There is no single person automatically responsible when AI-assisted work causes harm. Depending on the facts and applicable law, responsibility may involve the system provider, the organization that deployed it, and the person who used or relied on its output. The key questions are who controlled the system and decision, what duties applied, what review was possible, and how the AI output contributed to the harm.
Responsibility depends on the role each actor played
An AI system does not take over legal responsibility simply because it generated a recommendation, draft, score, or decision. Investigators generally need to identify the people and organizations involved and examine their conduct under the laws and duties that apply in the relevant jurisdiction. A provider’s regulatory obligations, an employer’s workplace duties, a professional’s standard of care, and a party’s civil liability are related questions—but they are not interchangeable.

This is an accountability map, not a universal legal test. The applicable duty, causal connection, evidence, and available remedy vary by jurisdiction and type of harm.
What “human oversight” needs to mean
A human review step is not meaningful just because someone clicked “approve.” To assess whether oversight could prevent or limit harm, ask whether the reviewer had the information, time, competence, and authority needed to understand the system’s limits and act on concerns. Could they interpret the output, question it, disregard or override it, or intervene and stop the system when appropriate to the risk and context?

Those practical questions are particularly important when a person is expected to exercise independent professional judgment. If a workflow gives a reviewer no realistic chance to challenge an output, the existence of a human checkpoint alone says little about the quality of oversight.
What the EU AI Act says about providers and deployers
The EU AI Act, Regulation (EU) 2024/1689, is a risk-based regulation; it is not a general rule that assigns every AI mistake to one party or decides every claim for damages. For covered high-risk systems, Article 14 requires systems to be designed so that natural persons can effectively oversee them. The required measures are to be proportionate to the risks, the system’s autonomy, and the context of use.

Article 26 sets out responsibilities for deployers of covered high-risk systems, including assigning oversight to people with appropriate competence, training, and authority, and monitoring the system’s operation. Providers have system-side obligations. Which requirements apply depends on the system, its intended use, the actor’s role, and the relevant provisions of the Act.
The Act applies in phases, so there is no single start date for all duties. The European Commission states that general-purpose AI provider obligations applied from 2 August 2025, while some high-risk categories have later application dates. Check the specific provision, system category, and current consolidated text before relying on a particular compliance date.

Employment uses can be high risk
The Commission identifies certain AI uses in recruitment, selection, and work-related decision-making as high risk because they can affect careers, livelihoods, and workers’ rights. Whether a particular system falls within a category depends on its intended use and the law’s scope. A high-risk classification is a regulatory designation; on its own, it does not prove that an employer or vendor owes damages for a particular outcome.
How to assess a real incident
For an actual dispute, the analysis should be specific to the place, sector, decision, and harm involved. These questions help organize the facts without assuming a universal liability rule:

- Who had control? Identify who selected, supplied, configured, integrated, supervised, and acted on the system.
- What duty may apply? Consider potentially relevant regulatory, contractual, employment, professional, privacy, intellectual-property, negligence, or product-law duties.
- What review was possible? Establish what the human reviewer knew, could access, was authorized to do, and had a reasonable opportunity to check or change.
- How did the output contribute? Trace how the AI result entered the workflow and affected the decision or harm. An error alone does not establish who is legally responsible.
- What evidence connects the events? Preserve the records that show what the system received, returned, and led people to do.
- Which jurisdiction and remedy apply? The governing law and available ways to seek redress depend on where and how the incident occurred.
Preserve the decision trail
Keep the input and output, model and version information, configuration details if available, prompts or workflow instructions, review records, timestamps, warnings, the decision rationale, and records of the resulting harm. These materials can help establish how the tool was used and whether oversight or monitoring occurred. Their relevance and any preservation obligations depend on the circumstances; seek jurisdiction-specific legal advice for a live claim.

The National Institute of Standards and Technology (NIST) describes its AI Risk Management Framework as intended for voluntary use to improve the incorporation of trustworthiness considerations into AI products, services, and systems. The framework can help an organization structure risk-management work, but following it does not, by itself, decide who is legally responsible for an incident.

What is known about the proposed AI Liability Directive?
The proposed EU AI Liability Directive should not be described as enacted law based on the evidence available here. A 2025 Council of the EU document reported that the Commission’s 2025 Work Programme announced an intention to withdraw the proposal. That report supports describing an announced intention; it does not establish that formal withdrawal was completed. Its status should be checked against an official legislative record before making a current claim about its disposition.
