Yes—but the 25% Section 232 chip tariff that took effect on January 15, 2026, applies to a specifically defined set of advanced computing chips and derivative products, not to every semiconductor or device containing one. Product classification, technical thresholds, and declared end use all matter. The January action also described broader tariffs as a possibility, not as an already-effective universal duty.
What Section 232 chip tariffs mean
Section 232 is a U.S. trade authority used to address imports found to threaten national security. The Bureau of Industry and Security (BIS) says Commerce investigates and reports to the President; the President may concur or not with the recommendations and take action to adjust imports or take other action. BIS’s Section 232 overview describes the process.
Commerce began its semiconductor investigation on April 1, 2025. The investigation covered semiconductors, semiconductor manufacturing equipment, and derivative products, including substrates, bare wafers, microelectronics, equipment components, and downstream products containing semiconductors. That broad investigative scope is not the same as the narrower set of goods subject to the January 2026 duty. The Federal Register notice documents the investigation’s scope.
Which products face the 25% duty?
President Donald Trump’s January 14, 2026 proclamation imposed a 25% ad valorem duty on specified covered products entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. Eastern Standard Time on January 15, 2026. The proclamation says the duty is additional to other applicable duties except where it provides otherwise. The proclamation sets out the operative terms.

The White House named NVIDIA H200 and AMD MI325X chips as examples of advanced computing chips. That does not make those examples a complete product list or determine the treatment of a particular import. Customs and Border Protection (CBP) identifies HTSUS headings 8471.50, 8471.80, and 8473.30 in its entry guidance, which also sets out performance and DRAM-bandwidth thresholds for covered logic integrated circuits and articles containing them. For an actual shipment, verify the product’s classification and technical specifications against the proclamation annex, complete CBP guidance, and current HTSUS notes. The policy documents do not establish the classification of every chip or finished device; an importer may need qualified customs advice.

Are all semiconductors and chip-containing devices covered?
No. The investigation considered a wide range of semiconductor-related imports, but the January proclamation’s immediate 25% duty applies to products meeting its specific definitions and technical criteria. It is not a blanket 25% tariff on all chips, semiconductor manufacturing equipment, or electronics that contain a chip.

The proclamation lists use-based exceptions for covered products imported for:

- Use in U.S. data centers.
- Repairs or replacements performed in the United States.
- U.S. research and development.
- U.S. startups.
- Non-data-center consumer applications.
- Non-data-center civil industrial applications.
- U.S. public-sector applications.
- Other uses the Commerce Secretary determines contribute to strengthening the U.S. technology supply chain or domestic manufacturing capacity for semiconductor derivatives.
An exception depends on the applicable classification, end use, and certification or administrative requirements. A product’s name or capabilities alone do not establish that it qualifies; importers should follow CBP instructions and assess the facts of the shipment.
How does the duty interact with other tariffs?
For products covered by the proclamation, its terms and duties control over another Section 232 proclamation. It also excludes covered goods subject to this clause from specified duties imposed under Executive Orders 14257, 14193, and 14194. These provisions do not eliminate every other customs duty or charge: the proclamation says its 25% duty is additional to otherwise applicable duties except where it specifically says otherwise. It also provides that drawback is unavailable for duties imposed under this proclamation.

The January proclamation directed Commerce and the U.S. Trade Representative to pursue or continue negotiations. It said broader, significant tariffs and a tariff-offset program could be considered depending on the negotiations’ status or outcome; the White House fact sheet likewise described broader tariffs as a possible future step. Those statements do not establish that such broader tariffs took effect. The official materials cited here substantiate the January 2026 duty, not a universal semiconductor tariff. Because trade measures and entry instructions can change, check for later proclamations, Federal Register notices, CBP guidance, and current HTSUS notes before relying on this summary.

The proclamation says the Commerce Secretary sent the investigation report to the President on December 22, 2025, and found that imports, in their quantity and circumstances, threatened to impair national security. The government’s stated rationale was that U.S. production capacity for semiconductors, certain equipment, and derivative products was insufficient to meet domestic demand, creating dependence on foreign sources. This is the administration’s finding and explanation; the cited public materials do not independently establish it as a market statistic.
