They may also use witness accounts, communications, records, location data, and other circumstances to support or test parts of that account. The prosecution must still prove the charged offense beyond a reasonable doubt with admissible evidence; the absence of physical evidence neither rules out a case nor guarantees a conviction.
Can a case proceed without DNA, injury, or other physical evidence?
Yes. Physical evidence is not invariably available or decisive, and its absence does not automatically make prosecution legally impossible. The U.S. Department of Justice’s Office on Violence Against Women says in its May 2024 Framework for Prosecutors to Strengthen Our National Response to Sexual Assault and Domestic Violence Involving Adult Victims that “Most sexual assault and domestic violence prosecutions rely on the victim’s account.” The framework notes that these crimes often occur without witnesses or video and rarely produce dispositive physical evidence.
That does not mean an allegation is proof of itself. A complainant’s account is evidence for the fact finder to assess alongside any other admissible evidence. The person’s role as complainant or victim does not, by itself, resolve whether the allegation is true.
What evidence can support the account?
Investigators may use the complainant’s account to guide inquiries into events before, during, and after the alleged assault. Other evidence may support details in that account, challenge them, or provide context. It need not independently establish that an assault occurred to be relevant to how jurors assess the evidence.

- Witness observations: Someone may have seen the complainant or accused before or after the event, or observed the complainant’s condition or demeanor. That person may not have witnessed the alleged assault.
- Communications: A message, statement to a friend, or emergency call may help establish what was said or when. Whether a particular statement can be admitted for its truth depends on the applicable evidence rules; its existence alone does not prove the allegation.
- Records and digital evidence: The DOJ framework gives payroll records and cell-site data as examples that may help assess timing, absence, or location. Such information must be obtained and admitted lawfully, and its meaning should not be overstated: a record that bears on a detail is not automatically proof of the charged act.
- Place and context: Investigators may compare a description of the setting or a distinctive detail with other evidence about that location.
- Expert or clinician testimony: A qualified witness may help jurors understand particular evidence or behavior, subject to admissibility and case-specific limits. An expert does not decide whether the offense occurred.
Corroboration is not necessarily a separate legal requirement. The DOJ framework says independent corroboration requirements generally no longer apply in sexual-assault cases, while recognizing that jurisdictional differences remain. Evidence rules govern whether particular supporting material may be presented and how it may be used.
How do prosecutors assess credibility and decide whether to charge?
When there is no eyewitness or recording, credibility may be central. The DOJ framework cautions prosecutors against treating a case as unprovable simply because it depends on the complainant’s account. It recommends investigating the facts and context rather than relying on assumptions about how a victim would behave.

Delayed reporting, lack of resistance, continued contact, or demeanor should not be treated as automatic proof for or against an allegation. Prosecutors must assess the evidence and whether it is admissible and credible under the law that applies. The DOJ framework states: “Allegations unsupported by law and admissible, credible evidence must be declined for prosecution.” A decision to investigate or charge is not a finding of guilt.
What must the prosecution prove at trial?
The prosecution must prove every element of the charged offense beyond a reasonable doubt. The elements depend on the statute and jurisdiction. Do not assume that lack of consent, force, injury, or resistance is defined as an element in the same way everywhere; the applicable law and jury instructions control.

The burden does not fall because physical evidence is missing. The fact finder—usually a jury—decides whether the admissible evidence proves the charged offense to the required standard. Testimony alone may be legally sufficient in some circumstances, but that does not mean every case based on testimony will satisfy the burden or result in a conviction.

State and federal law may differ on offense definitions, corroboration, admissibility of statements, and other evidence. Federal Rule of Evidence 412 is one example: in proceedings involving alleged sexual misconduct, it generally limits evidence offered to prove an alleged victim’s other sexual behavior or predisposition. It has defined exceptions in criminal cases, including specified evidence concerning sexual behavior with the accused and evidence whose exclusion would violate constitutional rights. This federal rule is not a complete statement of state law, and case-specific rulings matter.

For a particular case, the relevant questions are which jurisdiction and offense are involved, what evidence can be admitted, and what the jury will be instructed to decide. The DOJ framework is national guidance, not a substitute for local law or legal advice about an individual case.
