역사적 조문에서 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제22조 제1항 제1호는 정보통신서비스 제공자가 이용자 개인정보를 수집·이용할 때 그 목적을 알리고 동의를 받도록 한 항목입니다. 다만 확인된 자료만으로는 이 조항이 2026년 현재도 현행인지 확정할 수 없습니다.
제22조 제1항 제1호는 무엇을 뜻하나
역사적 제22조 제1항은 정보통신서비스 제공자가 이용자의 개인정보를 이용하려고 수집하는 경우, 정해진 사항을 이용자에게 알리고 동의를 받도록 규정했습니다. 그중 제1호가 다룬 사항은 개인정보의 수집·이용 목적입니다. 즉, 이용자에게 어떤 개인정보를 왜 수집하고 이용하려는지 알리는 항목이었습니다.
이는 과거 조문의 의미를 설명한 것입니다. 이 자료만으로 현재의 의무나 적용 조항을 단정할 수는 없습니다.

따라서 제1호는 고지 사항 중 목적에 관한 항목이며, 개인정보 항목이나 보유·이용 기간을 뜻하지 않습니다. 이 구분은 국가법령정보센터의 역사적 제22조 본문 및 해당 조항의 항목 확인에 근거합니다.
2026년 현재도 적용되는 조항인가
현재 지위는 확인된 자료만으로 판단할 수 없습니다. 국가법령정보센터의 2020년 시행본에는 과거 규정에 따라 받은 동의와 개정 규정에 관한 경과조치가 확인됩니다. 별도 법률인 「개인정보 보호법」에도 동의 사항을 정보주체가 명확히 인지하도록 알리는 규정이 있습니다. 그러나 이 내용만으로 과거 정보통신망법 제22조 제1항 제1호가 2026년에도 현행이라고 결론 내릴 수는 없습니다.

개인정보 수집·이용 동의 문구나 절차를 검토할 때는 조항 번호만 과거 자료에서 가져와 적용하지 말고, 다음을 확인해야 합니다.
- 해당 서비스와 행위에 적용되는 법률 및 시행 시점
- 동의 과정에서 수집·이용 목적, 개인정보 항목, 보유·이용 기간을 각각 어떻게 알리는지
- 목적이나 처리 내용이 변경될 때 필요한 절차
- 정보주체, 서비스 또는 처리 상황에 적용되는 예외와 경과조치
이 항목들은 검토의 기준이지, 이 글이 특정 서비스에 대한 현행 법률 적용 결과를 확정한다는 뜻은 아닙니다. 이 주제와 관련해 확인된 공식 조문 자료에는 인용할 통계 수치가 없으며, 특정 인물의 직접 인용문도 확인되지 않았습니다.
