A data center can disturb nearby residents without exceeding a conventional noise limit. The mismatch is often about persistent, tonal or low-frequency mechanical sound—not simply a brief peak in loudness—and many ordinances were designed for short-lived sources such as parties or barking dogs. Virginia offers a detailed example of how local governments are adapting, but noise rules vary by jurisdiction.

Why can a data center sound intrusive if it meets the noise ordinance?

Data centers rely on mechanical equipment, and some nearby residents report that a steady low-frequency hum affects their well-being. Virginia’s Joint Legislative Audit and Review Commission (JLARC) says this sound is rarely loud enough to violate existing ordinances and is not loud enough to damage hearing. It also notes that most facilities do not generate complaints, often because of their location or design. A resident’s report is important evidence of a concern, but it does not by itself establish a measured violation or prove a health effect. The challenge for enforcement is that a sound can be persistent and noticeable without crossing a limit written for general loudness. A rule may also use a measurement that does not fully describe the sound residents find troubling.

What do dBA, dBC and octave-band measurements tell you?

A-weighted decibels (dBA) emphasize frequencies people generally hear most readily. They are useful and comparatively straightforward for local governments to apply, but may underrepresent low-frequency sound or the discomfort associated with a steady tone. Loudoun County says C-weighted decibels (dBC) and octave-band analysis can cover a broader range of frequencies. Those methods require additional equipment and training. That does not make one number universally right. A reading needs context: the metric used, where and when it was taken, how long the sound was measured, the facility’s operating condition, and the local background sound. A limit measured at a property line at night cannot be compared directly with a reading taken somewhere else, at another time, or using a different metric.

How are Virginia counties adapting their rules?

Virginia localities have used or considered tools beyond general nuisance ordinances, including sound studies for proposed projects, measurements of operating facilities, changes to nighttime exemptions and zoning standards. The rules differ by county; these examples are not nationwide requirements. JLARC recommends that the General Assembly consider expressly authorizing local governments to set and enforce data-center sound limits, including alternative low-frequency metrics and zoning-based rules separate from ordinary noise ordinances. That is a recommendation, not proof that every locality has this authority or has adopted such limits. JLARC’s report describes the recommendation and local activity.

Fairfax County: setbacks, screening and studies

In September 2024, Fairfax County adopted a data-center zoning amendment. Under the county’s summary, equipment must be enclosed or screened in districts where data centers are allowed. Data center buildings generally must be at least 200 feet from adjacent or abutting residential property, and backup generators must be 300 feet away or screened by the data center building. Special-exception pathways apply. The amendment also requires pre- and post-construction noise studies. These are Fairfax County rules, not a general U.S. standard. Loudoun County: property-line limit and enforcement

Loudoun County states a maximum of 55 dBA at the property line for residential properties. Its framework combines noise ordinances with zoning rules, which it says are used more often for business-noise violations. A pre-construction study is required at site-plan review; a post-construction study is due between one and 12 months after the first Certificate of Occupancy.

When a complaint is made, zoning enforcement collects data. If it substantiates a violation, the operator must demonstrate compliance; unresolved violations may lead to a Notice of Violation and civil penalties. JLARC describes a maximum $500 civil penalty after the first offense in the context of Virginia state law for noise-ordinance violations; this is not a nationwide penalty. Loudoun also says its rules lack specific language for tonal or low-frequency noise. The county’s noise page describes its limits and procedures.

Loudoun’s standards project is continuing

Loudoun’s Board initiated a data-center standards project in 2024. The county says Phase 1 changes were approved on March 18, 2025, and Phase 2 is underway to consider policy guidance and use-specific zoning standards. Its project page anticipates further amendments in spring or summer 2027; that is a stated expectation, not an adopted effective date. Loudoun’s standards and locations page tracks the project.

What should a data-center noise rule specify?

A limit is only meaningful alongside its measurement and enforcement rules. When assessing a proposed standard or an existing complaint process, check these details:

  • Metric and frequency coverage: Does the rule use dBA alone, or add dBC or octave-band measurements to capture low-frequency or tonal components?
  • Measurement location and timing: Is sound measured at the property boundary or another receiving location? Does the rule distinguish day and night, specify duration, and identify operating conditions?
  • Baseline and follow-up: Are there pre-construction modeling or ambient measurements, a post-opening test, and periodic checks?
  • Investigation and enforcement: Who responds to complaints, what equipment and training are used, what establishes a violation, and what happens if it is not corrected?
  • Land-use protections: Do setbacks, screening, equipment placement or facility location reduce exposure before operation begins?

South Carolina Bill 867, introduced in the 2025–2026 session, illustrates how specific a proposal can be; it is bill text, not a verified current state limit. It proposes 60 dBA Leq at residential property boundaries from 7 a.m. to 10 p.m. and 50 dBA Leq overnight, along with baseline monitoring before operation, a check within six months and then every three years. Proposed mitigation options include acoustic barriers, quieter equipment where feasible, building orientation, vegetation buffers and maintenance. The bill’s enactment status is not established here, so do not treat these figures as current requirements. The South Carolina Legislature’s bill text sets out the proposal.

What can a nearby resident do about persistent noise?

Start by recording when the sound occurs and where it is most noticeable. Note dates, times, duration and relevant conditions, such as whether the sound continues overnight. A basic sound-level meter may help keep a consistent record, but a consumer reading does not establish a code violation, may not adequately capture low-frequency sound, and is not a substitute for calibrated equipment or an agency inspection.

Then check the applicable county or city rules and ask the responsible planning or zoning office how to submit a complaint and what measurements it can collect. Include the location, timing and persistence of the sound. If a locality uses only dBA, ask whether its procedures address tonal or low-frequency noise; the answer depends on local rules and available measurement capacity.
