Cloud data compliance is an ongoing responsibility for the organization using the service. A provider may operate important security controls, but the organization must identify which rules apply, assess the provider and its contract against those requirements, and keep checking that controls work over time. The right requirements depend on your data, industry, services, contracts, and jurisdictions; there is no universal cloud-compliance checklist.

Which rules and obligations apply to your cloud data?

Start with the facts about your own operations rather than a generic list of regulations. Inventory the information you store or process, the cloud services and systems involved, the people and teams with access, and the jurisdictions connected to your organization, users, and data. Identify whether the information includes personal data, business records, or other regulated material.

Then determine the legal, contractual, and internal-policy requirements that follow from those facts. Relevant issues can include where data is located, privacy and security controls, records management, and electronic discovery. These are important considerations, not an exhaustive inventory of possible obligations. NIST’s SP 800-144 offers broad guidance for public-cloud security and privacy, but it is not a jurisdiction-specific legal checklist.

How do you assess whether a cloud service meets your requirements?

Turn each applicable obligation and internal policy into a requirement you can evaluate. For example, specify what control or process is needed, what evidence would demonstrate it, and who must provide or review that evidence. Compare the actual service offering and its terms with those requirements; a provider’s general compliance statement does not, by itself, establish that the service fits your organization’s duties.

  • Control fit: Do the service’s security and privacy controls address the requirements you identified?
  • Evidence and audit visibility: What control information can you access, and can you assess how controls perform over time?
  • Data location and legal fit: Where will data be held, and how might its location affect your obligations, records, investigations, or discovery needs?
  • Contract fit: Do the service terms address accountability, incident response, evidence, and other relevant requirements?
  • Operational oversight: Can your organization monitor the service and act on risks throughout its lifecycle?

If you are choosing among services, apply the same organization-specific requirements to each option instead of relying on a generic “most secure” ranking. NIST recommends assessing cloud offerings and contract terms against organizational needs and seeking visibility into provider controls.

Who is responsible for cloud data security?

The provider and customer may perform different security tasks, but outsourcing a service does not transfer the organization’s accountability for security and privacy. NIST co-author Tim Grance put it this way: “accountability for security and privacy in public cloud deployments cannot be delegated to a cloud provider and remains an obligation for the organization to fulfill.” (NIST, January 24, 2012.)

Make the division of work explicit. For each material security task, document who performs it, who supplies evidence, who receives incident communications, and how your organization verifies that the agreed work is being done. The allocation of operational tasks can vary by service and contract; accountability remains with the organization.

What should cloud security governance and monitoring include?

Extend your organization’s policies, procedures, and standards to cloud service selection, provisioning, deployment, use, and monitoring. Define who approves changes, reviews evidence, handles exceptions, and escalates risks. NIST recommends audit mechanisms that help determine whether practices are being followed, alongside visibility into provider controls and their performance over time.

Monitoring should inform ongoing risk decisions rather than end after initial onboarding. Establish a repeatable process to review control information, audit results, service changes, and identified risks, then decide whether existing safeguards remain adequate or need adjustment. NIST SP 800-53 Rev. 5 is a customizable security and privacy control catalog that can support risk management; using it does not, by itself, prove that an organization or cloud service is compliant.

How should you prepare for incidents and investigations?

Agree on incident-response arrangements before entering a cloud service contract. Clarify how incidents are communicated, what information and cooperation are available, and how responsibilities are coordinated. Also discuss data location: geography can affect investigations, so location and related expectations should be considered contractually. These are planning considerations, not a guarantee that a particular provider or contract will satisfy your needs.

How should you keep compliance current?

Revisit the assessment when the organization’s data, services, contracts, operating practices, or relevant jurisdictions change. Recheck whether the requirements still apply, whether the service still meets them, and whether the organization can still obtain sufficient evidence and respond to risks. Cloud compliance is therefore a continuing governance activity, not a one-time provider selection or certification check.

NIST’s cloud publications include newer work such as IR 8505, finalized September 30, 2024, and SP 800-210, finalized July 31, 2020. These provide additional technical guidance; they do not replace analysis of the laws and obligations applicable to a particular organization.
