For an Indian construction service covered by the legacy Point of Taxation Rules, 2011, an advance generally becomes taxable when the provider receives it. Rule 3 states that when an invoice is issued or payment is received before the service is provided (or agreed to be provided), the point of taxation is the earlier event for the amount covered. Its explanation is explicit: an advance, by whatever name, is taxed at the date each advance is received. You therefore generally cannot defer the service-tax point of taxation until construction is completed merely because the work is still in progress.
A different timing rule applies to a continuous supply for which payment is due periodically or from time to time. The contractual due date can determine when that portion is treated as provided, unless an earlier invoice or receipt of payment fixes the point for the amount concerned. These are legacy service-tax rules. For supplies on or after 1 July 2017, GST law and its transition provisions must be examined instead.
What “due” means in this question
The Point of Taxation Rules determine when a service-tax liability arises (the point of taxation). That date is not necessarily the same as the last date for depositing tax or filing a return. Deposit and return deadlines came from separate procedural provisions. This article answers the timing question: which event makes the tax chargeable for an advance or instalment?
The answer also depends on whether the transaction falls within the service-tax regime, whether the construction activity was a taxable service, whether an exemption or abatement applied, and which version of the rules governed the transaction. A contract signed in one period can contain payments received in another, so the date of each relevant event matters.

First identify the governing tax regime
Service-tax period
Notification No. 18/2011-Service Tax, issued on 1 March 2011, brought the Point of Taxation Rules, 2011 into force from 1 April 2011. For a construction-service advance or part payment in that legacy period, apply the rule version in force on the relevant dates and check later amendments and transition provisions.
GST period
GST commenced on 1 July 2017. A supply taking place from the GST transition onward is not governed simply by the old service-tax answer. GST has its own time-of-supply and invoicing rules, and construction classification can turn on the nature of the supply and facts such as completion or occupation. A historic dispute straddling the changeover requires a transaction-by-transaction review rather than an automatic application of Rule 3 or Rule 6.
Ordinary service timing: why an advance can trigger tax
For an ordinary taxable service, compare three events: when the service was provided (or was to be provided), when the invoice was issued, and when payment was received. If an invoice or payment comes before provision, the earlier applicable event sets the point of taxation for the amount it covers. The rule specifically removes doubt about advances.
The official explanation to Rule 3 states: “For the purposes of this rule, wherever any advance, by whatever name known, is received by the service provider towards the provision of taxable service, the point of taxation shall be the date of receipt of each such advance.” “Advance,” therefore, is not limited to a document labelled advance. A booking amount, mobilisation amount, deposit applied toward the service, or similar receipt can be caught when it is received toward a taxable service.

| Event or document | How it affects the point of taxation | What to establish |
|---|---|---|
| Service provided before invoice and payment | The ordinary provision rules apply; the advance rule is not engaged for a payment that has not yet been received. | Actual service date and the amount attributable to that service. |
| Invoice issued before service | The invoice date can fix the point for the amount covered, subject to the rule version and invoice conditions then applicable. | Issue date, amount, description and whether the invoice relates to a taxable service. |
| Payment received before service | The receipt date generally fixes the point for that amount; an advance is taxed by reference to each receipt. | Bank credit, receipt voucher, cash record and the contractual purpose of the payment. |
| Invoice and payment before service | Use the earlier event for the covered amount, while preserving evidence of both dates. | Invoice issue date, receipt date and reconciliation to the same portion. |
The rule works by amount or portion, not merely by the overall contract value. If a customer pays 20% of the agreed price, the analysis concerns that 20% and the work or stage to which the contract allocates it. A later payment is assessed separately; an earlier advance does not automatically accelerate every future instalment.
How to analyse construction instalments and milestones
Construction agreements often use labels such as foundation stage, slab completion, handover, or percentage-of-work billing. Do not treat the label itself as decisive. For each instalment, separate the contractual due date, invoice date, actual receipt date, whether the service is continuous, and the portion or value covered.
| Situation | Likely timing question under the legacy rules | Evidence to retain |
|---|---|---|
| Customer pays a mobilisation amount before work starts | Receipt of that advance is generally the point of taxation for the amount received. | Agreement, receipt date, bank statement and allocation of the mobilisation amount. |
| Contract says the second instalment is due on completion of a specified stage, but the customer pays early | For a continuous supply, the specified due date matters, but the earlier receipt can move the point forward for the amount paid. | Stage clause, payment request, bank credit and certification of the portion. |
| Provider issues an invoice before the contractual due date and before payment | The earlier invoice can control the amount covered, subject to the applicable rule and invoice validity. | Invoice sequence, issue timestamp and contract schedule. |
| One payment covers several future stages without a reliable allocation | The provider must identify what portion the receipt relates to; uncertainty makes the classification and valuation review more important. | Customer correspondence, ledger coding, work schedule and reconciliation. |
Contractual due date, invoice date and receipt date are different events. A clause saying that an amount is “payable” on a future date does not erase an earlier receipt. Conversely, a payment schedule can matter where the arrangement meets the continuous-supply rule and no earlier event has fixed the amount.

Continuous supply of service: the special rule
Rule 6 addresses a continuous supply where the whole or part of the service is determined or payable periodically or from time to time. The notification says: “In case of continuous supply of service, the whole or part of which is determined or payable periodically or from time to time, shall be treated as separately provided at the date on which the payment is liable to be made by the service receiver, if such date is specified in the contract.”

