What web-page evidence can show in a UDRP case
The Uniform Domain Name Dispute Resolution Policy (UDRP) concerns three elements: whether the complainant has trademark rights to which the domain is identical or confusingly similar; whether the respondent lacks rights or legitimate interests; and whether the domain was registered and is being used in bad faith. Link each capture to a specific factual point in your case. A screenshot is not self-explanatory: identify what it shows and why it matters.
WIPO’s current Domain Name Disputes evidence guidance advises parties to provide evidence of bad-faith registration and use, including, where applicable, screenshots of the offending website, fraudulent emails, and prior correspondence with the registrant. The 2017 WIPO Overview 3.0 also described dated screenshots of the site to which a disputed domain resolves as an example of available evidence supporting arguments about conduct under UDRP paragraph 4(b). That Overview 3.0 edition is superseded; WIPO announced an updated Overview 3.1 in 2026, so consult Overview 3.1 for current consensus guidance rather than relying on old-edition wording.
WIPO’s process offers limited remedies: a panel may order transfer or cancellation of the domain, or deny the complaint; it cannot award monetary damages. The relevant procedural details and filing directions depend on the provider and case. See WIPO’s UDRP Guide and check the applicable provider’s current supplemental rules.

The National Archives notes that static screenshots do not retain hypertext functionality. The Library of Congress describes WARC records as documenting dates, record types, lengths, and related harvested resources or context. ISO 28500:2017 defines the WARC format; ISO says this edition was confirmed in 2023 and remains current. These descriptions concern the format, not the completeness or evidentiary weight of an individual capture. WIPO says panels may undertake limited research into public records when useful to deciding a case, including consulting historical resources such as the Internet Archive for indications of past domain use. That does not make an archive capture conclusive or remove the party’s responsibility to submit and explain organized evidence. WIPO’s example decision illustrates limited public-record research.

Capture and preserve a page as evidence
- Capture promptly. Open the full disputed URL, including its scheme and path, and record the page as it appears. If the domain redirects, record the original URL and destination and capture relevant stages where feasible.
- Record provenance. Keep a log with the full URL, date and time, time zone, capture operator, browser or tool, and an exhibit identifier. Note relevant context, such as a redirect, consent dialog, or page state, so a reviewer can understand what the image represents.
- Capture enough context. Ensure the image identifies the page and its relevant content. Take additional captures for separate pages, pop-ups, or states that one image cannot show. Do not rely on a crop that removes the location or other context necessary to interpret the exhibit.
- Preserve originals. Keep original screenshot files and related emails or correspondence unaltered. If you crop, annotate, redact, or convert a copy for filing, keep the original separately and identify the derivative as an edited copy.
- Add an archive capture when useful. If the issue requires more than a visual rendering, consider a WARC-capable workflow and retain the WARC file with its associated capture information. Verify what resources it contains; a WARC file is a container format, not proof the capture harvested everything.
- Prepare the filing copy. Match each exhibit to the factual proposition it supports, use a consistent exhibit identifier, and confirm the provider’s current file-size and file-format instructions. Those requirements are provider- and case-specific.
This is prudent recordkeeping, not a WIPO-mandated capture protocol. The reviewed WIPO materials identify dated screenshots as evidence examples but do not prescribe one universal capture tool or authentication method. Do not claim that a screenshot or archive capture proves when a page was first published.

What screenshots and archives cannot establish by themselves
- Legal admissibility or weight: The reviewed WIPO materials give dated screenshots as an evidence example but do not establish a universal authentication method or guarantee that a particular exhibit will be accepted or given decisive weight. Follow the applicable provider’s rules and case directions.
- First-publication date: A timestamp showing when you captured a page is not proof of when its content first appeared online.
- Complete page history: A single screenshot shows a rendered view at capture time, not every page state, resource, redirect, or earlier version.
- Complete preservation from a format alone: WARC can package payloads and related context, but the standard does not certify that a particular capture is comprehensive.
WIPO Overview 3.0 said a UDRP case generally involves a single round of pleadings and no discovery as such. Because that is older-edition guidance and Overview 3.1 was updated in 2026, consult the current edition and provider rules rather than assuming missing evidence can be obtained later through discovery.

Troubleshoot a weak or confusing capture
- The screenshot does not show the disputed URL: Preserve a separate capture or log entry with the full URL, timestamp, and destination. Do not silently crop away location context.
- A banner or pop-up obscures the relevant content: Capture the state as observed, then make a separate capture of the unobscured page if that state is relevant. Explain how the additional view was produced; do not present a cleaned image as though it were the untouched browser view.
- The site redirects, fails, or varies by state: Record the requested URL, final destination if any, capture time and conditions, and take separate captures of material states. Avoid treating one failed load as proof of the site’s behavior at other times.
- A Wayback page is absent or incomplete: State what archive was checked and what its capture shows, if anything. Do not infer that the page never existed merely because no usable capture is available.
- The WARC is hard to interpret: Preserve the file and associated capture information, inspect which resources and records it contains, and pair it with a legible screenshot that explains the visible point at issue.
- The exhibit exceeds filing limits or uses an unsupported format: Check the current instructions for the actual UDRP provider and case. Keep the original file separately and label any converted or reduced-size exhibit copy.
Frequently Asked Questions
Can a Wayback Machine capture be used in a UDRP case?
It may be useful historical corroboration, and WIPO identifies archive consultation as an example of limited public-record research. Its presence does not make the capture conclusive; submit and explain relevant material yourself.
