A “virtual electronic record” is not a universally standardized term. Generally, it means a record handled electronically; in some systems, “virtual” describes information assembled or accessed from connected sources rather than stored as one consolidated file. The exact meaning depends on the system and the legal or professional context.

What does “virtual electronic record” mean?

The phrase combines two ideas: an electronic record is information created or kept using electronic means, while virtual may describe how that information is presented, accessed, or assembled. The phrase does not, by itself, specify a file format, storage location, technology, or legal status.

For U.S. federal law under the E-SIGN Act, an “electronic record” is “a contract or other record created, generated, sent, communicated, received, or stored by electronic means” (15 U.S.C. § 7006(4)). The Act separately defines “record” as information inscribed on a tangible medium or stored in an electronic or other medium and retrievable in perceivable form. These are definitions for that statute, not universal definitions used identically in every jurisdiction. Read the current U.S. Code definition.

What does “virtual” mean in a record system?

In a particular system, “virtual” can describe a view that brings information together from connected systems when needed. The information may remain in its original source systems rather than being copied into one central record. That is one documented use, not a rule for every system called virtual.

Healthcare example: New Zealand’s Hira programme

Health New Zealand’s Hira programme business case describes a virtual electronic record enabled by linking existing electronic medical record systems and data repositories as needed. The description concerns that programme: it does not establish that all virtual records work this way, nor that the linked information has been migrated into a single patient file. Historical example: the U.S. VLER initiative

In a 2009 congressional hearing, testimony used “Virtual Lifetime Electronic Record” (VLER) for a proposed initiative intended to bring together health and administrative data for current and future service members, veterans, and eligible family members over time. Does an electronic record have to be sent to someone?

No. Electronic records can be created, received, or stored electronically without being messages transmitted to another person. The UNCITRAL Model Law on Electronic Commerce discusses “data messages” broadly enough to include computer-generated records that were not intended to be communicated. It is a model-law framework; the binding rules depend on how a jurisdiction has enacted it. Consult UNCITRAL’s Model Law and guide.

Is a virtual electronic record legally valid?

The label alone does not establish that a record has been signed, satisfies a required form, or is legally effective for a particular transaction. The answer depends on the governing jurisdiction, the record’s purpose, and any rules that apply to its creation or signature. Under U.S. E-SIGN, “electronic record” and “electronic signature” are distinct defined terms.

Requirements can also be transaction-specific. For example, Singapore’s Electronic Conveyancing and Other Matters Act 2025 sets conditions for certain conveyancing instruments, including use of a prescribed electronic transaction system and prescribed secure electronic signatures. Singapore Statutes Online listed the Act as uncommenced as of 4 October 2026, so it should not be treated as an operative requirement on that date. Check the Act’s official status and text.

How to interpret the phrase in a specific system

When a product, agency, or law uses “virtual electronic record,” look for its own definition and check these distinctions:

  • Where the data reside: Are they held in one repository, or linked from multiple source systems?
  • How the view is assembled: Is information retrieved on demand, or maintained as a persistent combined record?
  • What the record covers: Which information is included, and who is meant to access it?
  • Which rules apply: Identify the jurisdiction, transaction, and any specific signature or system requirements.

Without those details, “virtual electronic record” is best read as a context-dependent description—not as a promise that the information is cloud-stored, centrally consolidated, medically specific, secured in a particular way, or legally signed.
