Nintendo protects its characters and intellectual property for two connected reasons: it says enforcement protects the substantial creative investment behind its games and legitimate sales, while careful licensing keeps characters recognizable, appealing and useful for future games. The company treats a character as more than a picture or name; it is part of an interactive world that players may become attached to over many years.
That explains both the takedowns that attract attention and the permissions Nintendo does grant. Unauthorized game copies, circumvention tools and counterfeit products are enforcement targets. Individual consumers may share certain gameplay videos and screenshots under Nintendo’s current guidelines, but those rules are not a general license to draw, sell or commercially exploit Nintendo characters.
Nintendo’s stated reasons for strict protection
Protecting creative work and legitimate sales
Nintendo’s Intellectual Property & Piracy FAQ says its enforcement work targets unauthorized copies of games, devices or software that circumvent protection, and counterfeit products. Nintendo presents this as a way to protect the work of its creators and preserve legitimate game sales.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThe commercial argument is broader than one lost purchase. Nintendo says game development can take several years and require substantial investment, although the FAQ gives no numerical estimate for either development cost or piracy losses. In the company’s stated view, allowing unauthorized distribution to become normal would weaken the ability of Nintendo and other developers to keep financing new games. This is Nintendo’s rationale for enforcement; the cited materials do not independently establish that every particular takedown is necessary or that every disputed use is unlawful.

Keeping the company’s game business at the center
Nintendo also wants character recognition to lead people back to its games and dedicated platforms. Its enforcement FAQ and its character-expansion policy describe intellectual property as an asset that supports an ongoing game business, not merely a catalog of artwork that can be licensed as widely as possible.
Preserving audience attachment
Nintendo’s Nintendo IP Expansion Philosophy, presented on September 16, 2020, describes a stewardship concern that is separate from piracy. Nintendo says its properties are grounded in interactive game experiences and in the personal attachment players develop to characters. It wants expansion to fit the individual appeal of each property, protect the image and attachment audiences have formed, and prioritize quality instead of exposure for its own sake.
The presentation states: “That’s why we will always expand our properties in ways that fit the individual appeal of each character, taking great care not to damage the image or attachment consumers have for them.” The passage is presented as Nintendo’s corporate explanation and does not identify an individual speaker.

| Right | What Nintendo says it covers | Why it matters for characters and products |
|---|---|---|
| Copyright | Expressive material such as game characters, visuals, music, software, packaging, manuals and artwork | Controls copying and other uses of creative expression, subject to applicable law and exceptions |
| Trademark | Names, symbols and designs that identify the source of products | Helps prevent consumers from being misled about whether a product or service comes from, or is authorized by, Nintendo |
| Patent | Inventions | Protects qualifying technical innovations rather than a character’s appearance by itself |
| Design right | Product appearance, including accessory shapes | Can protect the visual form of hardware or accessories separately from software artwork |
These rights can overlap around one product, but they are not interchangeable. A character illustration may involve copyright; the character’s name or logo may function as a trademark; a controller mechanism may involve a patent; and the controller’s exterior shape may involve design protection. The exact rights available depend on the jurisdiction and the particular work.
Enforcement across many jurisdictions
Nintendo says it operates intellectual-property enforcement programs in more than 40 countries. The figure appears in Nintendo of America’s undated support FAQ, so it should not be read as a statistic tied to a particular year. Nintendo describes a combination of legal enforcement, consumer awareness, technology and efforts to improve intellectual-property legislation rather than a single takedown method.
Why character stewardship is different from ordinary licensing
Characters carry a promise about how a game feels
Players meet Nintendo characters through rules, stories, movement and sound, not just through a static image. A change in tone, behavior or context can alter what audiences think the character represents. Nintendo’s 2020 philosophy says expansion should respect each property’s individuality and avoid damaging the attachment audiences have built through play.
Uncontrolled traits can limit future games
The same presentation says Nintendo wants to avoid introducing unintended character traits that could constrain future game development. In practical terms, a portrayal that becomes widely associated with a character can create expectations about personality, story or visual design. Nintendo therefore treats consistency as a creative resource: preserving room for future games is one reason it prefers controlled expansion.

Quality over maximum exposure
Nintendo explicitly rejects exposure as the only measure of a successful character expansion. The company says it will manage quality and choose uses that fit a character’s appeal. That policy helps explain why a project can be visible, popular or technically competent and still fall outside Nintendo’s preferred approach. Popularity does not itself create permission.
Why Nintendo may remove fan games and other unauthorized projects
Nintendo’s public enforcement categories include unauthorized game copies, circumvention devices or software, and counterfeit goods. A fan game can raise several of these concerns at once: it may reproduce protected characters, graphics, music or software; distribute altered copies of a game; or imply an association with Nintendo. The FAQ gives Nintendo’s reasons for enforcement, but it does not declare that every fan project is identical or that every use will have the same legal result.
Removing a project can also protect the distinction between an official Nintendo release and an unofficial one. If a download uses Nintendo branding or familiar characters, players may assume Nintendo tested it, supports it or will provide technical help. Nintendo’s trademark and consumer-protection interests are therefore relevant alongside copyright.

There is no blanket rule in the cited material saying that every fan expression is automatically illegal. Copyright, trademark, fair-use or other exceptions vary by country and by facts. A project that uses a character is not made lawful merely by being free, noncommercial or made by a fan, and it is not made unlawful solely because Nintendo has a strong enforcement policy. Specific disputes require the applicable law and, when necessary, qualified legal advice.

