The safest way to evaluate senior housing is to obtain the current contract and an itemized fee schedule before paying a deposit or signing. Mark what the base fee includes, every service billed separately, how care-level charges are calculated, when rates can change, what happens if the resident moves or leaves, and whether a family member is accepting personal payment responsibility.

There is no single national senior-housing contract. Assisted-living communities, nursing homes, and continuing care retirement communities (CCRCs) can use very different agreements. The contract—not the marketing rate—controls the resident’s financial and care obligations. The National Institute on Aging advises consumers to get detailed cost and service information and, “Once you select a facility, read the contract carefully.” Read the NIA guidance before making a decision.

Start by identifying what kind of housing agreement you are reviewing

“Senior housing” can describe settings with different services, payment models, and legal protections. First identify the setting named in the agreement and the level of care it is licensed to provide.

Assisted living

Assisted living generally helps with personal and everyday activities, such as bathing, dressing, meals, medication reminders, and housekeeping. The contract may use a base room-and-board fee plus charges tied to a care assessment. Ask whether the community can continue serving a resident whose needs increase, or whether a transfer to another unit or provider would be required.

Nursing homes

Nursing homes provide around-the-clock nursing and support. A nursing-home agreement may address skilled nursing, rehabilitation, room type, supplies, medications, and payment from Medicare, Medicaid, private insurance, or personal funds. Certain federal admission and payment rules apply to nursing facilities that participate in Medicare or Medicaid; they do not automatically govern every assisted-living or other housing contract.

Continuing care retirement communities (CCRCs)

CCRCs offer a campus or system with progressively higher levels of assistance. Their agreements commonly combine a one-time entrance fee with a recurring monthly fee. The entrance-fee refund formula, financial condition of the provider, and rules for moving between care levels deserve especially close review. The Administration for Community Living describes the general two-part structure and explains why refundability can matter for Medicaid. See the ACL CCRC overview (page last modified February 18, 2020; verify current state requirements).

Request the complete documents before you compare prices

Ask for the current version of every document you would sign, not just a brochure or a one-page rate sheet. Request amendments, resident handbooks, care-level definitions, and any addendum referenced by the contract. Keep a dated copy of what the facility provided.

  • Request an itemized fee schedule showing the base charge, mandatory fees, optional services, deposits, and taxes or other pass-through amounts.
  • Ask the facility to identify which services are included in the base fee, which are billed per use, and which trigger a recurring care-level charge.
  • Ask how a nurse or care team assesses needs, when reassessments occur, and how an assessment changes the bill.
  • Have every verbal explanation of an unclear clause put in writing and attached to the agreement.
  • Check that the legal name of the provider, room or unit, effective date, renewal terms, and notice addresses are correct.

Use the fee schedule to find the real monthly cost

A headline monthly rate is not a reliable comparison unless the same services and assumptions are included. Build a personal estimate for the resident’s likely first-year costs and for a higher-care scenario.

Charge category What the agreement should state Questions to ask
Base housing fee Room type, meals, utilities, housekeeping, maintenance, activities, transportation, and other included items Which items are limited, optional, or subject to usage caps?
Care or service levels Assessment method, level definitions, unit prices or recurring charges, and reassessment process What exact event moves the resident to a higher level, and when does the new charge start?
One-time charges Application, community, admission, setup, move-in, or administrative fees and whether they are refundable When is each amount due, and what happens if admission is canceled?
Consumables and outside services Medication management, incontinence supplies, salon services, guest meals, transportation, therapy, or privately hired aides Are charges per visit, per item, or monthly? May the resident use an outside provider?
Deposits and reserves Security, holding, meal, or care deposits; permitted deductions; and return deadline Who holds the money, and what written accounting will be provided?
Late and collection charges Due date, grace period, interest, returned-payment fee, and collection process Can a disputed charge be withheld while it is investigated?

Ask for an example invoice using the resident’s expected services. Then request a second example showing a higher care level. This exposes charges that are easy to miss in a list of unit prices.

