It depends. There is no settled rule that makes the AI developer, shopping-agent provider, seller, marketplace, card issuer, or consumer automatically pay whenever an agent orders the wrong product. First determine whether the seller’s return policy or consumer law provides a refund, then check any marketplace claim process and the payment method’s dispute rules. Those routes decide who can recover money now; the question of who ultimately bears the loss among the parties remains unsettled.

Keep two questions separate: who processes a refund or dispute? and who should ultimately absorb the loss? A seller may accept a return, a marketplace may run a claim, or a card issuer may investigate a billing dispute without establishing a universal rule about the AI provider’s liability.

What “responsible” means in an AI purchase mistake

An AI agent can misunderstand a natural-language instruction, select a similar-looking product, choose the wrong size or quantity, or complete a purchase after interpreting an ambiguous limit. Legally and practically, that does not create one automatic refund path.

The party that gives you money first may not be the party that ultimately bears the loss. A seller can refund under its posted policy, a marketplace can resolve a claim under its own terms, and a credit-card issuer can process a qualifying billing dispute. The allocation of the final cost can still depend on authorization, contracts, consumer-protection law, network rules, and the facts of the transaction.

Federal Reserve Governor Christopher J. Waller described the unresolved issue in a September 28, 2026 speech: “Liability in this context comes down to a pretty simple question: Who is on the hook if an agent makes the wrong purchase?” He added that current e-commerce liability frameworks “could potentially be adapted for agentic commerce.” That is an acknowledgment that no single, agent-specific rule currently answers every case.

What to do immediately

Act quickly, because return and dispute windows can be shorter than the time needed to investigate how the agent made its decision.

  1. Preserve the authorization trail. Save the exact prompt or instruction, account settings, spending limits, product filters, the agent’s product recommendation, the cart, checkout confirmation, receipt, shipping record, and any seller or marketplace messages. Capture the product page as it appeared when ordered, including size, model, color, quantity, price, and seller identity. This record shows what you authorized and what the agent actually bought.
  2. Read the seller’s policy that applied at checkout. Check whether a return for a full refund is offered, the deadline, return-shipping responsibility, restocking fees, exclusions, and the required condition of the item. In the United States, Federal Trade Commission (FTC) guidance says an online seller’s site should state whether a full-refund return is available and explain its conditions.
  3. Contact the seller with the order number. Explain precisely what was ordered, what was intended, and whether the item is unopened, defective, not as described, or simply the wrong selection. Ask for written confirmation of the return authorization, label, deadline, and refund amount. Do not describe an intentional purchase as “unauthorized” unless that is accurate.
  4. Check the marketplace separately. Identify whether the marketplace was the seller or merely hosted a third-party seller. Read the platform’s buyer-protection terms and claim deadline; programs differ, and some leave the buyer and seller to resolve ordinary returns.
  5. Contact the payment provider promptly if needed. For a U.S. credit card, ask the issuer whether the facts fit a billing-error dispute and follow its instructions. If the loss is significant or the seller rejects a claim, obtain advice that applies to the transaction’s jurisdiction rather than assuming an AI-specific rule exists.

Seller refunds: start with the exact return terms

The seller is usually the first practical contact because it controls the order, return authorization, and refund under the contract presented at checkout. A seller may voluntarily accept an agent-selected item even when the law would not require a return, or it may deny a return that falls outside its policy.

Questions to check

  • Is the item eligible for a change-of-mind or wrong-item return?
  • What is the return deadline, and when does it start?
  • Must the item be unopened, unused, or in original packaging?
  • Who pays return shipping, and is the original shipping charge refundable?
  • Is there a restocking fee or a category-specific exclusion?
  • Was the listing accurate, or was the item defective, counterfeit, or materially different from its description?

Whether a seller must accept the return depends on governing law, the product, the seller’s representations, and the facts. An agent’s mistake does not automatically create a statutory refund right. Conversely, a wrong or defective item, a failure to deliver what was agreed, or a misleading listing may create rights independent of the agent’s involvement.

Marketplace claims are a separate route

Marketplace protections are not uniform. Some platforms provide a claim process for an item that never arrives or is materially not as advertised. Others direct buyers to the seller and provide little or no coverage for an ordinary selection error. Eligibility can depend on the seller’s status, the payment channel, the item category, tracking information, and a short filing window.

Before opening a claim

  • Confirm whether the transaction was with the marketplace itself or an independent seller.
  • Read the current buyer-protection terms and note the exact claim deadline.
  • Use the platform’s required messaging or return workflow so the record remains attached to the order.
  • Submit the authorization evidence only as needed; redact unrelated personal or payment information.
  • Do not assume that a marketplace decision determines whether the AI provider is legally liable.

If the marketplace refunds you, it may later recover from the seller under its contract. That internal allocation does not establish a general rule for every AI-assisted purchase.

Credit-card disputes and other payment methods

A payment dispute is different from a seller return. It asks the issuer or payment network to investigate a charge under rules for that payment instrument. The result is not guaranteed merely because an AI selected the wrong item.

