An AI chatbot should stop and bring in a qualified human when continuing could cause material harm, when it cannot reliably understand the situation, when it behaves unexpectedly, or when you ask to speak to a person. The more consequential or difficult to reverse the outcome, the less appropriate it is for the system to keep improvising on its own.

Human oversight does not mean a person must approve every chatbot reply. It means the system and its operating process give an assigned person a meaningful ability to understand what is happening, assess the AI’s output, and intervene when needed.

When should an AI chatbot hand you off to a human?

A handoff is warranted when the automated conversation is no longer a safe or reliable way to handle the user’s need. These are practical escalation triggers, not a universal legal checklist:

  • Health, safety, rights, or essential services are at stake. If an answer could affect someone’s health, physical safety, liberty, or access to an essential service, a trained person should take over the consequential decision.
  • The system cannot establish what it needs to know. Missing information, conflicting answers, or an inability to interpret the user’s circumstances should lead it to explain the limit and escalate—not guess in a high-stakes situation.
  • Something unexpected happens. Contradictory output, a failed tool, an unplanned action, or behavior outside the intended process should pause the automated path for review.
  • The user asks for a person. Provide a clear route to a human where one exists, without making the user repeatedly justify the request.
  • The action would be hard to reverse. As a practical safeguard, require human review before an irreversible or consequential action rather than waiting until after its effects.
  • The user may be vulnerable or in distress. Avoid presenting a chatbot as a substitute for qualified help, and route to an appropriate person or service when available.

These triggers reflect a risk-based approach: the plausible harm, the system’s autonomy, and the circumstances of use should shape how much human oversight is needed. The EU AI Act states that, for high-risk AI systems, oversight measures should be proportionate to those factors. Article 14 of Regulation (EU) 2024/1689 says oversight should aim to prevent or minimise risks to health, safety, or fundamental rights.

What makes a human handoff meaningful?

A transfer is not meaningful just because the chatbot sends a case to a queue. The person receiving it needs enough context and the competence, training, and authority to act. The European Commission’s explanation of Recital 73 describes overseers as needing the ability to decide if, when, and how to intervene.

A workable handoff process should make clear:

  • Who receives the case and what decisions they are authorized to make.
  • How quickly the user can expect a response, including what happens outside business hours.
  • What conversation context transfers, so the user does not have to start over unnecessarily.
  • What the AI must stop doing while the case awaits review.
  • How users with urgent needs can reach appropriate help rather than waiting in a routine queue.

These are operational design recommendations. The exact staffing, response times, and urgent-help route depend on the service and the risks it handles.

When should AI stop answering because it is uncertain?

Uncertainty matters most when the cost of being wrong is high. A chatbot that cannot interpret a low-stakes request may ask a clarifying question or say it does not know. If the same uncertainty concerns a medical, safety, legal-rights, or other consequential matter, continuing to generate plausible-sounding answers can create more risk than pausing.

The system should say what it cannot establish, avoid taking consequential action, and route the case to someone qualified to assess it. Unexpected performance is also a stop signal: Article 14 specifically describes monitoring anomalies, dysfunctions, and unexpected performance for high-risk systems, with the ability for overseers to interpret outputs, disregard or reverse them, and intervene or interrupt operation.

Does the AI Act require every chatbot to offer a human?

No. Article 14 of Regulation (EU) 2024/1689 concerns high-risk AI systems; it should not be described as a universal human-handoff rule for every customer-service chatbot. For systems within its scope, Article 14 requires effective human oversight during use, with measures commensurate with risk, autonomy, and context. The article’s operative provisions describe oversight capabilities such as understanding system limitations, monitoring performance, interpreting outputs, disregarding or overriding them, and intervening or interrupting operation as appropriate and proportionate.

Recital 73 is explanatory text about the purpose of oversight and the competence, training, and authority of assigned overseers; it is not a separate operative article. For exact obligations, check the current legal text and whether the particular system falls within the relevant category.

Is telling users they are talking to AI the same as offering a human?

No. Disclosure and escalation are different issues. European Commission guidance says people within Article 50’s scope must be informed from the beginning of their first direct interaction with an AI system, unless it is obvious that they are interacting with AI. That transparency duty does not itself create a general requirement to transfer the conversation to a person. See the Commission’s Article 50 transparency guidance for the scope of that obligation.

What should users know about chatbot use by children?

Chatbots used as companions or in other sensitive contexts can raise particular concerns when children or teenagers are involved. In September 2025, the US Federal Trade Commission said it had ordered seven consumer-facing chatbot companies to provide information about how they evaluate, test, and monitor potential negative effects on children and teens, and how they inform users and parents about risks. This was an inquiry seeking information, not a finding that a particular chatbot caused harm and not a universal rule requiring a specific handoff protocol. The FTC announcement is available at FTC Launches Inquiry into AI Chatbots Acting as Companions.

How do the EU AI Act dates affect these duties?

Dates depend on the specific obligation and system category. As reflected on European Commission pages checked on 6 October 2026, Article 50 transparency rules apply from 2 August 2026; Annex III high-risk obligations apply from 2 December 2027; and high-risk AI systems embedded in regulated products apply from 2 August 2028. These are not universal deadlines for every chatbot duty. The Commission’s pages on AI Act enforcement and the AI Act regulatory framework explain the dates and categories. The legal text cited here is the EUR-Lex consolidated text dated 27 July 2026, so readers applying the law should verify the currently applicable provision and consolidated text.