In practical terms, a contractually specified payment date can create a separate point of taxation for that portion even though the overall construction project continues. The rule does not make the due date the only possible trigger. If the provider issues an invoice earlier, or receives the money earlier, that earlier event can determine the point for the amount covered. Each advance remains tied to its own receipt date.
Questions that indicate a continuous supply
- Does the agreement provide for recurring, periodic or stage-based consideration rather than one undivided payment?
- Is the date on which each amount becomes payable written into the contract or a clearly incorporated schedule?
- Can each amount be linked to a defined part of the service or value?
- Was an invoice issued or payment received before the specified due date?
A construction project is not automatically a continuous supply merely because it lasts many months. The contractual payment mechanism and the facts of the service must be examined under the rule applicable to the period.
A step-by-step timing test
- Fix the transaction date. List the dates of every advance, instalment, invoice, stage certification and service event. Decide whether the relevant supply is before 1 April 2011, between 1 April 2011 and 30 June 2017, or from 1 July 2017 onward.
- Choose the regime and rule version. For the legacy period, check the Point of Taxation Rules and amendments in force on the event date. For the GST period, stop and apply GST time-of-supply and transition provisions instead.
- Confirm the service and taxability. Establish what the provider supplied, whether it was a taxable service in the relevant period, and whether an exemption, abatement or special classification applied.
- Define the amount under review. Map every receipt to a percentage, milestone, work package or other contractual portion. Do not apply one date to the entire contract without an allocation.
- Test for an advance. If money was received toward a taxable service before provision, record the receipt date as the primary timing event for that amount under Rule 3.
- Test for continuous supply. If the service and contract meet Rule 6, identify the specified contractual due date for each portion. Then check whether an invoice or actual payment occurred earlier.
- Reconcile the conclusion. Match the selected point of taxation to the invoice, receipt records, accounting entry and tax return for the relevant period. Investigate any mismatch before finalising a legacy position.
Worked examples using the legacy rules
Example 1: advance before construction starts
A hypothetical customer signs a taxable-service agreement and transfers an advance on 10 May 2014. Site work starts in June. Because the money was received toward the taxable service before provision, the Rule 3 timing event for that advance is 10 May 2014. Completion in June does not postpone the point for the amount already received.

Assume a contract states that a specified stage amount is payable on 30 September 2015. The provider issues an invoice on 15 September and the customer pays on 20 September. For the covered amount, the earlier invoice event can determine the point under the applicable rule; the later contractual due date does not move it back to 30 September. The file should show that the invoice and payment relate to the same stage.

Example 3: due date arrives before payment
Suppose a continuous-supply contract specifies 31 January 2016 as the due date for a monthly portion. No invoice was issued earlier and the customer pays in February. The contractual due date is the relevant Rule 6 event for that portion, provided the arrangement qualifies and the rule version in force supports that treatment. The February receipt remains important evidence, but it is not automatically the contractual due date.
Documents that determine the answer
A defensible legacy position depends on contemporaneous records, not the name later given to a payment. Assemble:
- The signed agreement, amendments and incorporated payment schedule.
- Milestone definitions, stage certificates, measurement sheets and correspondence accepting completion.
- Every invoice, debit note, receipt voucher and credit note, with issue dates and amounts.
- Bank statements, payment gateway records or cash-book entries proving the date funds were received.
- Ledger extracts linking each receipt to a work stage or contract portion.
- Service classification, exemption or abatement documents and any departmental correspondence.
- Tax returns and challans for the periods in which the points of taxation were recorded.
- Evidence of the exact rule version and transition notification relied upon for a disputed date.
Where a receipt is a refundable security deposit rather than consideration toward a taxable service, its legal character requires separate analysis. The fact that a contract calls something a “deposit” is not by itself conclusive; the agreement and subsequent adjustment records should show whether it was actually received toward the service.

Using the contract due date even after early payment
Error: ignoring a bank receipt that precedes the stated milestone date. Correction: compare the due date with invoice and receipt dates; an earlier event can control the amount covered.
Using the payment date for every instalment
Error: assuming that a later-paid instalment always waits until cash arrives. Correction: check whether an invoice was issued earlier or whether a continuous-supply due date already fixed the point.
Applying service-tax rules to a GST-period supply
Error: carrying the 2011 rule into a supply on or after 1 July 2017. Correction: classify the transaction under GST and examine the statutory transition provisions for any overlap.

Failing to allocate a lump-sum receipt
Error: recording one undifferentiated advance against an entire multi-stage project. Correction: obtain a contract-based allocation and preserve the working paper that connects the receipt to the relevant portion.
What can change a case-specific conclusion
The general timing principles do not decide every dispute. The result can change if the activity was not a taxable service, an exemption or abatement applied, a later amendment changed the rule, the payment was not consideration for the service, or transition provisions assigned the transaction to another regime. Valuation of the portion covered by an advance can also require contract-specific evidence.
Before giving a definitive opinion on a legacy assessment, gather the transaction date, agreement and payment schedule, invoice dates, proof and dates of receipt, service description, stage allocation, exemption or abatement position, and the relevant transition notification. A tax professional should verify those facts against the rule text and any contemporaneous departmental guidance.
Practical checklist
- Have you identified whether the receipt occurred in the service-tax period or after GST began?
- Have you recorded the actual receipt date rather than only the date shown on a receipt voucher?
- Does each advance or instalment have a documented contractual purpose?
- Is the arrangement genuinely a continuous supply with specified periodic or stage due dates?
- Was an invoice issued before the contractual due date or before payment?
- Have you checked exemptions, abatements, amendments and transition provisions?
- Do the books, bank records, invoices and returns all point to the same amount and date?
The safest way to answer “when is service tax due?” is therefore to analyse each amount separately: identify the governing regime, determine whether Rule 3 or the continuous-supply rule applies, compare the contract due date with invoice and receipt events, and preserve evidence for the portion taxed. For a post-1 July 2017 supply, perform a fresh GST analysis instead of relying on this legacy framework.
