No single federal office preapproves every government advertisement. The answer depends first on what is being reviewed: a private company’s commercial ad, or a federal agency’s decision to spend public funds on a campaign. The FTC enforces truth-in-advertising laws for most commercial advertising but does not clear ads in advance. For an agency-funded campaign, the key questions are whether the agency has legal authority to spend the money and whether it follows applicable appropriations restrictions and internal controls. GAO can issue appropriations-law decisions and audit agency practices; the agency itself manages operations and review.
Start by identifying what kind of advertising is at issue
“Who reviews this ad?” can mean two different things. A private business may want to know whether its claims comply with consumer-protection law. A federal agency may want to know whether it can lawfully use appropriated funds for a public-information campaign, and whether its contracts and controls are adequate. Those questions involve different authorities, standards, and remedies.
The Federal Trade Commission (FTC) is the principal federal truth-in-advertising enforcer for most products and services. Federal agency advertising, by contrast, is not governed by a universal prepublication clearance office. Its spending authority depends on the agency’s statutory authority and the applicable appropriations law. The Government Accountability Office (GAO) addresses appropriations questions and audits agency performance and controls, while the agency makes operational decisions and maintains program controls.

How the FTC reviews private commercial advertising
The standard: truthful, not deceptive or unfair, and supported
The FTC’s advertising guidance says claims should be truthful, not deceptive or unfair, and supported by evidence. This is about the claims made to consumers and the basis for making them. It is not a government-wide system for reviewing all ads, and it does not make the FTC the reviewer of every federal agency campaign.

Enforcement is not a prepublication approval process
The FTC’s small-business guidance addresses the question, “Will the FTC review my company’s ads before they run to make sure that we’ve complied with the law?” Its answer is that “FTC staff cannot clear your ads in advance.” In practical terms, a business should not treat sending an ad to the FTC as a route to approval or as a guarantee that the ad complies.
The FTC’s Division of Advertising Practices can bring enforcement actions in federal or administrative courts, issue warning letters, develop rules and guidance, and provide consumer education. Those are enforcement and policy tools, not a routine pre-run sign-off service. The FTC describes its jurisdiction as covering most products and services, but Congress has assigned authority in some sectors to other agencies.

Check whether another sector regulator has authority
For an industry-specific commercial ad, do not assume that FTC jurisdiction is the whole answer. The FTC’s small-business guide identifies airlines, banking, insurance, common carriers, and securities and commodities as examples of areas where other agencies have authority. The correct regulator depends on the sector and the legal question; the existence of another regulator does not establish that every ad in that field is exempt from all consumer-protection requirements.

First question: is the expenditure authorized?
For government-funded advertising, the threshold issue is not simply whether the message is accurate or well designed. It is whether the agency may use the particular funds for the activity. GAO’s Principles of Federal Appropriations Law puts the rule this way: “Whether an agency’s appropriations are available for advertising, like any other expenditure, depends on the agency’s statutory authority.” That means a conclusion about one agency, program, or appropriation does not automatically answer the question for another.

Assessing a particular campaign therefore requires attention to the actual program authority, the appropriation being charged, and any applicable restriction in law. Congress may authorize programs and spending, and an appropriations act may impose conditions or limits. The relevant rule depends on the text and circumstances; there is no single restriction that answers every federal-advertising question.
Public-information restrictions are not a blanket ban
Appropriations decisions address restrictions on covert communications, self-aggrandizement, partisan activity, and certain appeals to the public to lobby Congress. These categories matter, but they should not be collapsed into a claim that ordinary factual government communication is prohibited. GAO has recognized that informing the public about agency policies and activities can be a legitimate government function.

GAO decisions concerning publicity or propaganda apply the relevant legal language to particular communications and facts. For example, GAO’s 2017 decision B-329199 addressed HHS communications, while its 2005 decision B-304272 concerned prepackaged news stories and the boundary around covert communications. Its 2010 decision B-320482 discussed categories of restricted publicity or propaganda. These decisions illustrate the kinds of issues that can arise; they are not a substitute for evaluating the statute, message, audience, and circumstances of a different campaign.

