Before approving an automated license plate reader (ALPR) system, require a documented purpose, a limited data plan, named and controlled access, enforceable vendor obligations, and a way to verify that safeguards work. If the vendor cannot explain where data goes, who can use it, how it is deleted, and how the system is secured and updated, pause procurement until those gaps are resolved.

Start with what the system would collect

An ALPR is more than a camera that reads a plate. A record can associate a plate identifier with a time and location. Depending on the configuration and image settings, it may also include a vehicle image and show the driver, passengers, or surrounding area. Records may be sent to central storage and searched later.

A single observation may reveal little on its own. A collection of time-and-location records can expose movement patterns or sensitive visits, especially if records are retained for a long time or combined with other information. The Electronic Frontier Foundation (EFF) describes this as a privacy risk; it is a risk assessment, not a legal determination about a particular deployment.

Before comparing products, map the whole system: cameras and other devices, communications links, applications and APIs, storage, user accounts, vendor support access, integrations, exports, backups, and any organizations that receive data. A general claim that a system is “secure” does not answer how its data is handled or shared.

Define the purpose and test whether ALPR is necessary

Write down the problem and intended result

Require the proposing team to identify the specific problem the system is meant to address, the locations and capabilities needed for that purpose, and an outcome that can be measured. “Improve safety” or “support investigations” is not a bounded purpose on its own. Specify who may use the system, for which tasks, and what would count as success.

Compare less data-intensive options

Ask whether the objective could be met with a narrower deployment, shorter collection window, fewer locations, or a different measure that gathers less information. Record the alternatives considered and why the proposed system is proportionate to the stated need. Set a date to reassess the need and a condition for pausing or ending the deployment if it is not met.

Compare deployment choices and data custody

Fixed, mobile, and trailer-mounted equipment differ in where and how they collect information. The right comparison is not just camera coverage: include collection context, operating procedures, and who controls the equipment. Ask the proposer to document the actual configuration rather than assuming a deployment type has a particular privacy or security outcome.

Choice What to evaluate
Fixed Proposed locations, field of view, hours of operation, and whether the coverage is limited to the documented purpose.
Mobile Who operates the equipment, when it is active, what routes or locations are covered, and how operators document and supervise use.
Trailer-mounted Who controls and relocates it, how each placement is approved, and how its field of view and operating period are recorded.

Also establish whether the system is vendor-hosted or organization-hosted. Hosting location alone does not establish who can access the records or control them. Ask who administers accounts, handles patches, can provide support, manages backups, fulfills deletion requests, and can authorize exports or sharing. Compare proposals on those responsibilities and on the organization’s ability to audit them.

Minimize collection and set retention before purchase

Specify what is collected and kept

Ask whether the system captures every passing plate, retains only records tied to an identified purpose, or uses another design. Distinguish plate-read data from images, non-alert scans, alerts, user queries, and audit logs. For each category, state whether it is collected, retained, and made searchable, and whether collection or retention can be reduced.

The Federal Trade Commission’s connected-device guidance recommends limiting collection to what is needed and retaining it only for an essential period. Apply that principle category by category rather than adopting a single unexplained retention period for everything.

Make deletion verifiable

Put a defined retention schedule in policy and contract. Ask how deletion works for primary storage as well as backups, exported files, evidence holds, vendor copies, and copies shared with partners. Require the vendor to describe how deletion is verified, who certifies it, and what happens at contract termination. Indefinite retention should not be the default; require a specific legal or operational basis for any exception.

Control access, searches, and sharing

Restrict and review access

Identify every user group and administrator, including vendor personnel and support staff. Require individual accounts, strong authentication, consideration of multifactor authentication, least-privilege permissions, and logs that show who searched what and when. Define approved query purposes and ask whether supervisors review access, how often permissions are recertified, and how unusual searches are investigated. These controls are consistent with FTC guidance on authentication, administrative permissions, and monitoring.

Do not treat a written rule as proof that access is controlled. Ask to see how the system enforces permissions and produces usable logs, who reviews those logs, and how misuse is escalated and documented.

