In the United States, vaccine-injury claims generally follow one of two federal paths. The National Vaccine Injury Compensation Program (VICP) handles most routinely used, excise-taxed vaccines that meet its coverage rules. Claims involving COVID-19 vaccines and other covered public-health countermeasures go to the separate Countermeasures Injury Compensation Program (CICP). They are not interchangeable: VICP uses a petition in the U.S. Court of Federal Claims, while CICP uses an administrative Request for Benefits.
Both programs require specific proof, deadlines and eligibility conditions. A reaction that occurs after vaccination is not automatically compensable. The first practical step is identifying the vaccine or countermeasure, then checking the program’s current coverage, injury criteria and filing deadline.

HRSA describes VICP as “a no-fault alternative to the traditional legal system for resolving vaccine injury petitions.” No-fault means the petitioner does not have to prove that a manufacturer was negligent, but the petition still must satisfy the program’s legal, medical and timing requirements.

What vaccines VICP covers
VICP generally covers vaccines recommended by the Centers for Disease Control and Prevention for routine administration to children or pregnant women, subject to the program’s other conditions. The vaccine category must generally be subject to a federal excise tax and added to the program under applicable rules. Coverage is tied to the specific vaccine and formulation, not simply to the fact that a shot was given.

HRSA’s coverage categories include diphtheria, Haemophilus influenzae type b (Hib), hepatitis A and B, human papillomavirus, seasonal influenza, measles, mumps, meningococcal, pertussis, pneumococcal conjugate, polio, rotavirus, rubella, tetanus and varicella vaccines. The current coverage list must be checked for the exact product. HRSA identifies exceptions and distinctions, including non-seasonal influenza, pneumococcal polysaccharide and shingles vaccines, as well as differences among meningococcal formulations.
COVID-19 vaccines are directed to CICP, not VICP. A person who received both a VICP-covered seasonal flu vaccine and a CICP-covered countermeasure, such as the 2009 H1N1 vaccine, may be able to submit claims in either or both programs. That does not guarantee eligibility or payment in either program; the facts, product and alleged injury control.
How the Vaccine Injury Table affects a VICP claim
The Vaccine Injury Table lists specified injuries or conditions and the time window in which they must begin. If the claimed injury fits the Table’s definition and timing, causation is presumed unless another cause is established. The presumption can make the medical-causation issue different from an ordinary lawsuit, but it does not eliminate the need to prove vaccination, timing, severity and other requirements.
A petitioner can also allege significant aggravation of a pre-existing condition. For an injury not listed on the Table, HRSA says the petitioner generally must show that the vaccine caused the injury. Administration outside a product’s label or contrary to recommendations does not, by itself, bar a claim for an otherwise covered vaccine.
Who may file and where vaccination must occur
The vaccine recipient may file regardless of age or U.S. citizenship. A parent or legal guardian may file for a child or disabled adult, and an authorized estate representative may file after a death.

Ordinarily, the covered vaccine must have been administered in the United States or its territories. Exceptions can apply to certain U.S. government or military service abroad and to some people who return to the United States within six months when the manufacturer was located in the United States. Because these exceptions are fact-specific, preserve travel, employment and military records if vaccination occurred overseas.
VICP severity thresholds and deadlines
Before the merits of causation are reached, a VICP injury generally must have lasted more than six months after vaccination, resulted in inpatient hospitalization and surgical intervention, or resulted in death. These are filing thresholds, not a finding that compensation is owed.
Injury claims
The ordinary deadline is three years after the first symptom or manifestation of onset, or of significant aggravation, of the injury. The clock is tied to the first qualifying manifestation, not necessarily to the date a diagnosis was made.
Death claims
A death petition generally must be filed within two years of the death and within four years of the first symptom or manifestation of onset or significant aggravation of the injury from which the death resulted. Both timing requirements matter.
Later Vaccine Injury Table changes
When a Table revision newly enables or materially improves eligibility, a special two-year period can apply to injuries or deaths that occurred up to eight years before the revision. This is a narrow statutory rule, not a general extension.

Equitable tolling
HRSA says the court may apply equitable tolling in very limited circumstances. A late petitioner should not assume tolling will apply; seek advice promptly and treat the published deadlines as controlling.