What GAO can and cannot do
GAO issues legal decisions on the availability of appropriated funds and audits agency performance and controls. Its decisions can assess whether an expenditure fits the governing appropriations rules; its audits can examine how an agency manages advertising activities and oversight. Those functions are distinct from approving creative content before release. The available authorities do not establish GAO as a universal ad-clearance office.

GAO’s role is also distinct from an agency’s day-to-day responsibility for a campaign. Agencies manage their programs and contracts, and their internal controls and review arrangements apply within the agency. Inspectors general can audit and investigate agency programs and operations when relevant, but an inspector general should not be treated as a mandatory preapproval office for every campaign.

GAO’s 2016 report DOD Advertising (GAO-16-396) recommended stronger coordination, performance measurement, and a clearly defined department-wide oversight role. GAO’s current product page reports that the Department of Defense later issued a November 2017 instruction defining oversight and review requirements. Those requirements included review of contracts and reporting for certain advertising activities.
This is an example of agency-specific policy and follow-up, not a model that automatically governs every department. The key lesson is that an agency can establish operational oversight requirements for its own advertising, and GAO can assess those arrangements. The DoD instruction does not create a government-wide approval chain or establish that all agencies use the same controls.

A practical way to route a federal advertising question
- Identify who is paying for the campaign. If a private company is advertising its product or service, focus first on truth-in-advertising jurisdiction. If an agency is paying, begin with the authority to spend the relevant funds.
- Define the legal issue. A claim that an ad misleads consumers is different from a claim that an agency used funds without authority, violated an appropriations restriction, or failed to maintain effective controls. One campaign can raise more than one kind of question, but the reviewer depends on the issue.
- For a commercial ad, identify the sector. The FTC covers most products and services, but the FTC guide names areas such as airlines, banking, insurance, common carriers, and securities and commodities where another agency has authority. Do not infer the responsible regulator solely from the fact that the ad is commercial.
- For a federal campaign, identify the agency and funding source. Review the agency’s statutory authority, the appropriation charged, and any applicable restrictions. A generic answer about “government advertising” cannot resolve an agency-specific spending question.
- Separate legality from management quality. Whether funds were legally available is an appropriations question. Whether the agency coordinated its work, measured performance, or maintained suitable controls is an oversight question that may involve agency management, an inspector general, or a GAO audit.
- Match the conclusion to the evidence and facts. FTC enforcement, a GAO decision, an audit finding, and an agency’s internal review are different types of action. None should be described as a universal prepublication clearance unless the applicable agency policy actually establishes that process.
What readers should not infer from a review or a decision
- No universal federal ad reviewer exists. The responsible body depends on whether the ad is commercial or government-funded, which sector is involved, and whether the issue is an advertising claim, spending authority, or internal control.
- FTC jurisdiction does not mean FTC advance approval. The FTC says its staff cannot clear ads in advance, even though it can investigate and enforce applicable advertising laws.
- A GAO decision is fact- and law-specific. A decision about one agency’s message or appropriations does not establish a blanket rule for all campaigns.
- Publicity-or-propaganda limits do not prohibit all public communication. GAO recognizes legitimate agency communication while also applying statutory restrictions to particular practices and facts.
- Agency oversight is not automatically independent clearance. Internal review, inspector-general oversight, and GAO audit or legal decisions serve different functions and should not be conflated.
Limits of a general answer
This framework explains the principal federal roles; it does not determine whether a particular advertisement is lawful or a particular expenditure is available. That conclusion turns on the agency’s authority, the specific appropriation and statutory language, the campaign’s purpose and content, and any relevant sector-specific law. There is no established current government-wide advertising-spending total that can be used to characterize the full federal advertising portfolio; the cited DoD report is department-specific and dates to 2016.