Trace every recipient and secondary use

Require a data-flow map that names each agency, partner, platform, subcontractor, and other recipient, including onward-sharing paths. Specify in policy and contract which recipients and purposes are permitted. Ask whether vendor staff can view records, whether records are used for analytics or product improvement, and whether data can be sold, transferred, or queried across a broader network. Evaluate the actual sharing design, not a broad assurance about security.

Evaluate security across the full system lifecycle

Request evidence for safeguards covering the device, accounts, communications, interfaces, storage, vendor access, updates, and eventual deletion. FTC guidance supports effective authentication, limited administrative permissions, secure remote access, timely vulnerability review, monitoring, and reasonably secure updates. Ask the vendor to explain how those controls are implemented and maintained in the proposed system.

  • Encryption: Is data encrypted in transit and at rest, and how are encryption keys managed?
  • Remote access and interfaces: How is vendor or administrator access secured? How are APIs and other integrations authenticated, restricted, and monitored?
  • Network and storage: Are system components appropriately segmented, and what protections prevent unauthorized access to stored records?
  • Vulnerabilities and updates: How are vulnerabilities reported and reviewed, what is the patch process and cadence, and how long will the product receive security support?
  • Testing and monitoring: What independent security testing has been performed, what is monitored for suspicious activity, and how are findings and remediation tracked?
  • Incidents: What is the incident response process, who is notified, and what assistance will the vendor provide?

Ask for evidence rather than relying on a security checklist or policy statement alone. The proposed controls should cover the system as operated, including integrations and vendor support—not only the camera.

Put vendor duties and organizational oversight in writing

Identify the system operator, hosting provider, subcontractors, and every organization that processes the data. FTC guidance recommends vendor oversight and contractual security expectations. The contract should make the safeguards enforceable and align them with the organization’s policy.

  • Limit data use, access, sharing, and secondary use to specified purposes and recipients.
  • Require appropriate access controls, security practices, incident notice, and cooperation during response.
  • Set audit rights and require information needed to verify compliance and investigate misuse.
  • Define vulnerability remediation, patching, and product-support obligations for the contract term.
  • Specify retention, deletion, handling of backups and copies, and verifiable deletion at termination.

Operationally, assign an accountable owner, train users on approved purposes, review access logs, investigate suspected misuse, and provide meaningful notice appropriate to the deployment. A public usage and privacy policy can explain purpose, data handling, access, and oversight. Its existence does not substitute for implementation, log review, and audit results.

Rules vary by jurisdiction and operator. EFF’s summary of California’s framework describes requirements that include a policy, logging, public comment before implementation, and restrictions on public-agency data transfers. Treat these as California-specific points to verify with counsel, not nationwide requirements. The Privacy Act’s safeguard requirement applies to covered federal agency records systems; it is not a general law for every private company or local agency.

Assess harms, benefits, and the decision to proceed

Review risks tied to the actual proposed use, including inaccurate plate reads, inappropriate alerts, unauthorized searches, a security compromise, and expansion of access or sharing beyond the original purpose. For each risk, identify who could be affected, how it could occur, what safeguard would reduce it, and who is responsible for checking that safeguard.

Use the same comparison criteria for every proposal so that a strong claim in one area does not obscure a gap in another.

Data minimization Data categories collected and retained, including images and non-alert scans, and available limits.
Retention and deletion Category-specific schedule and deletion process covering copies, backups, and termination.
Access and accountability User and administrator roles, authentication, query rules, logs, review, and misuse response.
Sharing Complete data-flow map, authorized recipients, permitted purposes, and onward-sharing limits.
Technical security Evidence on encryption, remote access, interfaces, monitoring, testing, vulnerability handling, and updates.
Vendor terms Enforceable limits, incident duties, audit rights, remediation, support, and deletion obligations.
Oversight and operating burden Named policy owner, training and review responsibilities, notice, and resources needed to sustain controls.

Proceed only if the organization can state a bounded purpose, justify the data and retention period, identify every party with access, demonstrate technical and operational safeguards, and enforce restrictions through policy and contract. Pause or reject procurement if the vendor will not disclose data flows, cannot provide meaningful deletion or audit mechanisms, permits unbounded secondary use, or lacks a credible security and update plan. This is a practical decision rule, not a universal legal test; have counsel determine the requirements that apply to the particular deployment.
