Common workplace data privacy risks include phishing, intrusive employee monitoring, collecting or keeping too much personal information, unauthorized access or mishandling, weak third-party safeguards, and careless disposal or breach response. They arise both when an employer collects information about workers and when security failures expose employee or customer data. Their prevalence varies by country and by how each source measures incidents; the figures below are not a universal ranking.
What are the common data privacy risks in the workplace?
These six risks cover two related but distinct problems: an organization can intrude on workers’ privacy through its own collection and monitoring, or fail to protect personal information it holds. A single event can involve both—for example, a phishing message can compromise an employee account and expose customer records.
1. Phishing and social engineering
Fraudulent emails, messages, links, or calls can persuade an employee to disclose personal information, reveal credentials, or grant an attacker access. In an EU employee survey released on 30 September 2026, three in four respondents said they had encountered suspicious emails, messages, or links at work. In that survey, 39% reported phishing, 18% attempts to steal personal data, 16% password-theft attempts, 17% malware attacks, and 15% AI-generated scams. These are employee-reported experiences, not confirmed breach rates or estimates for workers worldwide. European Commission survey findings.
A separate UK government survey, published 30 April 2026 and based on fieldwork from August to December 2025, found phishing was the most prevalent attack type reported by 38% of businesses and 25% of charities. Those figures describe surveyed UK organisations, not the share of employees affected globally. UK Cyber Security Breaches Survey 2025/2026.

2. Excessive or opaque employee monitoring
Monitoring tools and practices can capture location, communications, webcam images, keystrokes, or information about a worker’s home and family life. The privacy impact depends on the purpose, scope, sensitivity, and retention of the information—not simply on whether monitoring is digital.
The UK Information Commissioner’s Office (ICO) says workers are likely to have greater privacy expectations at home, where monitoring is more likely to capture family or private-life information. Its guidance calls for a clear purpose, fair and lawful processing, balancing the employer’s interests against workers’ rights, and the least intrusive means that achieves the purpose. Canada’s privacy regulator likewise recommends targeted, appropriate monitoring and limiting collection to what is necessary. ICO guidance on monitoring workers; Office of the Privacy Commissioner of Canada guidance on workplace privacy.
3. Collecting or retaining more information than needed
Every unnecessary employee file, surveillance record, or indefinitely retained dataset adds information that could be misused, accessed by someone who should not see it, or exposed in a breach. Retention should be tied to a stated business or legal purpose rather than a general preference to keep records in case they might be useful.

Canada’s privacy regulator advises employers to tell workers what information will be collected and how it will be used, collect only what is necessary for the stated purpose, and identify retention periods in monitoring policies. 4. Unauthorized access, insider misuse, and accidental mishandling
Personal information can be exposed when an employee with legitimate credentials looks at records without a work reason, permissions are broader than necessary, correspondence goes to the wrong recipient, or an attacker takes over an account. Errors in data entry, labelling, or routing can expose information even without malicious intent.
In fiscal year 2025–2026, unauthorized access accounted for 78% of business breaches reported under Canada’s PIPEDA. Among those reported unauthorized-access breaches, cybersecurity incidents accounted for 68%, social engineering for 13%, and employee misuse of access privileges for 8%. Separately, mishandling such as data-entry, misdirection, or labelling errors was the most common cause of reported breaches under Canada’s federal Privacy Act, with 368 cases. These are Canadian regulator-reported figures with distinct denominators; they should not be treated as universal incident rates. 5. Weak safeguards at third-party providers
Payroll, HR, hosting, and monitoring providers may handle sensitive employee information on an organization’s behalf. A provider’s access, security practices, contracts, and data locations can therefore affect the privacy risk. Using a purchased application does not transfer away the employer’s responsibility for deciding why and how monitoring takes place.

6. Insecure disposal and unprepared breach response
Paper records, retired computers, and portable storage can reveal personal information if discarded or reused without appropriate safeguards. The US Federal Trade Commission advises securely disposing of records that are no longer needed, keeping records only under a written retention policy when they must be retained, and making sensitive paper unreadable before disposal. It specifically recommends shredding, burning, or pulverizing paper and making shredders available throughout the workplace, including near photocopiers. These are US agency recommendations, not a substitute for local disposal or retention requirements. FTC business guide to protecting personal information.

An incident also becomes harder to contain when nobody knows who should investigate, preserve relevant information, limit access, or make required notifications. The FTC recommends having an incident-response plan and promptly investigating incidents.

Practical controls should address what information is held, who can access it, how it is used, and how the organization responds when something goes wrong.

Inventory personal information, document why each item is needed, and remove it when its business or legal retention purpose ends. Follow applicable local retention rules and set a written schedule.
- Restrict access. Use role-based, need-to-know permissions. Remove or change access promptly when an employee leaves or changes roles.
- Train and verify. Teach staff to recognize suspicious requests, independently verify requests for sensitive information, and report suspected incidents quickly. The FTC describes a well-trained workforce as a key defense against identity theft and data breaches.
- Assess monitoring before it starts. Document a specific purpose, assess necessity and proportionality, consider less intrusive alternatives, explain the practice to workers, set retention limits, and assess risks. The ICO recommends considering a data protection impact assessment (DPIA). Under its UK guidance, if a DPIA identifies high residual risk that cannot be reduced, the organization must consult the ICO before proceeding.
- Review providers and transfers. Check a provider’s competence, access, safeguards, data locations, contract responsibilities, and any transfer requirements that apply in the relevant jurisdiction.
- Dispose of records safely and prepare for incidents. Make sensitive paper unreadable before disposal, and apply appropriate disposal practices to home workers as well as office staff. Maintain a response plan with assigned responsibilities and notification steps.
How should an employer decide whether workplace monitoring is justified?
Consider the proposed monitoring as a specific intervention, not a default feature to enable across the workforce. A useful assessment compares the purpose and expected effectiveness with the privacy impact and available alternatives.
- Purpose: What defined problem is monitoring intended to address?
- Necessity and effectiveness: Is the information collected needed, and is the method likely to achieve the stated purpose?
- Scope and sensitivity: How much information will be collected, how sensitive is it, and could it reveal private activity?
- Alternatives: Could a less intrusive method achieve the same result?
- Transparency and expectations: Have workers been told what will be monitored and why? Does the setting—especially work from home—heighten the chance of capturing private life?
- Retention and access: How long will information be kept, who can see it, and how will unnecessary data be removed?
- Accountability: Have risks been assessed and responsibilities documented, including those of any monitoring provider?
The ICO’s least-intrusive-means test is UK guidance, and its page is under review following legislative changes. Privacy duties differ by jurisdiction, sector, worker status, and type of data; organizations should apply the law relevant to their circumstances rather than treat this checklist as a legal determination.
