Vice President JD Vance accused Microsoft of laying off U.S. workers while relying on foreign workers, but the figures he cited do not establish that H-1B employees replaced the people laid off. The action reported alongside his October 8, 2026 remarks concerned PERM labor certification for employer-sponsored green cards—not a general suspension of H-1B visas.

What Vance said about Microsoft

At a press conference on October 8, 2026, Vance said: “You cannot lay off American workers and then replace them with foreign indentured servants.” He argued that H-1B workers are dependent on their employer because losing a job can affect their immigration status. The phrase “indentured servants” is Vance’s political characterization, not a legal classification of H-1B workers. Read the transcript of Vance’s remarks.

Vance cited 6,000 U.S. layoffs at Microsoft in the preceding year, alongside 6,300 H-1B visas and almost 3,000 green cards. Those are figures he cited, as reported by the Associated Press; they do not by themselves show that visa recipients replaced the laid-off workers. The counts may cover different people, time periods, and processes, and a visa or green-card count is not the same measure as a new-hire count. The Associated Press report attributes the figures to Vance.

How Microsoft responded to the H-1B figures

Microsoft said 80% of its H-1B applications in the last fiscal year were for extensions or changes of status for existing employees. The company also said filings for new employees concerned people already legally in the United States and represented 1% of its U.S. workforce. Microsoft’s figures are its own statements as reported by the Associated Press, not independent verification of the underlying counts or a complete accounting of hiring. The company also said: “These were not to hire new people.” See the Associated Press account of Microsoft’s response.

The two accounts therefore describe figures that should not be treated as a direct replacement calculation: Vance cited layoffs, visas, and green cards, while Microsoft characterized most H-1B applications as filings for existing employees and separately described the scale of new-hire filings. The available reporting does not establish that the figures measure the same population or that visa holders took the jobs of the people laid off.

Did the administration suspend H-1B visas?

No general H-1B suspension was described in the action reported on October 8. The reported measure concerned the Permanent Labor Certification Program, or PERM, a labor-certification step in some employer-sponsored green-card cases. H-1B is a temporary nonimmigrant work category; PERM is part of a separate route toward employment-based permanent residency. The report on the PERM action describes that distinction.

The available reporting does not identify an official agency notice or case record that sets out the announced PERM suspensions’ evidence, procedural basis, precise scope, or review process. Those details should not be treated as settled without a primary agency document.

How the September H-1B actions fit in

Order directing agencies to consider layoffs

A September 2026 White House H-1B integrity order directs relevant agencies to consider whether an employer sponsor conducted layoffs in the previous year, or plans layoffs, that negatively affect similarly situated U.S. workers when processing relevant labor-condition applications, petitions, and visas. That is administration policy guidance; it does not prove that Microsoft committed fraud or establish that any particular worker was displaced. Read the White House order.

Separate $100,000 payment provision

A separate September 2026 White House proclamation specifies a $100,000 payment requirement for certain H-1B entrants coming from outside the United States. It took effect September 21, 2026, includes exceptions, and states a 12-month duration absent an extension. Its described scope is not a blanket payment rule for every existing H-1B worker. Read the proclamation.

Why the layoff and visa totals do not prove replacement

To establish that foreign hires replaced laid-off U.S. employees, the counts would need to identify comparable workers and jobs, align their time periods, and show a connection between specific departures and subsequent hires. The figures Vance cited do not supply that evidence on their own. Microsoft’s response offers a different characterization of its filings, but its statements also are not an independent labor-market analysis.

The Associated Press also reported that former USCIS adviser Doug Rand argued that restricting green-card sponsorship could prolong the employer dependence invoked by Vance. That is Rand’s analysis of the potential policy effect, not an adjudicated finding about how the action will operate. Read the Associated Press report on Rand’s criticism.
