A local exchange carrier (LEC) is any person that provides telephone exchange service or exchange access, under the U.S. federal definition in 47 U.S.C. § 153(32). The term describes a service-based legal category, not only traditional landline companies or providers using copper networks.

What does LEC mean in telecom?

The statute defines a local exchange carrier as “any person that is engaged in the provision of telephone exchange service or exchange access.” Because the definition turns on the activity, a provider’s technology or corporate form alone does not determine whether it is an LEC.

The same statutory provision qualifies the definition for commercial mobile service: a person is excluded insofar as it provides that service, unless the Federal Communications Commission (FCC) determines that the service should be included. It is therefore too broad to say that wireless companies can never be LECs.

How is an LEC different from an ILEC?

LEC is the broader category defined in § 153(32). An incumbent local exchange carrier (ILEC) is a separate status defined in 47 U.S.C. § 251(h) for a particular area. The statutory criteria generally look at whether a carrier provided telephone exchange service in that area on February 8, 1996, and whether it met the specified exchange-carrier-association or successor criteria. The FCC may also designate certain comparable carriers as incumbents by rule.

Use “ILEC” when the incumbent status and obligations under § 251 matter; do not use it as a synonym for every LEC. The Telecommunications Act of 1996 established the local-competition framework by amending the Communications Act and adding relevant definitions and duties.

What does the definition tell you about a particular provider?

The definition gives the federal legal test, but it does not by itself settle a provider’s status in a specific state, market, or regulatory proceeding. That determination can depend on provider-specific facts, the service at issue, and the relevant jurisdiction. For a particular carrier, consult applicable current FCC and state materials and the record for the proceeding.
