On U.S. roads, the public agency or official with jurisdiction is responsible for traffic-control devices, including changeable message signs (CMS) and their operation. The person who actually types, approves, or schedules a message depends on the agency’s local procedures, the sign’s purpose, and whether the sign is permanent or part of a temporary work zone. A contractor may operate a portable sign it supplied, but that does not automatically remove the highway agency’s overall responsibility.

The direct answer

A roadside electronic sign is normally changed under the authority of the state, county, city, toll road authority, or other public agency that has jurisdiction over that roadway. The federal Manual on Uniform Traffic Control Devices (MUTCD) establishes national requirements, but it does not assign one universal job title, control room, or employee to enter every message. Each responsible agency sets its own operating arrangement.

For a permanent sign, the agency with jurisdiction remains responsible for the device’s design, placement, operation, maintenance, and message policy. A traffic-management center, district office, maintenance unit, emergency-operations staff member, or another authorized employee may perform the day-to-day update. Those internal assignments vary by agency.

For a temporary work-zone sign, a contractor may operate a portable CMS that the contractor furnished, subject to the public agency’s requirements and the construction contract. North Carolina, for example, assigns ultimate responsibility for messages to the Division Engineer while making the contractor responsible for operating a contractor-furnished sign. That is a state-specific example, not a nationwide rule.

What kind of sign is being changed?

The MUTCD defines a changeable message sign as a traffic-control device capable of displaying one or more alternative messages. The familiar yellow or orange electronic board with rows of illuminated characters is one type of CMS. Signs can be permanently installed beside or over a highway, mounted on a trailer for a work zone, or positioned temporarily for an incident, event, weather condition, or traffic shift.

Classification matters because ownership, operating authority, and staffing can differ. A sign outside a construction project may belong to a state department of transportation even when a private contractor is physically operating it. Conversely, a municipal sign on a city street may be controlled by the city rather than the state. A toll-road operator or other public authority can have its own procedures where it has jurisdiction.

Permanent highway signs

Who has overall responsibility?

The public agency or official having jurisdiction is responsible for traffic-control devices on that road. That responsibility covers more than changing words on a display. It includes selecting and placing the device, ensuring that it is operated consistently with applicable standards, maintaining the equipment, and establishing procedures for its use.

The national standard does not say that every CMS must be controlled by a particular title such as “traffic engineer” or “control-center operator.” One agency may centralize updates in a regional traffic-management center; another may authorize district personnel or a designated maintenance office. The controlling question is which public entity has jurisdiction and what that entity’s written policy says.

What the agency’s CMS policy normally addresses

For permanently installed or permanently positioned CMS, state and local highway agencies must maintain policies governing the signs. Those policies address the categories of messages that may be displayed, how messages are prioritized, the syntax or wording format, timing and duration, and related operating details. The policy is the practical bridge between the MUTCD’s national requirements and the agency’s local workflow.

  • Timing: when a message is activated, how long it remains, and when it is removed or replaced.
  • Authorization: which staff members or offices may approve, enter, review, or cancel a message.

Because these details are local, two signs on similar roads can be updated through different chains of command while both remain compliant with the same national standard.

Temporary work-zone and incident signs

When a contractor operates the sign

Construction projects commonly use trailer-mounted CMS to warn drivers about lane closures, shifted traffic, reduced speeds, queues, or changing work activities. If the contractor furnishes the portable sign, the contractor may be assigned to position it, turn it on, enter approved wording, and monitor it. The public agency still sets the project requirements and retains authority under the contract and applicable traffic-control rules.

“Operates the sign” and “is responsible for the traffic-control decision” are therefore different concepts. A contractor can carry out the physical update while the agency determines what information is required, approves the wording, or has final authority to order a correction.

North Carolina as a concrete example

The North Carolina Department of Transportation construction manual states that the Division Engineer has ultimate responsibility for messages used on changeable message signs, while a contractor is responsible for operating a contractor-furnished sign. This example shows how duties can be divided, but it should not be presented as the allocation in every state. Other agencies can use different contract language, approval paths, or staff assignments.

What messages are allowed?

The MUTCD 11th Edition, published in 2023, limits CMS content principally to traffic-operational, regulatory, warning, and guidance information, subject to the exceptions stated in the manual. Section 2L.02 says: “CMS shall display only traffic operational, regulatory, warning, and guidance information except as otherwise provided in this Chapter.”

This limitation explains why an agency should not treat a highway CMS as a general advertising screen or an unrestricted public bulletin board. A message must serve a traffic-control purpose recognized by the applicable standard and agency policy. The exact wording, abbreviations, display sequence, and duration are also constrained by the policy adopted for that sign system.

The 11th Edition is the relevant national edition identified for this subject. Agencies may also be operating under amendments, state supplements, project specifications, or later guidance, so a dispute about a particular display should be checked against the current requirements adopted in that jurisdiction.

How public input fits into message changes

Residents, drivers, elected officials, emergency responders, or event organizers may suggest that a sign carry certain information. Suggestions can help an agency identify a problem or understand what travelers need to know, but public requests do not by themselves authorize a message.