How to file a VICP petition
- Identify the product and program. Confirm the exact vaccine formulation, administration date, location and whether it is on the current VICP coverage list. If it was a COVID-19 vaccine or another covered countermeasure, use CICP instructions instead.
- Check the Table and threshold. Compare the injury, onset window and any significant aggravation with the current Vaccine Injury Table. Also document the duration, hospitalization with surgery or death requirement.
- Assemble evidence. Collect vaccination records, lot or product information when available, contemporaneous symptoms, complete medical records, diagnostic reports, hospitalization and surgical records, employment and wage documentation, and records showing relevant pre-existing conditions.
- Prepare the legal petition. HRSA calls the petition a legal document. Follow the Office of Special Masters’ current submission instructions and forms; an attorney is not stated to be mandatory.
- File with the U.S. Court of Federal Claims. Submit the petition, cover sheet, medical records and other supporting documentation with the appropriate filing fee to the court. The court’s current mailing and electronic-filing directions control.
- Send HRSA a copy. After filing with the court, provide HRSA with a copy electronically through its Injury Compensation Programs website or by mail, following its current directions.
- Track the case. Keep proof of filing, a complete copy of every submission and updated contact information. Respond to requests for records or clarification within the stated time.
The court generally awards reasonable attorneys’ fees and other legal costs when a petition is reasonable and filed in good faith, even if compensation is not ultimately awarded. That rule does not make every expense recoverable and does not remove the need to satisfy filing requirements.
How VICP decisions are made
- HHS medical staff reviews whether the medical criteria are met and prepares a preliminary recommendation.
- The Department of Justice prepares a report containing the medical recommendation and legal analysis.
- A court-appointed special master decides whether compensation is appropriate, often after a hearing.
- If compensation is awarded, the special master determines the amount and type, and the court orders HHS to pay.
A special master’s decision may be appealed. Under statutory timing and election rules, a petitioner who rejects a decision or withdraws may be able to bring a civil action against the manufacturer or administrator. That option is not automatic; the applicable statute and deadlines govern.
What VICP may pay
HRSA’s December 29, 2025 presentation lists medical expenses, lost wages, reasonable attorneys’ fees, pain and suffering and a death benefit as possible categories. The presentation states up to $250,000 for pain and suffering and a $250,000 death benefit. Those figures describe statutory categories in that presentation, not guaranteed awards; current law, offsets, proof and case-specific findings determine payment. Awards are not generally capped as one combined total, but each category remains subject to legal restrictions.
How CICP handles COVID-19 and other countermeasure claims
CICP is an administrative program for eligible serious injuries or deaths resulting from administration or use of covered countermeasures. Countermeasures can include vaccines, medications, devices or other items used against a public-health emergency or security threat. COVID-19 vaccine claims belong here when the product and injury meet CICP rules.

Deadline and required proof
A CICP Request for Benefits Package generally must reach the program within one year after the countermeasure was received or used. Proof of administration or use is required. CICP also has a limited alternative deadline tied to an amendment to a Covered Countermeasure Injury Table; use the current CICP instructions to determine whether that rule applies.
What to submit
- Request for Benefits form.
- Health-information authorization forms, with a separate authorization for each treating provider.
- Proof that the countermeasure was administered or used.
- Medical records from relevant treatment, including records needed to document pre-existing history.
The claimant is responsible for obtaining and sending the records. HRSA says CICP does not obtain records directly or pay for them. Eligibility review starts only after a complete package is received.
How to deliver the package
CICP describes electronic and mail submission. Do not send a package or letter of intent by email or fax. Follow the current CICP filing page for the accepted electronic method, mailing address, forms and formatting requirements.

- Create a date line: vaccination or countermeasure use, first symptom, diagnosis, hospitalization, surgery, work absence and death, if applicable.
- Keep the product name, manufacturer, lot number and vaccination site when available.
- Request complete records rather than only billing summaries or selected pages.
- Separate records for the alleged injury from records showing prior medical conditions.
- Document unreimbursed expenses, insurance payments, disability benefits and lost income.
- Record every submission date and retain delivery confirmations.
- Check the current Table, forms and deadlines immediately before filing because HRSA updates program materials and states that its website reflects current HHS thinking but does not bind the Department or the public.
Common mistakes that can defeat or delay a claim
Using the wrong program
Submitting a COVID-19 vaccine claim as a VICP petition can waste time against a one-year CICP deadline. Identify the product first.

Coverage depends on the vaccine category, Table status or proof of causation, severity threshold and timing. Temporal association alone is not enough.

Missing the first-manifestation date
Waiting for a definitive diagnosis can create a deadline problem when earlier symptoms were the first manifestation. Preserve contemporaneous records and obtain case-specific legal guidance promptly.
Sending an incomplete CICP package
CICP will not begin eligibility review until required forms, authorizations, proof of use and medical records are complete. A provider authorization that omits one treating clinician can leave the package incomplete.
Expecting the program to gather records
For CICP, the claimant must obtain records and bears any retrieval cost. Build that task into the filing schedule.

A VICP petition is a legal document, and the Office of Special Masters provides detailed instructions, sample filings and an attorney-referral list. Professional advice is particularly important when the Table does not clearly fit, significant aggravation is alleged, vaccination occurred abroad, more than one program could apply, a deadline is close or a death claim involves multiple possible causes. An attorney is not stated to be required, but relying on an assumption that a deadline exception or tolling will apply is risky.
What to verify before submitting anything
Use the current HRSA VICP and CICP pages, the current Vaccine Injury Table, the U.S. Court of Federal Claims filing instructions and the applicable forms. Confirm the product’s coverage, the filing clock, accepted delivery method, fee, medical-record requirements and any statutory changes. Program information can change, and only the court or program reviewing the specific facts can determine eligibility.
