The NFL is backing New Jersey’s request for the U.S. Supreme Court to review whether federal or state authorities can regulate sports event contracts on prediction-market platforms. The Court had not agreed to hear the case as of an October 9, 2026 report, and the timing of any decision on the petition remained uncertain.
What is the dispute about?
The central question is who has authority over sports event contracts offered by prediction-market platforms: the federal Commodity Futures Trading Commission (CFTC), which oversees derivatives markets, or state authorities applying sports-betting laws. New Jersey asked the Supreme Court to review the dispute after two federal appeals courts reached different results on whether states could apply those laws to prediction-market platforms, creating a circuit split.
The case concerns the regulatory framework for these contracts, not a Supreme Court ruling that prediction markets are or are not legal. Front Office Sports reported on October 9, 2026, that the Court had been asked to take the case; it had not yet accepted it or decided the merits.
Why is the NFL supporting New Jersey?
The NFL’s position, as summarized by Front Office Sports, is that sports event contracts should be subject to state-level rules. The league argues those rules offer stronger protections for game integrity and consumers, and it has questioned whether the CFTC has adequate safeguards and resources to address integrity, consumer-protection, and market-manipulation risks. Those are the NFL’s claims, not findings established by the report.

The league also raised an access concern: some platforms allow users as young as 18 to trade sports contracts, while many state-regulated sportsbooks set a minimum age of 21. The report does not establish a uniform age rule across states or platforms.
The NFL filing cited trading activity as a reason for urgency. It said more than half of prediction-market trading volume on the first Sunday of the season—$1.8 billion out of $3.3 billion in total—related to the NFL. That figure is from the league’s filing as reported by Front Office Sports; it is a claim about that Sunday, not an independently audited measure or a season-wide total. An unnamed league source quoted by the outlet said, “Given this volume of trading and the uncertainty around it, it is critical for the Court to act as soon as possible.”

What do the CFTC and the platforms say?
The CFTC and prediction-market platforms describe a different approach, emphasizing federal oversight, surveillance, and cooperation. Their reported positions are not judicial findings.
- CFTC: A spokesperson said the agency had engaged with the NFL and regretted that the league declined a memorandum of understanding that could have allowed cooperation and information exchange. “It’s unfortunate the NFL declined,” the spokesperson said, as quoted by Front Office Sports.
- Kalshi: The platform said market integrity is its top priority, described its surveillance and league-partnership posture, and said the CFTC actively polices sports-related markets.
- Polymarket: The platform said it was enhancing surveillance and collaborating with regulators and leagues toward a harmonized federal framework.
The NFL’s brief, as quoted in the report, made its position conditional: if federally regulated exchanges adopted robust safeguards and vigorous oversight similar to state and tribal regulators and legalized sportsbooks, there might be less cause for concern. The brief added, “But that is not what is happening.”

Who else supports Supreme Court review?
Front Office Sports reported that attorneys general from 39 states and the District of Columbia, along with a coalition of 145 tribal nations and organizations, supported New Jersey’s petition. The NFL also filed in support. This is substantial backing, but it does not mean every stakeholder wants the Supreme Court to take the case; the parties disagree about which oversight model is appropriate.

No. As of the October 9, 2026 Front Office Sports report, New Jersey had petitioned for review and the NFL had filed an amicus brief supporting the petition, but the Court had not agreed to hear the dispute. The report said Kalshi’s response was due November 9, 2026. It also relayed an unnamed Supreme Court expert’s view that January was the earliest possible point for action, while warning that the Court could take longer. That was a forecast in the report, not a confirmed schedule.

If the Court accepts the case, it could address the conflict over whether states may apply sports-betting laws to these platforms or whether federal derivatives oversight controls. The report does not establish what the Court would decide, or whether it would reach every issue raised by the parties.