What Nintendo’s online video policy actually permits
Nintendo’s Game Content Guidelines for Online Video & Image Sharing Platforms were updated September 2, 2024. They create a limited framework for qualifying individual consumers who share gameplay footage and screenshots from games Nintendo owns.
Uses the guidelines address
- Gameplay videos and screenshots made from officially released Nintendo game content.
- Content that includes the creator’s own creative input, such as commentary or other original additions, rather than a bare substitute for the game.
- Official promotional material, where the guidelines identify it as eligible.
- Only the monetization methods Nintendo separately specifies in the guidelines.
Nintendo says it respects players’ desire to express themselves and writes: “We are humbled every day by your loyalty and passion for Nintendo’s games, characters and worlds, and respect that you want to be able to express yourself creatively by sharing your own original videos and images using content from our games.”
Limits that are easy to miss
- The policy applies to individual consumers, not corporate entities.
- It does not authorize every commercial way of earning money from Nintendo content. Nintendo says other commercial monetization of its intellectual property is not permitted under these guidelines.
- It covers the specified online sharing of game footage and images. It does not become a general license for fan art, character merchandise, music releases, game modifications or other projects.
- Eligibility still depends on following the guidelines and any applicable platform rules and law.
Nintendo directs people to applicable law and their own legal counsel for questions outside the policy. Treat the page as a permission framework with conditions, not as a promise that Nintendo will approve a particular upload.
Can you use Nintendo characters in your own videos, art or products?
Gameplay videos and screenshots
An individual consumer can generally start with the 2024 guidelines when sharing footage or screenshots from an officially released Nintendo game. Add your own commentary or other creative contribution, use only eligible material, and select monetization methods the guidelines specify. Keep records of the game version and source footage so you can explain what you uploaded if a platform flags it.

Fan art and illustrations
The gameplay-sharing guidelines do not grant general permission for fan art. Drawing a character, posting an illustration or using Nintendo imagery in a portfolio falls outside the policy’s stated scope. Whether a particular use is protected by an exception depends on the country, purpose, amount used and other facts; the safest course for a commercial project is to obtain permission or seek legal advice rather than infer consent from the video policy.
Merchandise and physical products
Nintendo says licensed accessories, peripherals, toys and apparel display its Official Nintendo Licensed Product Seal. Its Licensed and Unlicensed Nintendo Products guidance warns that unlicensed products have not gone through Nintendo’s testing and evaluation process and may not work or may have compatibility problems.
If you are buying official Nintendo character merchandise, look for the seal and verify the seller’s product information. A listing that merely shows a familiar character is not proof of authorization. The seal is Nintendo’s consumer-facing indicator for the licensed product categories it describes; it is not a guarantee that every item using Nintendo imagery elsewhere is approved.
Commercial collaborations
A business, studio or other corporate entity is outside the individual-consumer scope of the online video guidelines. Commercial use normally requires a separate permission or license, and the cited pages do not provide a universal application process or fee schedule. Do not treat a free project, an advertising-supported channel or a product sold at cost as automatically covered.
How enforcement and expansion work together
Strict enforcement and selective expansion are two sides of the same strategy. Enforcement limits unauthorized copying, counterfeit products and circumvention that can divert sales or confuse consumers. Stewardship limits official and licensed uses to projects Nintendo believes fit a character’s identity and quality standards. Together, these policies protect both the economic value of a game and the meaning audiences attach to its characters.
The strategy also gives Nintendo control over timing. A character can remain available for future game design instead of being permanently associated with an outside portrayal. Nintendo’s stated objective is not to maximize the number of appearances immediately, but to expand properties in ways that encourage interest in the games and dedicated platforms.
A practical decision guide for creators
- Identify the material. Separate gameplay footage, screenshots, music, logos, character artwork, software and product designs. Different rights may apply to each.
- Check whether you are an individual consumer. The 2024 online guidelines do not cover corporate entities.
- Match the use to the policy. If it is an online gameplay video or screenshot, compare every element with the eligible-content and monetization rules. If it is fan art, merchandise, a fan game or a modified game, do not assume the policy applies.
- Add genuine original contribution where required. Commentary or other creative input may be part of an eligible gameplay upload, but it does not erase rights in the Nintendo material itself.
- Remove commercial features the guidelines do not permit. Advertising, sales, sponsorships or other revenue methods are not automatically authorized because a video is free to watch.
- Check authorization for physical goods. For purchases, look for Nintendo’s Official Nintendo Licensed Product Seal and compatibility information.
- Get advice for a business project. If the use is commercial, corporate, or outside gameplay sharing, obtain a license or consult a lawyer familiar with the relevant jurisdiction.
Common misunderstandings about Nintendo’s protection
- “Nintendo owns the character, so every use is automatically forbidden.” The company has a strict enforcement policy, but the legal result depends on the right involved, the country and the facts. Its gameplay guidelines expressly allow certain individual-consumer sharing.
- “If I do not charge money, Nintendo has approved it.” Noncommercial status is not a blanket license. The 2024 policy permits only defined uses and monetization arrangements.
- “A video policy covers fan art and merchandise.” Nintendo describes the policy as online gameplay footage and image sharing. It does not create general permission for art, products or other character uses.
- “A product with a Nintendo character must be official.” Nintendo specifically warns about unlicensed goods and points consumers to its Official Nintendo Licensed Product Seal.
- “All protection is copyright protection.” Nintendo identifies copyright, trademarks, patents and design rights as separate tools with different functions.
The bottom line
Nintendo protects its characters closely because it sees them as long-term creative and commercial assets. Its stated goals are to defend the work and sales that finance new games, prevent counterfeit and unauthorized distribution, preserve player attachment, and expand each property without sacrificing quality or future creative flexibility. For creators, the practical distinction is crucial: Nintendo’s conditional gameplay-sharing rules are real but narrow, while fan art, fan games, merchandise and other commercial uses require a separate analysis rather than an assumption of permission.
