The Planning Inspectorate dismissed Clearstone Energy Limited’s appeal for a proposed 150 MW battery energy storage system near Axminster, Devon, on 13 August 2026. Reporting on the decision says the inspector was not satisfied that the proposed fire and explosion controls had been shown to work effectively, or that fire water could be contained well enough to protect groundwater. Landscape effects were also an issue.
What project and appeal did the decision concern?
The case was Clearstone Energy Limited’s planning appeal APP/U1105/W/25/3369854. It concerned land just south of Hazlehurst, Raymonds Hill, near Axminster, Devon. The Planning Inspectorate lists East Devon District Council as the local planning authority, classifies the appeal as an inquiry, and records the outcome as dismissed, with a decision date of 13 August 2026. Why was the appeal dismissed?
According to ESS News’ account of the inspector’s decision, the central concern was whether a fire or explosion could be managed without unacceptable risk to residents or pollution of aquifers and groundwater. The inspector reportedly found the evidence insufficient to demonstrate that the proposed deflagration and explosion mitigation strategies would work effectively, particularly with battery cabinets 10 cm apart.
The inspector’s reported reasoning connected the two risks: if the fire-safety case was not sufficiently established, the inspector could not be confident that the proposed fire-water retention measures would prevent pollution or protect groundwater quality. The reported decision says the fire-safety concern weighed very heavily against the proposal.
What battery system was proposed?
ESS News reports that the scheme included 52 Wärtsilä Quantum 1 units using lithium iron phosphate batteries. Those details describe the proposed commercial-scale installation; they do not establish that the system was inherently unsafe, nor do they resolve whether its particular design and site-specific controls were adequately evidenced for this appeal.
The report also cites a case-specific estimate by Jeremy Ramsden, an expert for the opposing Rule 6 Party: approximately a 10% probability of at least one fire over the project’s planned 40-year lifetime, calculated using 2025 failure rates. This is an estimate attributed to an expert in this case, not a general rate for battery energy storage systems.
ESS News also reports inspection figures attributed to Clean Energy Associates: 26% of inspected BESS units had fire-suppression-system defects, 18% had thermal-management defects, and system-level defects accounted for nearly 50% of quality-assurance findings. These figures describe that organization’s inspection findings; they are not findings about the Axminster proposal or all battery installations.

What other planning issue mattered?
The appeal also addressed the scheme’s effect on the character and appearance of the area, including the Dorset National Landscape. ESS News reports that the inspector had concerns about the industrial appearance of the development in its rural setting. The case outcome is established by the Planning Inspectorate record, but a full account of the landscape reasoning and the inspector’s overall planning balance requires reading the linked decision itself.

This is one appeal, not a blanket ruling on battery storage. It does not establish that all battery energy storage systems are unsafe, nor that compliance with a particular guideline guarantees planning approval. For a meaningful comparison with another project, examine the appeal route and decision date, battery design and scale, cabinet spacing and explosion-mitigation evidence, fire-water retention and groundwater pathways, emergency-response evidence, landscape setting, and the local authority’s position. Differences in any of these may make another case materially different.
