A GST taxpayer has the strongest basis to request cross-examination when the adjudicating authority proposes to rely on an adverse witness statement, the taxpayer specifically disputes that statement, and the request is made during adjudication before the order is decided. The request should identify the witness and statement, explain its materiality, describe the factual issues to be tested, and ask for a reasoned decision before the evidence is relied upon.

Indian courts have applied the Supreme Court’s natural-justice ruling in Andaman Timber Industries to GST disputes, but the decisions do not establish an unconditional right in every case. The result depends on the evidence, the statutory setting, the timing and specificity of the request, and the controlling High Court jurisdiction.

What creates a legal basis for cross-examination?

The issue is not merely whether the CGST Act contains the words “right to cross-examine.” The practical question is whether procedural fairness requires the taxpayer to test evidence that the department is using against it. A witness’s statement can affect a proposed tax demand, input-tax-credit reversal, confiscation, interest, or penalty. If the authority relies materially on that statement without allowing a meaningful opportunity to challenge it, the taxpayer can argue that the hearing was incomplete.

Natural justice and the Andaman Timber principle

In Andaman Timber Industries v. Commissioner of Central Excise, Kolkata-II, decided under central excise law on 2 September 2015, the Supreme Court treated denial of cross-examination as a serious natural-justice defect where witness statements formed the basis of the order. The Kerala High Court reproduced the Supreme Court’s conclusion as follows:

“According to us, not allowing the assessee to cross-examine the witnesses by the Adjudicating Authority though the statements of those witnesses were made the basis of the impugned order is a serious flaw which makes the order nullity inasmuch as it amounted to violation of principles of natural justice because of which the assessee was adversely affected.”

The case was not decided under the CGST Act, so it is not a standalone GST provision. GST High Courts have nevertheless relied on or discussed its reasoning when a department seeks to use third-party statements against a registered person.

Section 75(4) and the hearing opportunity

The Delhi High Court’s judgment dated 29 July 2025 in W.P.(C) 4853/2025 discussed the opportunity of hearing under section 75(4) of the CGST Act. In the context of an adverse third-party statement, the judgment treated cross-examination as part of a meaningful hearing where the authority uses that statement against the taxpayer. That reasoning supports a targeted request, but it does not turn every departmental witness into a witness who must automatically be produced.

Reliance, not mere existence, is central

A statement obtained during an investigation does not by itself establish a cross-examination entitlement. The stronger case is one in which the show-cause notice or proposed order cites the statement as evidence for a disputed finding and the finding would be materially weaker without it. If the authority expressly disclaims reliance on the statement, or the statement is peripheral and cumulative, the legal argument is less certain.

When is a request strongest?

The following factors, drawn from the reasoning in the GST decisions, make a request more persuasive. They are practical indicators rather than a statutory checklist or guarantee of success.

  • An adverse statement exists. The witness has made a statement that supports the department’s allegation or contradicts the taxpayer’s records.
  • The notice or proposed order relies on it. The document identifies the statement, its date, or its substance as support for the proposed demand, penalty, or other adverse action.
  • The taxpayer identifies a real dispute. The request points to a contested fact, omission, contradiction, translation issue, recording circumstance, or credibility concern rather than asking for questioning in the abstract.
  • The evidence is material. The statement bears on liability, classification, valuation, supply, movement of goods, input-tax credit, mens rea, or another issue that could change the outcome.
  • The request is timely. It reaches the adjudicating authority early enough to be considered before the authority decides the case using the statement.
  • The requested subjects are relevant. The taxpayer explains what questioning may establish, such as the witness’s source of knowledge, whether the witness personally observed the transaction, the circumstances in which the statement was recorded, or an inconsistency with contemporaneous documents.

In Nishad K.U. v. The Joint Commissioner, decided by the Kerala High Court on 17 December 2024, the adjudicator had relied on statements recorded during investigation and assumed that cross-examination would not affect credibility. The court rejected that presumption. Its formulation was: “The Adjudicating Authority cannot presuppose or presume what could be the subject matter of the cross-examination, or what benefit would be derived by the person proceeded against, through such cross- examination.”

