That openness also does not, by itself, prove that a model protects privacy or behaves safely.
What does open-source AI actually mean?
“Open source” is often used loosely in AI discussions. For a precise claim, ask whether a specific release meets the OSI Open Source AI Definition 1.0, then inspect its materials and legal terms. The definition is a named standard from the Open Source Initiative (OSI), not a universal label that settles every legal question.
OSAID describes the freedoms to use a system for any purpose, study how it works, modify it, and share it. It says: “Use the system for any purpose and without having to ask for permission.” It also calls for the preferred form for making modifications, including relevant code, model parameters, and information about the data used. Read the Open Source AI Definition 1.0.
Are open weights the same as open source?
No. Weights are the learned parameters of a model: they encode patterns acquired during training and are often what people download to run or adapt a model. They are important, but they are only one part of the release.

OSAID says “Open Source models” and “Open Source weights” must also include the data information and code used to derive those parameters. A weights-only release can allow useful adaptation or deployment, yet still leave out materials needed to understand how the system was prepared or to reproduce modifications. OSI explains the distinction in its open-weights explainer.
What materials and permissions should a release provide?
Check the actual release—not just a product page or the phrase “open source”—against the definition’s freedoms and materials. These checks cover openness; privacy evidence is a separate practical assessment.

The first five checks reflect OSAID’s freedoms and required materials. The last is a separate question: OSAID is not a privacy certification. The definition and OSI’s FAQ explain the criteria and data-information requirements.
Does open-source AI mean the training data is public?
No. OSI’s FAQ distinguishes among open, public, obtainable, and nonpublic data that cannot be shared. The requirements differ: open data should be shared; for public or obtainable data, the release should provide detailed access information; and for legally unshareable nonpublic data, it should provide a detailed account of the data and how it was collected. The FAQ’s rationale includes cases where redistribution would be unlawful or inappropriate, such as private or sensitive information. See OSI’s data guidance.

That account can help people understand a dataset’s characteristics and potential bias, or create analogous data. It does not make the original data public, remove privacy risk, or prove that a trained model cannot reveal sensitive information. Data-sharing and privacy obligations also depend on jurisdiction and context.
Is an open-source AI model private or safe?
Not necessarily. “Open source” concerns permissions and access to materials for studying and modifying a system. Privacy concerns how personal data is collected, handled, exposed, and protected. The questions are related, but one does not answer the other.

Likewise, the definition does not establish a model’s safety performance or guarantee how it will behave in a particular deployment. Assess privacy and safety claims on their own evidence, including relevant evaluations and the practices used to operate the system. Documentation about training data is useful context, not proof that sensitive information cannot be exposed.

Do not infer that an entire AI system is open source because its weights are described as “MIT,” or because a code repository uses an OSI-approved software license. OSAID refers to OSI-approved licenses for code and OSI-approved terms for parameters. OSI uses “terms” because the appropriate legal mechanism for parameters is not settled; it does not take a position on whether parameters are copyrightable. The definition also permits conditions such as share-alike requirements. OSI’s FAQ discusses the legal nuance.

The definition is a standard’s criteria, not a court’s determination of legal status. Read the terms applying to each component and version, including any conditions on use, modification, and redistribution. A broad marketing label cannot replace that check.
What does OSI’s list of example models establish?
OSI’s FAQ says Pythia (Eleuther AI), OLMo (AI2), Amber and CrystalCoder (LLM360), and T5 (Google) passed a validation phase during development of the definition. OSI describes that work as a learning exercise, not certification. It says it does not validate or review individual AI systems in the way it reviews software projects. These are historical examples reported in the FAQ—not a current endorsed-products list or a fresh audit of today’s releases. Check the exact version, materials, and terms before making a present-day claim. Read the FAQ’s explanation.
