If you learn that your medical records may have been exposed online, contact the provider, insurer, or service through a verified channel, secure any affected accounts, and watch for signs that someone is using your information. Exposure does not by itself prove identity theft. The right complaint route depends on whether the organization is covered by HIPAA or another rule.
1. Verify the notice without giving information to a stranger
An unexpected call, email, or text about a breach could itself be an attempt to steal your information. Don’t click its links, call its numbers, or share health or account details in response. Instead, open the provider’s or insurer’s website using an address you already know, or call a phone number from a trusted statement or card.
Ask the organization whether your records were affected, what information was involved, when the exposure occurred, what it has done in response, and where to report suspicious activity. Keep the notice and note the dates, names, and case numbers associated with your contact. The FTC recommends verifying messages through a known-good website or phone number in its medical identity theft guidance.

2. Secure the account if you think someone accessed it
If the exposure may involve your login, go directly to the official website or app and change that account’s password. Choose a unique password you do not use elsewhere, and turn on multifactor authentication if the service offers it. If you reused the old password on other accounts, change it on those accounts too.

Changing a password can help prevent further access to an account; it cannot retrieve or erase a copy of records that has already been exposed.
3. Watch for signs of medical identity theft
Review mail, insurer communications, and bills for activity you do not recognize. The FTC identifies these as warning signs:

- A collection contact for medical debt you do not owe.
- Unfamiliar medical debt on a credit report.
- An insurer notice that you have reached a benefit limit you believe you have not used.
These signs deserve follow-up, but an exposure notice alone does not establish that anyone has used your information.

If you suspect misuse, ask each potentially affected doctor, clinic, hospital, pharmacy, laboratory, and insurer for the records it holds. Check for unfamiliar visits, services, prescriptions, or claims. Keep copies of what you receive and mark the entries you do not recognize.

For an incorrect medical record, send the provider a written correction request with a copy of the record and a clear explanation of what is wrong. Use a delivery method that confirms receipt and retain your request and supporting documents. The FTC says a provider must respond within 30 days and notify other providers who may have the same mistake; see its guidance on medical identity theft.
If a provider refuses access because information from a thief is mixed into your file, the FTC advises appealing through the organization’s privacy contact, patient representative, or ombudsman.

5. Check credit reports and report suspicious billing
Get your credit reports through AnnualCreditReport.com and look for medical collection notices you do not recognize. If you find suspicious medical billing or collection information, report the billing errors to all three credit bureaus through the recovery process at IdentityTheft.gov. The site can also help you create a recovery plan for suspected medical identity theft.

HIPAA does not cover every company that collects health information. It generally applies to health plans, health care providers conducting certain electronic transactions, health care clearinghouses, and relevant business associates. Some standalone health apps and other online services may fall outside HIPAA, though some may be subject to the FTC Health Breach Notification Rule or other laws. For an alleged HIPAA or Part 2 violation by an entity within OCR’s authority, you can submit a written complaint, including through its online portal. Describe what happened and identify the entity. OCR says complaints generally must be filed within 180 days of when you knew of the alleged violation, though it may extend the period for good cause. Details are in OCR’s complaint process.
An OCR complaint is not a substitute for asking the organization to investigate, disputing an inaccurate record, or challenging a bill. A privacy concern involving a non-HIPAA company may belong with the FTC instead; the applicable route depends on the company and conduct. HealthIT.gov discusses reporting concerns about non-HIPAA companies, and HHS explains the HIPAA and FTC scope distinction.
What a breach notice means—and what it does not
When a HIPAA-covered entity discovers a breach of unsecured protected health information, it must notify affected people without unreasonable delay and no later than 60 days after discovery. The notice should describe the incident and types of information involved, protective steps for affected individuals, the organization’s response, and contact information. This is the organization’s notification obligation, not a deadline for you to file a complaint or take action. HHS outlines the requirements in its Breach Notification Rule.
Some personal health record vendors, related entities, and service providers outside HIPAA may be covered by the FTC Health Breach Notification Rule. The FTC describes company reporting requirements that vary by incident size: for incidents affecting 500 or more people, the outer limit is 60 days after discovery; smaller incidents must be reported by the 60th day of the following calendar year. These are company reporting requirements, not a consumer filing deadline. The FTC explains the rule and reporting at HHS’s HIPAA and FTC overview.
Because some health apps are outside HIPAA, don’t assume every health detail shared online has the same legal protection. HealthIT.gov’s practical advice is: “Never post anything online that you don’t want made public.”