The Madhya Pradesh High Court likewise described fair hearing as requiring an opportunity to cross-examine witnesses whose evidence was relied on in the show-cause notices in W.P. No. 12326 of 2024, decided on 20 May 2024.

When is the legal position weaker or uncertain?

Courts do not treat cross-examination as an automatic procedural step in every GST adjudication. The argument is weaker in several situations:

  • The witness is not identified and the taxpayer cannot show what statement is being challenged.
  • The authority does not rely on the statement in the notice or final order.
  • The request gives no reason why the statement is inaccurate or why questioning could affect the result.
  • The evidence is immaterial, entirely corroborative, or unrelated to the finding under challenge.
  • The taxpayer waits until after the adjudication order, without explaining why the request could not have been made earlier.
  • The proceeding involves a different statutory scheme or a jurisdiction whose binding decisions limit the application of natural-justice principles.

These limitations do not mean that a late or imperfect request is automatically lost. They mean the taxpayer should explain the timing, identify the material prejudice, and show how the disputed evidence affected the decision.

When should the request be made?

Make the request during adjudication, in writing, and before the authority decides the case on the disputed statement. A reply to the show-cause notice is a natural place to raise it, but a separate application or follow-up representation may be appropriate if the statement is disclosed later. The Madhya Pradesh High Court described the opportunity as one to be afforded at an appropriate stage of the proceedings; that stage must still allow the authority to consider the request before issuing its decision.

Do not assume that an oral request at a hearing is enough. Send a written request through the filing channel applicable to the proceeding, retain the acknowledgment or electronic receipt, and refer to the request in later written submissions and at the hearing.

How to prepare a focused written request

  1. Identify the witness. Give the witness’s name, role, statement date, and any document or annexure number used in the notice. If the identity has been withheld, identify the statement by the description and page or paragraph reference available to you.
  2. Quote or pinpoint the disputed passage. Reproduce the relevant assertion briefly or cite the page and paragraph. Avoid asking to cross-examine every person mentioned in the investigation without linking each person to an adverse proposition.
  3. Explain the materiality. State which proposed finding depends on the statement and why the finding could change if the witness’s account is qualified or rejected.
  4. Describe the subjects for questioning. List the factual areas to be tested: personal knowledge, records reviewed, the circumstances of recording, interpretation of documents, omissions, contradictions, or whether the statement accurately captures the witness’s words.
  5. Ask for sequencing. Request that the authority decide the cross-examination application before relying on the statement in the adjudication order, and ask that the witness be made available through the procedure the authority considers appropriate.
  6. Request reasons if refused. Ask for a speaking order or recorded reasons addressing materiality, relevance, and the specific grounds raised.
  7. Renew the request if reliance continues. If a hearing notice or draft order still relies on the statement, repeat the objection and identify the earlier filing and acknowledgment.

What not to claim

The reviewed decisions do not prescribe one mandatory application form, a universal filing deadline, or a single filing portal. Do not state that a particular template is legally required unless the rules governing the individual proceeding say so. Likewise, do not promise that the authority must allow questioning of every departmental officer or every person whose name appears in the case file.

Cross-examination and access to documents are separate requests

Cross-examination addresses the opportunity to test a witness. It does not replace the taxpayer’s request for the relied-upon documents needed to answer the notice. Ask separately for copies of statements, reports, annexures, and other material actually relied on. The Madhya Pradesh decision discussed access to documents and referred to section 67(3)’s rule concerning return of documents that are not relied upon. That document-return issue is distinct from whether a witness must be made available for questioning.

If the authority relies on a statement that was not previously supplied, object promptly, identify the prejudice, and ask for the document and adequate time to respond. A request for cross-examination should not be used to conceal a failure to seek basic disclosure.

What if the adjudicating authority refuses?

