UKNova shut down its tracking service in August 2012 after receiving a cease-and-desist notice from the Federation Against Copyright Theft (FACT). The site said it excluded commercially available programmes and removed links when rights holders raised concerns, but its operators said they could not afford the risk of a lengthy legal fight. That was the site’s stated reason for closing—not a court ruling that settled whether UKNova was lawful or unlawful.
Why did UKNova shut down in 2012?
UKNova had operated for nearly a decade, according to TorrentFreak’s August 2012 report. It was intended to help people access UK television programmes they had missed or could not watch because of geographic restrictions.
In August 2012, the site’s operators said they received a cease-and-desist notice from FACT. They reported removing links they understood might be connected with two FACT member companies and asking FACT to identify examples. The report characterized FACT’s position as being that links or access were infringing unless UKNova could prove explicit permission from the copyright holder. That was FACT’s reported position, not a court’s finding about the site.
A UKNova administrator told TorrentFreak: “Whilst we believe that FACT are wrong both legally and morally on account of the strong ‘no commercial content’ stance that we have always taken, we are not in a position to be able to risk lengthy and costly court battles to prove this,” The site stopped its tracking service; its forum community reportedly continued.

What did UKNova mean by its “no commercial content” rule?
UKNova’s operators said the site did not allow programmes commercially available through DVD, premium television channels, or pay-per-view. They also said they had historically dealt with complaints by removing material. Those descriptions came from the operators; they are not an independent audit of every item on the tracker.
The distinction matters: a site’s voluntary rules describe what its operators intend to allow, but do not by themselves establish that each copyright owner authorized each link or access to a programme. FACT’s reported demand for proof of explicit permission and UKNova’s confidence in its own restrictions were competing positions. The sources do not show that a court resolved that dispute for UKNova.

Was UKNova found liable by a court?
The accounts of the 2012 shutdown report a notice, the parties’ positions, and the operators’ decision to avoid the expense and risk of litigation. They do not establish a judgment finding UKNova liable, nor one clearing it.
A separate 2013 High Court case, EMI Records Ltd & Ors v British Sky Broadcasting Ltd & Ors [2013] EWHC 379 (Ch), considered whether The Pirate Bay communicated protected recordings to the public. It concerned a different site and different proceedings; it is wider context, not a ruling on UKNova. A separate 2013 report about a City of London Police initiative against sites alleged to provide unauthorized material for criminal gain is also period context, not evidence of action against UKNova or a description of current enforcement policy.

Why did UKNova close again in 2016?
UKNova was revived by independent users in 2013, according to a 2016 TorrentFreak retrospective, with the original rule against commercially available material. The revived site’s final closure in August 2016 had a different immediate context from the FACT intervention four years earlier.
| Closure | Reported trigger or context | Evidence |
|---|---|---|
| August 2012 | FACT cease-and-desist notice; operators cited the risk and cost of lengthy court proceedings. | Contemporaneous reporting quoting the operators and describing FACT’s position. |
| August 2016 | The retrospective says legitimate services and near-immediate DVD availability reduced the programmes eligible under UKNova’s rules; it also reports declining forum activity and membership. | A retrospective published in 2016. |
The 2016 account names BBC Store and Amazon Video as examples of services that had changed the content landscape. Those are historical references in that account, not confirmation of either service’s present availability, territory, or price.