Payment route What the available guidance establishes Important limitation
U.S. credit card FTC guidance says a customer who receives a wrong or defective item can dispute the charge. The Fair Credit Billing Act covers specified billing errors, including unauthorized charges and certain items not accepted or not delivered as agreed. The process depends on the facts and the issuer’s instructions. A purchase the consumer intentionally authorized, but the agent selected incorrectly, is not automatically the same as an unauthorized card charge.
U.S. credit-card timing The FTC says a billing-error dispute generally must be sent in writing within 60 days after the first statement showing the error is sent. This is a procedural deadline, not a guarantee that the issuer will decide in the consumer’s favor. Contact the issuer promptly and retain proof of the written notice.
Debit card Debit-card protections differ from credit-card protections. The FTC advises contacting the issuer and checking the rules for the payment type. Do not copy the credit-card 60-day procedure or other credit-card assumptions onto a debit transaction.
Other payment methods Use the provider’s stated dispute or buyer-protection process and preserve the transaction record. Coverage, deadlines, and eligible reasons vary; no universal AI-agent rule applies.

When you contact a credit-card issuer, describe the event accurately: the cardholder authorized the transaction, an agent interpreted the instruction, and the delivered item differs from the intended selection. The issuer may ask whether the item arrived, whether it was returned, what the seller offered, and when you first contacted the seller. Answering “unauthorized” when you did authorize the agent to buy something can undermine the dispute.

Does the AI company have to pay?

Not automatically. The sources available for this issue do not establish a rule requiring an AI developer or agent provider to refund every mistaken purchase. The provider’s contract, service terms, representations, negligence standards, consumer-protection law, and the agent’s actual controls could matter, but those questions are fact-specific and jurisdiction-dependent.

Likewise, the consumer does not automatically bear the loss simply because an automated system made the selection. The result can turn on the instruction’s specificity, the spending authorization granted to the agent, warnings shown before checkout, the seller’s policy, and whether the item was misdescribed or defective.

Factors that can change the outcome

  • Authorization: Did the user authorize the agent to complete purchases, or did the transaction exceed a stated price, merchant, product, or quantity limit?
  • Clarity of the instruction: Was the request precise enough to identify one product, or did it leave material choices open?
  • Confirmation and disclosure: Did the agent show the final item and total for approval, or place the order without a meaningful check?
  • Seller conduct: Was the listing accurate, and does the seller’s policy cover the requested return?
  • Contract terms: What do the seller, marketplace, payment, and agent-service agreements say about errors, refunds, limitations, and governing law?
  • Jurisdiction: Which country or state’s consumer and contract rules apply?

What UK guidance does—and does not—answer

The UK Competition and Markets Authority’s guidance published March 9, 2026 addresses businesses that use AI agents to interact with customers, including processing customer refunds. It states: “It does not matter whether they interact with (or get information produced by) a person or an AI agent. It’s important to remember that you are responsible for what an AI agent does in the same way you are responsible for what an employee does.”

In that passage, “you” means the business using the agent in its customer relationships. It supports holding a business responsible for complying with consumer law when it deploys an agent; it is not a categorical ruling that a consumer’s personal shopping assistant makes the consumer, the agent provider, or the seller liable for every wrong-item purchase.

How to document a claim so it can be decided

A concise evidence package reduces avoidable disputes. Include the order number, date, seller, item received, item intended, total charged, delivery date, the exact instruction, the agent’s displayed reasoning or confirmation, and every response from the seller or marketplace. Keep originals and note when each message was sent.

Separate facts from conclusions. “I instructed the agent to buy the 13-inch model under $800; it ordered the 15-inch model for $1,049” is more useful than “the AI acted illegally.” If the seller offers a return, follow the stated process before escalating unless a deadline makes that unsafe. Obtain tracking or a receipt for any return shipment.

Common situations and the likely first route

Situation First step Why the route matters
The agent chose the wrong size or color, and the item is unused Use the seller’s change-of-mind or exchange policy. This is commonly governed by the posted return terms, including shipping and restocking conditions.
The listing promised one model but a different model arrived Contact the seller and, if necessary, the marketplace claim channel. A not-as-described issue may fit protections that do not apply to a simple selection mistake.
The item never arrived Check tracking, then use the seller or marketplace non-delivery process; notify the payment issuer promptly if needed. Non-delivery is treated differently from receiving an intentionally authorized but incorrect product.
The agent exceeded a stated spending or product limit Preserve the limit and confirmation record, then raise it with the seller, agent provider, marketplace, and payment issuer as appropriate. The authorization boundary may be central to contract or billing analysis.
The seller refuses a return and the loss is substantial Review the payment-dispute rules and seek jurisdiction-specific consumer or legal advice. There is no blanket rule assigning the loss to the AI company.

Preventing the next wrong-item purchase

  • Require a human confirmation screen showing the exact product, seller, quantity, total, delivery address, and return terms before payment.
  • Set hard limits for price, quantity, merchant, category, and delivery date rather than relying on a broad natural-language instruction.
  • Use a separate payment method or spending limit for agent transactions.
  • Disable automatic substitutions unless the agent must obtain approval for each substitute.
  • Keep the agent’s logs and confirmations for the period in which returns or billing disputes may arise.
  • Review whether the service terms explain errors, refunds, complaint handling, and governing law.

When to seek specialized advice

Consider jurisdiction-specific consumer advice or legal counsel when the amount is substantial, the item is safety-critical, the seller is overseas, the seller threatens collection, a payment dispute is denied, or the agent exceeded a documented authorization limit. Bring the complete evidence trail and the terms that applied at checkout. An adviser can assess the governing law and contracts; no general article can predict the result for every agent-commerce transaction.
