The 57th meeting of the GST Council, held in New Delhi on 8 October 2026 and chaired by Union Finance Minister Nirmala Sitharaman, recommended changes to how GST is registered, administered, refunded and enforced. The package covers registration and cancellation, refunds and input tax credit (ITC), withdrawal of GST arrest powers, a higher prosecution threshold, e-way bill inspections, and an optional Annual Return Quarterly Payment (ARQP) scheme for small business-to-consumer (B2C) sellers.

These are recommendations, not a set of rules that already apply. Only one item is described in the official material as operating today: automatic registration on the portal for a defined group of applicants. The sections below separate what is running from what still needs legal change.

How the Council’s recommendations become binding

The GST Council is constituted under Article 279A of the Constitution. Its remit covers GST rates, exemptions, model laws, principles of levy and place of supply, and thresholds. The Council generally works by consensus. If a vote is taken, the Union government’s vote carries one-third weight, the States together carry two-thirds, and a decision needs a three-fourths weighted majority.

A recommendation becomes enforceable only when it is carried into the instrument that governs the matter. Depending on the item, that can mean an amendment to the CGST Act, a change to the CGST Rules, a notification, a circular, or FAQs. The Press Information Bureau (PIB) release of 8 October 2026 says FAQs are being issued.

The GST Council Secretariat’s newsletter (Issue 84, March 2026) shows how uneven that sequence can be. Some provisions of the 2026 Finance Act took effect on 1 April 2026, while amendments on post-supply discounts and provisional refunds were still awaiting notification. The same newsletter reported a GSTN advisory on linking voluntary DRC-03 payments to demands through Form DRC-03A.

Registration: what is running and what is proposed

Automatic registration under rule 14A

The existing automatic-registration route under CGST Rules rule 14A is open to applicants who do not intend to pass on more than ₹2.5 lakh of input tax credit per month. The PIB release says the portal is already granting registration on this route without officer intervention, based on the 56th meeting’s recommendation. This is the only registration item the release describes as operating today.

Other registration applications

For all other applicants, the Council recommended a comprehensive registration circular with FAQs, specified document choices in Form GST REG-01, and a more guided portal interface. The stated aim is fewer rejections and queries and faster processing.

Amendments and cancellation

The Council recommended that most registration amendments be accepted automatically on the portal. The principal place of business is excluded for most taxpayers. For rule 14A taxpayers, every registration particular, including the principal place of business, would be accepted automatically.

On cancellation, the Council recommended a phased simplification, including automatic cancellation in specified cases where returns and dues are up to date. The word “phased” points to rollout in stages rather than a single switch, but the release does not give a timetable for those stages.

Refunds, returns and input tax credit

Refunds and appeal pre-deposits

The Council recommended clarifying and adjusting refund procedures, including how interest is treated on refunds of appeal pre-deposits. It also recommended measures to facilitate refunds for certain Indian service providers who deal through foreign offices or branches.

ITC categories proposed for broader eligibility

The Council recommended broader ITC eligibility in these specified categories:

  • outdoor catering
  • health and life insurance
  • telecommunication towers
  • pipelines outside factory premises
  • free samples
  • goods destroyed or written off on expiry, as required by law

Each category is a proposal. Whether and when it becomes claimable depends on the amendment that implements it and the conditions attached to that amendment.

Cross-border services and SEZ deliveries

The Council recommended changes to place-of-supply rules for specified cross-border services. It also recommended a clarification for specified goods delivered to an overseas buyer in a Special Economic Zone (SEZ) or Free Trade Warehousing Zone (FTWZ), subject to conditions set out in the release.

Arrests and prosecutions

The most significant enforcement proposal is the complete withdrawal of GST arrest powers, by omitting section 69 of the CGST Act. The Council also recommended the changes to prosecution thresholds and offence language set out below.

Item Position stated in the release Recommended change
GST arrest powers Provided for in section 69 of the CGST Act Omit section 69, withdrawing arrest powers completely
Monetary prosecution threshold ₹1 crore ₹5 crore
ITC-related offence Not stated in the release Limited to fraudulent availment without receipt of goods or services, or without an invoice or bill
Other specified offence language Not stated in the release Narrowed
Punishments Not stated in the release Rationalised

The PIB release presents the package as “further strengthening a progressive and trust-based tax regime, while retaining effective deterrence against fraud and evasion.” These are proposals for legal amendment. Nothing in the release says the current statute has already changed.

E-way bill interception and inspection

The Council’s proposals would tighten the rules for checking goods in movement as follows:

  1. Interception generally requires specific intelligence and an authorisation from an officer of at least Joint Commissioner rank.
  2. Inspection, detention or seizure is generally tied to the state where the supplier or recipient is located or registered.
  3. The release recommends no interception in transit states, subject to the exceptions below.

Exceptions

The release describes exceptions for situations where an e-way bill is missing, and for situations where documents showing origin and destination are missing. For consignors and transporters, the practical point is that these exceptions turn on documentation. Carrying a valid e-way bill and origin and destination records with every consignment is the simplest way to avoid falling into them.

Small taxpayers: ARQP and late-fee relief

Two proposals target businesses with turnover of ₹5 crore or less. Both are preliminary in the official text.

Measure Turnover test Other condition Status in the release
Optional Annual Return Quarterly Payment (ARQP) scheme Preceding financial year aggregate turnover of ₹5 crore or less Business exclusively makes B2C supplies Concept note approved in principle; final rules and effective date not stated
Late-fee waiver for delayed section 39(1) returns Preceding-year turnover up to ₹5 crore Return filed by the end of the month in which it was due Recommended; effective date not stated

Approval in principle means the Council endorsed the ARQP concept. It does not mean a filing option is open to taxpayers.

Other recommendations

The release also lists the following items. Timing for each depends on the instrument that implements it, and where the release gives no date, none is supplied here.

  • A route to challenge the blocking of amounts in the electronic credit ledger, with an opportunity for a personal hearing.
  • Circulars to resolve interpretive disputes involving input service distributors, financial institutions, pre-deposits, demonstration vehicles, and a rule 96(10) issue.
  • Alignment of return and ITC timelines.
  • E-invoicing extensions for specified reverse-charge domestic supplies and imports of services, for taxpayers with annual turnover of ₹5 crore or more.

What the “trust-based” language establishes, and what it does not

The Prime Minister’s Office record of 8 October 2026 quotes Prime Minister Narendra Modi: “The focus is clear: Faster decisions. Lower compliance costs. Automated refunds. Trust-based administration.”

That is a statement of intended direction, not a measured outcome. The official material contains no measured evidence that litigation or compliance costs have already fallen. Describing the meeting as a historical shift that reduces litigation therefore goes beyond what the official sources show. Whether faster decisions and lower costs materialise will become clear only after the amendments, circulars and portal changes are in force and their effects can be observed.

Before acting on any of this

  • Confirm whether you qualify for the rule 14A route before assuming automatic registration applies to your application.
  • If you are a B2C-only business, or a small taxpayer considering late-fee relief, check your preceding-year turnover against the thresholds in the tables above.
  • Do not claim ITC in the newly proposed categories until the implementing amendment is notified and you have read its conditions.
  • Watch for the registration circular, the FAQs and the notifications that will turn these recommendations into rules.
