Data residency is where data is physically stored; data sovereignty is which jurisdiction’s laws and authorities may govern access to it. Keeping data in a local cloud region can help meet a location requirement, but it does not by itself settle which laws may apply to a provider, its staff, or its operations. Data localization is related: it is a rule or policy restricting where data may be stored or processed.
Data residency, sovereignty, and localization compared

The Treasury Board of Canada Secretariat defines residency as “the physical or geographic location of an organization’s data while at rest,” and distinguishes sovereignty as a country’s right to control access to and disclosure of information subject to its legislation. Canada’s Guideline on Service and Digital provides these definitions in a federal-government policy context.
Does storing data locally make it sovereign?
No. A selected region addresses a physical-location question, not every legal or operational question. The Government of Canada’s cloud security risk-management paper explains that data in a cloud environment may be subject to foreign-country laws even when cloud resources are physically located in Canada. That is a Canadian public-sector analysis of risk, not a universal legal conclusion about every provider or jurisdiction.
Location is only one factor. The provider’s legal entities and operating jurisdictions, who can administer or support the service, subcontractors, and the service contract can all matter. The applicable result depends on the country, data type, sector, provider structure, and the precise rule involved. A region selector is not a substitute for legal review.

Do data residency laws mean all data must stay in-country?
No universal rule requires every personal, government, or regulated dataset to remain within national borders. Rules differ in scope: some concern storage, others processing or transfers, and many apply only to defined types of information or organizations.
Canada: requirements depend on classification and context
Canada’s federal guideline says its residency requirement concerns storage, not data in transit. For specified sensitive Government of Canada information—Protected B, Protected C, or classified—it directs departments to identify and evaluate facilities in Canada or within designated Government of Canada premises abroad as a principal delivery option. The same guidance says those facilities need not be owned by a Canadian corporation, and calls for consideration of legal and contractual requirements, trade agreements, market availability, technical capabilities, reputation, and business value. These are federal public-sector provisions, not a blanket rule for all Canadian private-sector data. Read the guideline.

European Union: a defined localization rule for non-personal data
Regulation (EU) 2018/1807 concerns electronic data other than personal data within its scope. It defines a localization requirement as one that requires processing in a specific Member State or hinders processing in another Member State. The regulation generally prohibits covered requirements unless justified on public-security grounds in accordance with proportionality, while preserving requirements under existing Union law. It also preserves competent authorities’ access powers under applicable Union or national law. This is not a general ban on data residency: the regulation has a defined scope and exceptions, and mixed datasets need particular care. See Regulation (EU) 2018/1807.
United Kingdom: an example of controlled overseas placement
UK Government guidance published 5 February 2025 says OFFICIAL government data, including SENSITIVE, may be stored and processed overseas when satisfactory legal, data-protection, and security practices are in place. It states there is no universal requirement for OFFICIAL data to be physically located in the UK and supports a controlled, considered multi-region approach compatible with UK law. This guidance is limited to the stated government classification; it is not a blanket rule for all UK data. See the multi-region cloud and SaaS guidance.

How to assess a cloud or hosting service
Do not compare providers only by the name of a storage region. Map the dataset and service end to end, then compare the consequences of each option.
- Define the data and applicable rules. Identify personal and non-personal data, sector obligations, public-sector classification, and whether relevant rules cover storage, processing, access, or transfers.
- Map physical placement. Confirm where primary data, replicas, backups, logs, and disaster-recovery copies are stored. Check whether the service’s location commitments cover each of them.
- Map processing and access. Ask where data is processed, managed, supported, or made accessible; which provider personnel and subcontractors can reach it; and what access is logged.
- Identify legal entities and jurisdictions. Determine which entities supply the service, where they operate, and which laws may apply to those entities and the data. Do not infer the answer solely from the data-center location.
- Review technical and contractual controls. Check encryption, who controls the keys, access controls and logs, breach and compelled-disclosure terms where lawful, and whether you can export or delete the data.
- Weigh resilience and business trade-offs. Consider multi-region recovery, availability, feature availability, cost, market choice, and the operational consequences of a strict location restriction.
These are evaluation questions, not a single preferred architecture. The right choice depends on the organization’s obligations, threat model, service requirements, and tolerance for trade-offs. None of the cited guidance establishes compliance for a particular organization, provider, or cloud plan; that requires analysis of the specific data, operations, contract, and applicable law.