In a January 4, 2021 interpretation, FHWA’s Office of Transportation Operations Director Mark R. Kehrli explained that when public input is solicited, it should inform the message developed and displayed by the agency’s technical representatives, using conventional sign-legend syntax. In other words, public feedback can be an input to the process; authorized technical staff decide what is displayed and how it is worded.

Who has jurisdiction? The state, local, toll-road, or other public agency responsible for that roadway. The public agency responsible for the project and roadway, under the applicable contract and traffic-control requirements.
Who has overall responsibility? The public agency or official having jurisdiction, including operation and maintenance. The public agency retains the governing responsibility; contract documents define delegated tasks.
Who may furnish equipment? Usually the agency or its equipment contractor; the specific arrangement is local and not fixed by the national standard. A contractor may furnish a portable sign for the project.
Who may enter the message? An agency-authorized operator, office, or control center chosen by local policy. The contractor may operate a contractor-furnished sign when authorized, while the agency controls requirements and approval.
What controls the wording? The MUTCD, state or local supplements, and the agency’s CMS policy. The same standards plus project plans, specifications, and agency instructions.

No cell in this table implies a universal staffing model. The responsible agency’s policy and the project’s contract are the controlling documents for the particular sign.

How to find out who changed a particular sign

If you need an answer about one display rather than the general rule, identify the road and the sign’s operating context first. The following process usually separates the possible authorities without assuming that every sign is controlled from the same type of office.

  1. Record the location and time. Note the road name or route number, direction of travel, nearest intersection or exit, date, and approximate time. A photograph can preserve the exact wording if it is safe and lawful to take one.
  2. Determine whether the sign is permanent or temporary. A trailer, wheels, temporary supports, cones, or an active construction project point toward a work-zone CMS. A fixed overhead or roadside cabinet is more likely part of the permanent highway system.
  3. Identify the road authority. State highways are generally handled by a state transportation agency; city and county streets may be handled locally; toll facilities can have a separate authority. Route markers, agency logos, and construction-project signs can help, but they are not substitutes for confirming jurisdiction.
  4. Ask the agency that controls the road. Use its published traffic, maintenance, customer-service, or public-information channel. Provide the exact location, time, direction, and message so staff can trace the sign or project.
  5. For construction signs, ask for the project contact and contract authority. The contractor’s name may be posted at the work site, but the public agency’s project office remains the appropriate place to ask who approved the message and what operating duties were delegated.
  6. Request the governing policy when the issue is disputed. Ask which CMS policy, project specification, or operating procedure covers the sign. That document is more likely to answer who may approve and enter messages than a generic assumption about a “traffic-control room.”

Why a message may change without a new construction project

CMS are used for changing traffic conditions, not only for long-term roadwork. An agency can replace one display with another when a crash, emergency response, lane restriction, queue, severe weather condition, roadway closure, or other operational issue changes. A warning may be removed when the condition ends, or it may be shortened and reformatted so drivers can read it within the available viewing time.

An event-related notice, if permitted by the agency’s policy and the applicable standard, still has to fit the traffic-control purpose and the sign’s syntax rules. A driver’s assumption that a message “suddenly changed” does not identify which employee made the edit; it only shows that an authorized operator or automated schedule presented a different approved display.

Common misconceptions

“The federal government changes every sign.”

Federal standards establish requirements for uniform traffic-control devices, but the day-to-day operation of a state or local CMS belongs to the agency with jurisdiction. The national standard does not operate every roadside display.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The contractor owns the message because it owns the trailer.”

Equipment ownership and traffic-control authority are separate. A contractor can furnish and operate a portable unit while the public agency specifies, approves, or remains ultimately responsible for the message.

“Anyone who asks can put a sentence on the board.”

Public suggestions may inform message development, but FHWA’s interpretation places development and display with agency technical representatives acting under conventional sign principles. Requests do not bypass the agency’s authorization process.

“Every sign operator has the same job title.”

There is no universal operator title in the MUTCD. Local policies determine whether updates are made by a traffic-management center, district staff, maintenance personnel, or another authorized arrangement.

If a sign appears incorrect or unsafe

Do not stop, reverse, or make an abrupt maneuver to investigate an electronic sign. Treat the roadway condition as the immediate safety issue, follow the visible traffic control, and report the location through the responsible agency’s established channel when it is safe to do so.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Include the message, direction of travel, precise location, time, and the apparent problem—for example, a warning that remains after a closure has ended, text that is unreadable, or a display that conflicts with signs or officers at the scene. The agency can then determine whether the sign itself, its programmed schedule, a communications link, or the underlying traffic condition needs correction.

What the national rule does—and does not—answer

The MUTCD answers the national questions: a CMS is a traffic-control device, its content is principally limited to operational, regulatory, warning, and guidance information, and agencies must operate it within accepted sign principles. It does not answer the local questions of which employee logs in, who gives final approval, how a contractor is supervised, or which office receives a complaint.

Those answers come from the state or local agency’s CMS policy, organizational procedures, state supplements, and—when construction is involved—the project’s contract documents. That is why the same “who changed this sign?” question can have different operational answers in different jurisdictions while the public agency remains responsible in each case.
