Before connecting or enrolling in a brain-computer interface (BCI), find out what it records or infers, where that information goes, who can access it, how long it is kept, and whether you can limit or delete it. Then review the device, companion app, and service together: a privacy choice in one part may not control data collected or processed elsewhere. The risks also depend on the device. A head-worn EEG product is not equivalent to an implanted system that records and can modulate brain activity.

What information can a BCI collect?

A BCI uses brain signals to control a computer or another device. Depending on its design and service, the information involved may include raw or processed neural signals, device telemetry, account details, performance or behavioral data, and inferences derived from the signals. A device may also collect signals beyond brain activity: the Future of Privacy Forum and IBM’s November 2021 report gives the example of a noninvasive EEG device measuring neural data alongside eye, muscle, and heartbeat signals.

Do not assume that a device only collects the signals needed for immediate control. Check its privacy notice and settings for the full range of information, purposes, storage locations, and recipients. Ask whether data are used for analytics, product improvement, model training, advertising, or research, and whether those uses are optional.

How device type changes the privacy questions

BCIs vary in invasiveness, purpose, processing, and capability. In particular, whether a system only reads signals or also stimulates or modulates neural activity matters: a security or privacy failure involving a system that can affect neural activity may pose risks beyond disclosure of information. The examples below describe categories, not the practices of any particular product.

Noninvasive, head-worn EEG Consumer-facing or other uses may involve EEG alongside eye, muscle, or heartbeat signals. FPF/IBM, November 2021. Which signals and associated data are collected? Does processing stay on the device, pass through an app, or go to a server? Which optional data uses can be declined?
Implanted BCI Clinical-trial uses reported by the U.S. Government Accountability Office (GAO) include communication and robotic-limb control for people with severe disabilities. Some systems may record and modulate brain activity. What neural and device data are collected, who can access them, and what happens to data and service access after a trial or support period ends?

The GAO also describes developing workplace, defense, entertainment, and consumer uses. These categories do not mean investigational implanted systems are generally available consumer products. Features, data practices, and controls must be checked for the specific device and service.

What to check before enrolling or connecting a device

Read the device terms, privacy notice, and companion-app settings together. The GAO’s December 17, 2024 assessment reports that experts found the purposes for collecting BCI data and who may access it can be unclear in user agreements. Use the following checklist to make the policy concrete:

  • Data: List neural signals, processed signals, telemetry, account information, behavioral or performance data, and derived inferences the service collects.
  • Purpose: Identify which data support core operation and which may be used for analytics, research, advertising, product improvement, or model training.
  • Flow and storage: Ask what is processed on the device, in the companion app, and on remote servers. Find out where data are stored and whether local storage is an option.
  • Access and sharing: Check which employees, contractors, service providers, research partners, or other third parties can access data, and for what purpose.
  • Retention and deletion: Find the retention period and determine whether deletion covers raw signals, processed data, account information, derived profiles, backups, and research copies.
  • Choice and consequences: Check whether collection, sharing, analytics, and research participation can be controlled separately, and whether declining optional use affects core functionality.
  • Change over time: Save the terms and settings shown at enrollment so you can compare them if the provider changes its practices.

Prefer specific, separate controls over a general assurance in a long policy. Do not assume a control exists—or that it works the same way—without checking the settings for your model and app.

Questions to ask about privacy and security safeguards

FPF and IBM’s November 2021 report recommends safeguards across on-device, companion-app, and server processing. These are recommendations, not confirmation that any particular vendor uses them. Ask the provider:

  • Can collection be paused or disabled? Is there a hardware off switch where appropriate?
  • Can the system process data locally, or is cloud processing required? Can you choose local storage?
  • Is sensitive personal neurodata encrypted in transit and at rest? Who holds the encryption keys, and who has operational access?
  • Can you delete raw signals, processed data, account data, and derived profiles? What remains in backups or research copies?
  • Are research, advertising, model-training, and product-improvement uses optional and separately controllable?
  • What happens to your device support and data access if a trial ends or the provider stops operating?

Data minimization, privacy by design, encryption, and privacy-enhancing methods such as differential privacy are among the practices discussed in the FPF/IBM report. Their relevance depends on how a system works; a provider’s claim should identify which data and processing the safeguard covers. De-identification approaches may also be relevant, but should not be treated as proof that data cannot be linked back to a person.

How U.S. regulation and privacy protections differ

Medical-device oversight and privacy protection are separate questions. The U.S. Food and Drug Administration (FDA) says it issued final guidance on May 20, 2021, for implanted BCI devices intended for patients with paralysis or amputation. That guidance covers nonclinical testing and clinical considerations for medical-device development; it does not establish that a particular product has privacy controls or that nonmedical BCIs follow the same pathway.

In its December 17, 2024 report, the GAO said experts had identified no mandatory, unified U.S. framework covering both medical and nonmedical BCIs. The report discusses examples of state laws, including in California and Colorado, that may extend to BCI-associated data, while noting uncertainty about how some nonmedical data or developers fit legal categories such as sensitive, identifiable, biometric, or biological information. It also identifies the NIST Privacy Framework 1.0 as voluntary cross-sector risk guidance. This is not a current fifty-state legal survey: applicable protection depends on jurisdiction, the use, and the facts. Check current rules for your location and situation rather than assuming all BCI data are either protected or unprotected.

What BCI-specific privacy standards are available?

ISO lists ISO/IEC WD 27505.2, “Privacy in brain computer interface (BCI) applications,” as a working draft under development. Its abstract says it provides BCI-specific privacy requirements and guidance based on ISO/IEC 29100 and ISO/IEC 27701. The ISO status page showed working-draft activity and committee progression in 2026; a working draft is not a published international standard, and its status can change.

The American Psychological Association has also stated in a resolution that neural data is highly sensitive and that individuals should have a basic right to mental privacy. That is a policy position, not itself a description of enforceable legal rights.
