AI can assist with bounded subpoena-response tasks, such as organizing records or extracting information for review. It should not decide what to preserve, what is legally responsive or proportional, whether material is privileged, how to object, or whether a final response is accurate. Those decisions depend on the subpoena, the relevant systems and facts, applicable law, and responsible human review.

The procedural discussion here focuses on U.S. federal civil procedure. Rules and court orders vary by jurisdiction and matter, so a federal rule should not be treated as a universal procedure or deadline.

Why is subpoena response more than a document search?

A subpoena can require people or organizations to identify information across distributed systems, preserve potentially relevant records, assess the request’s scope, raise appropriate objections, review for protected material, and produce information in a usable form. Finding files is only one part of that work.

Federal Rule of Civil Procedure 45 addresses issues including undue burden, objections, electronically stored information (ESI), and procedures for asserting privilege or protection. Rule 26 supplies related limits and duties for discovery, including proportionality, preservation considerations, privilege, and certification. The rules’ application depends on the subpoena and matter; applicable local rules and court orders may add requirements. Check the current rule text and seek qualified legal advice about a live request.

The request sets a legal scope, not just search terms

Deciding what to collect or produce means interpreting what the subpoena actually requests, identifying relevant sources, and considering whether the demand is overbroad or unduly burdensome. A model can retrieve documents that match a phrase, but a match does not establish that a record is responsive, that its collection is proportional, or that it can be produced without objection.

Records are spread across systems

Potentially relevant ESI may sit in email, collaboration tools, cloud repositories, archives, or other sources. An AI workflow that sees only a subset can create a misleading sense of completeness. A useful process needs to account for where records reside, who can access them, and whether the collection can be traced back to its sources.

How should preservation and accessibility be handled?

Preservation and accessibility are separate questions. Rule 26’s notes recognize that ESI considered not reasonably accessible because of undue burden or cost may still be subject to potentially applicable preservation duties. A conclusion that a source is difficult or expensive to search does not, by itself, settle whether relevant information must be preserved.

Delay can matter when systems automatically delete, overwrite, or rotate data. Do not use an AI tool to delete, alter, or casually transfer potentially responsive material. Preservation decisions should be made by responsible people who understand the matter, the sources, and applicable obligations.

What a sound assessment considers

Accessibility and proportionality require context, not a model’s summary of a data source. Relevant considerations include:

  • Which systems and custodians may hold responsive information.
  • How specifically the subpoena identifies the requested information.
  • Whether more accessible sources could provide the information.
  • The likely usefulness of additional information, the importance of the issues, and the parties’ resources.
  • The burden and cost of collection, review, and production.

Rule 26’s committee notes discuss these kinds of considerations. Their application is matter-specific; an automated search result cannot make the legal proportionality decision.

Can AI help with legal discovery?

Yes, when its role is limited to assistance that a reviewer can check. Depending on the tool and the matter, AI may help organize a collection, extract fields, identify likely duplicates, create an initial chronology, or summarize documents for a human reviewer. These are workflow aids, not determinations of legal scope or completeness.

Keep a human decision-maker at the consequential steps

People responsible for the response should evaluate the subpoena, determine preservation steps, choose and validate sources, assess burden and proportionality, resolve responsiveness, screen for privilege and other protections, and approve what is produced. AI-generated summaries and extracted details should be checked against the original records, particularly before they inform a legal position or a certification.

Traceability matters: a reviewer should be able to move from an extracted fact or summary back to the underlying document and verify the context. If the system cannot show what it relied on, or if a reviewer cannot inspect the relevant source, its output may be unsuitable for a consequential decision.

How do you protect privileged or confidential information?

Privilege review needs a deliberate process. Under Rule 45, a party withholding subpoenaed information on a privilege or protection claim must expressly make the claim and describe the withheld material sufficiently for the other side to assess it without disclosing the protected content. If protected information is produced and the claim is raised, the rule provides a process requiring the recipient to return, sequester, or destroy the specified information while the claim is resolved.

Sending documents to an AI service creates another place where sensitive information may be handled. Before using a tool, assess its data retention, training use, access controls, security, human-review practices, and ability to support privilege screening. Do not assume that a tool is appropriate for confidential, privileged, sealed, proprietary, or otherwise protected information merely because it is convenient.

A 2025 administrative order from the U.S. District Court for the Eastern District of North Carolina warns against using public AI tools with protected information without reliable assurances about storage, human review, and training use. That is a local court order, not a nationwide rule. Its specific policy should not be generalized beyond its scope, though the confidentiality risks are relevant when evaluating any tool.

Who is accountable for an AI-assisted response?

The responsible signer remains accountable. Federal Rule 26(g) requires a signature and certification made after reasonable inquiry. The signer certifies, among other things, that a disclosure is complete and correct and that a discovery response or objection is consistent with the rules, not made for an improper purpose, and not unreasonably burdensome.

The Eastern District of North Carolina’s 2025 order states: “All filings, discovery responses, and evidentiary submissions remain the ultimate responsibility of the signing attorney or party, whether assisted by AI or not.” It also cautions: “Counsel and self-represented litigants must understand that these tools hallucinate and can produce inaccurate information.” These statements are from that court’s order; they are not a nationwide rule. They reinforce a practical point for any workflow: AI assistance does not take responsibility for verifying the response away from the person who signs or submits it.

Can AI conversations themselves become discovery material?

They can be a potential discovery category in some disputes, but it is not established that every AI prompt or conversation is automatically discoverable or unprivileged. An American Bar Association Litigation article from Spring 2026 discusses requests and preservation letters that specifically identify AI platforms and conversation histories. That is professional commentary, not a binding rule or a universal judicial finding.

Whether particular AI records must be preserved or produced depends on the governing law and facts, including relevance, proportionality, privilege, confidentiality, and any applicable orders. Treat potentially relevant records thoughtfully; do not assume either that all conversations are discoverable or that AI use makes them protected.

How should you evaluate an AI-assisted workflow?

Assess the process as well as the model. A polished answer does not show whether the workflow preserved the right records, covered the right sources, or made its results verifiable.

  • Preservation and retention: Can the organization preserve relevant records and understand what the AI service retains or deletes?
  • Source coverage: Does the workflow account for applicable email, collaboration systems, cloud repositories, and archives, rather than silently omitting sources?
  • Security and permissions: Are access controls appropriate, and are the service’s storage and training practices acceptable for the information involved?
  • Traceability: Can reviewers connect each extracted claim or summary to the source document and inspect it?
  • Human and privilege review: Does the process leave legal judgments and protected-information screening to qualified reviewers?
  • Production and auditability: Can the workflow support the required production format and provide an adequate record of what was collected, reviewed, and produced?
  • Fit for the matter: Are cost and effort proportionate, and can the process comply with the subpoena, court orders, and applicable policy?

If a tool cannot provide enough control, coverage, or traceability for the task, narrowing its role—or not using it for that task—is safer than treating its output as a complete response.