A refusal can support a natural-justice challenge when the disputed statement materially supports the adverse decision and the taxpayer was denied a meaningful chance to test it. Andaman Timber characterized the refusal in its facts as a serious flaw. The GST High Court decisions show that courts may set aside or remand an order in an appropriate case, but there is no automatic rule that every refusal nullifies every GST order.

Preserve a complete record:

  • the statement and the notice passages that rely on it;
  • the written cross-examination request and filing proof;
  • any response, hearing order, or silence by the adjudicator;
  • submissions explaining the factual dispute and materiality; and
  • the final order’s treatment of the statement and the request.

In a challenge, connect the procedural failure to prejudice: identify the finding that depended on the witness, explain what questioning could have tested, and show where the final order relied on the statement despite the unresolved request. Depending on the proceeding and jurisdiction, the statutory appeal route may be important, and a writ petition is not guaranteed to be entertained. Obtain case-specific advice before selecting a remedy or allowing an appeal deadline to expire.

How recent decisions compare

Decision Date What it illustrates Qualification
Nishad K.U. v. The Joint Commissioner, Kerala High Court 17 December 2024 The adjudicator could not presume that cross-examination would have no effect on credibility where investigation statements were relied upon. Outcome depends on the facts and the materiality of the statements.
W.P. No. 12326 of 2024, Madhya Pradesh High Court 20 May 2024 Fair hearing included an opportunity to cross-examine witnesses whose evidence was relied on in the show-cause notices. The ruling also addressed document access, which is a separate issue.
W.P.(C) 4853/2025, Delhi High Court 29 July 2025 Discussed section 75(4) and cross-examination as part of a hearing when adverse third-party statements are used. The judgment does not create an unconditional requirement to produce every witness.
M/S JSW Steel Limited, Karnataka High Court proceedings 13 August 2025 source Recorded competing arguments: the Revenue disputed a general statutory right, while the taxpayer relied on natural justice when statements are used against it. The material reviewed does not establish the final Division Bench disposition of W.A. No. 303 of 2025. Verify the signed judgment and later appeals before stating a definitive Karnataka position.

A practical request format

The following structure can be adapted to the facts and filing rules of the individual case:

Subject: Request to cross-examine witness whose statement is relied upon in the show-cause notice
  1. Identify the proceeding, notice date, tax period, and adjudicating authority.
  2. Name the witness and identify the statement or paragraph relied upon.
  3. State the precise factual assertions disputed by the taxpayer.
  4. Explain why those assertions are material to the proposed demand, penalty, or other finding.
  5. List the subjects on which questioning is sought and the potential credibility or accuracy issues.
  6. Request that the authority decide the application before relying on the statement in the order.
  7. Request written reasons for any refusal and retain proof of filing.

Keep the application factual. A long accusation against the investigating team is less useful than a clear explanation of what the witness said, why it matters, and what a fair hearing requires.

A decision path for taxpayers

  1. Is there an adverse witness statement? If no, identify the other evidence and use the appropriate objection; cross-examination may not address the real problem.
  2. Is the statement relied upon? Check the show-cause notice, relied-upon documents, hearing minutes, and draft or final order.
  3. Can you identify a material factual dispute? Pinpoint the contradiction or credibility issue and explain its effect on liability.
  4. Has adjudication finished? If not, file the request immediately and preserve acknowledgment. If an order has issued, evaluate appeal or other remedies with advice specific to the jurisdiction.
  5. Was the request refused or ignored? Renew the objection, ask for reasons, and preserve the record so any later challenge can demonstrate both denial and prejudice.

The safest formulation is therefore qualified: a GST taxpayer can request cross-examination whenever the department seeks to use an adverse witness statement against the taxpayer, but the request is most compelling when the statement is identified, material, specifically disputed, and challenged in time. Courts have treated denial as a natural-justice problem in suitable cases, while the exact outcome remains fact- and jurisdiction-sensitive.
