The GST Council has recommended tighter limits on when officers may intercept goods in transit, along with a restriction on confiscation of goods or conveyances while they are in transit. These are proposals from the Council’s 57th meeting on 8 October 2026—not confirmed changes to the law. The amendments would affect sections 68, 129 and 130 of the CGST Act.
What the GST Council recommended
The Council’s recommendations would change the conditions for interception and follow-on action involving a conveyance carrying goods. The proposed rules distinguish between a stop in a State connected to the supplier or recipient and a stop in a State through which the goods are merely passing.
- Interception: A conveyance could be intercepted only on specific intelligence and with authorisation from an officer of at least Joint Commissioner rank.
- Inspection, detention or seizure: These actions could be taken when either the supplier or the recipient is located or registered in the State where the interception occurs. The recommendation says there would be no interception in transit States.
- Missing documents: The recommendation describes an exception allowing inspection, detention or seizure irrespective of jurisdiction if no e-way bill has been generated, or if the conveyance carries no document showing the goods’ origin or destination.
- Confiscation: The Council recommended that section 130 confiscation provisions not apply to goods or conveyances in transit.
The proposal concerns distinct steps: interception is the stop; inspection is an examination; detention or seizure may follow; confiscation is a separate action addressed by section 130. The Council’s recommendation would limit each as described above rather than treating every stop as the same legal action. The Ministry of Finance’s PIB release on the 57th meeting sets out the recommendations.

How the proposed rules distinguish cases

Are the recommendations already in force?
Not on the basis of the Council announcement alone. The PIB release says recommendations are given effect through relevant circulars, notifications or amendments to law, and that those instruments alone have the force of law. Treat the changes as proposed unless the operative instrument confirms that they have taken effect.

The official e-way-bill portal is a separate place to check operational system notices. Its announcements page, updated 30 July 2026, reported that recent EWB Closure and mandatory Ship-to GSTIN changes were put on hold and listed earlier validations. That notice predates the Council’s 8 October recommendations and concerns portal functionality; it neither implements nor negates the proposed statutory changes.
What businesses and transporters should do meanwhile
Until the relevant legal instruments are issued, businesses and transporters should follow the rules currently in force. As a practical precaution, keep the applicable e-way bill and documents showing the goods’ origin and destination available during transport, and check the operative rules and official portal announcements for changes. The Council’s stated rationale is smoother movement of goods and improved transportation efficiency; the release does not report measured results.

Which GST Council meeting announced the proposal?
The recommendations were announced after the 57th GST Council meeting, held in New Delhi on 8 October 2026. They should not be confused with the 56th-meeting recommendations, which the GST Council archive records as uploaded on 3 September 2025.
