Generally, do not assume you can buy a tokenized stock from the United States. As of October 7, 2026, xStocks says it is unavailable to U.S. residents and U.S. persons, and Ondo Stocks says it is offered only outside the United States to eligible non-U.S. persons. A temporary, conditional SEC exemption announced in September 2026 creates a limited pathway for certain venues; it does not establish that a particular platform has launched a product open to U.S. customers.
What is a tokenized stock?
The term can describe a financial instrument—such as a stock, bond, or fund interest—formatted as or represented by a crypto asset recorded on a blockchain or similar distributed ledger. That description alone does not tell you whether the token itself is the security, represents a claim held through an intermediary, or provides only economic exposure. The legal structure and product terms determine what a holder actually owns. Investor.gov’s overview of tokenized securities explains the category; it does not make every token equivalent to a share held in a standard brokerage account.
In particular, do not infer voting rights, dividend handling, custody protections, transferability, or redemption rights from the words “tokenized stock.” Those rights and arrangements depend on the specific instrument and its terms.

On September 17, 2026, the SEC announced temporary, conditional exemptive relief—described as an “Innovation Exemption”—for Tokenized Securities Venues to trade tokenized National Market System (NMS) stock through specified permissioned automated market makers and liquidity pools. The SEC announcement describes a limited pathway subject to conditions, not blanket permission for any platform to offer tokenized stocks to U.S. residents.

The exemption’s existence and a specific venue’s implementation are separate questions. It does not, by itself, confirm that a venue is operating under the framework, that a retail product is live, or that your state and account type are accepted. Check the named venue and product rather than treating the regulatory announcement as evidence of customer access.
Do xStocks or Ondo Stocks accept U.S. residents?
The providers’ published eligibility statements differ from the fact that tokenized-stock regulation is evolving. Their current public terms say:

The Oasis Pro Markets announcement was published July 23, 2026. Read it as a company announcement about authorizations for specified securities activities, not as a customer-level eligibility notice for the offshore Ondo Stocks product: Ondo’s announcement.
Does the SEC exemption mean I can buy one now?
No general conclusion about your access follows from the exemption. It is temporary and conditional, and applies to specified venue activity. Before relying on it, verify that the particular venue and product are operating under the relevant framework and accept customers with your state, residency, investor category, and account type. The SEC’s notice is the primary source for the exemption’s scope.
Does seeing or transferring a token make me eligible?
No. Visibility in a wallet, technical transferability, or access through a third-party integration does not establish legal or contractual permission to use an offering. A provider may impose geographic restrictions even when a token can be seen or moved on a blockchain. For xStocks, the provider’s U.S. exclusion and its stated partner compliance requirements are the relevant eligibility signals, not whether an integration displays the asset. Use the provider’s current terms and the documents for the particular token and venue. Verify these points before opening an account, funding it, or transferring a token:

- Identify the legal instrument. Determine whether the token is the security itself, represents an entitlement through an intermediary, or provides another form of economic exposure. Do not assume the label identifies your legal rights.
- Confirm your eligibility. Check the offering’s current rules for your state, residency, U.S.-person status, investor category, and account type. Ask the provider if the public terms do not resolve your situation.
- Identify the venue and intermediaries. Find out which venue executes or facilitates trading, which broker-dealer or other intermediary is involved, and how the underlying asset or entitlement is held.
- Read the rights and operational terms. Check voting, dividend treatment, custody, transfers, redemption, and any limits or conditions attached to those features.
- Understand trading conditions. Check trading hours, liquidity, and applicable fees for the specific product and venue; do not assume they match ordinary exchange-listed shares.