Separate included services from add-on care

Read definitions rather than relying on labels such as “all-inclusive.” A contract may include meals and basic housekeeping but charge separately for medication administration, transfers, toileting, escorting, two-person assistance, or incontinence care. It may also use a bundled care level that changes after an assessment.

Questions about care assessments

  • Who performs the assessment, what tasks are observed, and is the resident or family allowed to review the assessment?
  • How often is the resident reassessed, and can a family member request an earlier review after a health change?
  • Is there a written appeal or dispute process for a new care charge?
  • Does the agreement require payment for a higher level while the resident is temporarily hospitalized or away?
  • Are hospice, home-health, therapy, or private-duty aides allowed, and who pays them?

Match the promise to the staffing plan

Ask which services are available overnight, on weekends, and during emergencies. Request the community’s staffing description for the unit where the resident would live, including who administers medications and who responds to falls. Compare the available care with both present needs and reasonably foreseeable changes; a low initial fee can be costly if the contract requires an unexpected move when needs increase.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Find out exactly how rates can change

National guidance does not establish a universal percentage cap or timetable for senior-housing increases. Treat the contract’s rate-change clause as a negotiable risk to understand, not as a standard industry term.

  • Look for the notice period, delivery method, and effective date for a base-fee or care-fee increase.
  • Determine whether increases can occur once a year, at renewal, after reassessment, or whenever the provider says costs have changed.
  • Ask whether a change applies to all residents or only to a particular room, service, or care level.
  • Check whether the resident may terminate without a penalty after receiving a substantial increase.
  • Ask for the provider’s policy when a resident cannot afford the new amount and whether a payment plan or lower-cost option exists.

Do not rely on a staff member’s statement that increases are “usually small.” Ask the facility to identify the controlling paragraph and provide any current schedule of rates in writing.

For a CCRC, analyze the entrance fee and refund formula

CCRC entrance fees can be a major part of the financial commitment. The ACL explains that CCRC arrangements generally include an entrance fee and a monthly fee, while refundability varies by contract. A contract may provide no refund, a declining refund, a fixed percentage, or a refund only after a replacement resident is admitted. Those are examples of possible structures, not universal terms.

Questions that must be answered in the agreement

  • Is the entrance fee refundable, and is the refund calculated from the original amount or another base?
  • Does the refund decline over time, and on what exact schedule?
  • When does the refund clock start: signing, occupancy, or another date?
  • What deductions are allowed for damage, unpaid fees, taxes, or other expenses?
  • Is payment made after termination, after death, after the unit is resold, or on another timetable?
  • Who receives the refund if the resident dies, and what probate or beneficiary documents are required?

The ACL also cautions that a refundable entrance fee may count as an available asset for Medicaid even when the resident cannot currently access the money. Ask a benefits specialist or elder-law attorney to evaluate the resident’s state-specific Medicaid rules before treating the fee as unavailable.

Read transfer, discharge, and termination provisions closely

Find the clauses that govern a move to assisted living, a nursing unit, a hospital, or another provider. The agreement should explain who makes the decision, what notice is required, whether the resident can challenge it, and how the charges change during a transfer.

  • Identify clinical, behavioral, payment, or safety conditions that permit a transfer or discharge.
  • Check whether the provider must offer another unit or help locate another setting.
  • Find the notice period for the resident’s voluntary departure and the provider’s termination of the agreement.
  • Ask how prepaid rent, deposits, entrance fees, and unused services are reconciled at move-out.
  • Look for termination fees, cleaning charges, required notice, and the deadline for returning belongings or keys.

Ask the facility to describe a realistic scenario—for example, a resident needs two-person transfers or can no longer pay—and show which contract paragraph applies. State law and licensing rules may add protections, so local review is important.

Check who is signing and whether anyone is personally liable

If a family member signs for another person, read every signature block and guarantee clause. The document should distinguish between signing as the resident’s authorized representative and promising to pay personally.

For a nursing facility participating in Medicare or Medicaid, the Consumer Financial Protection Bureau states that “a nursing facility may not condition a resident’s admission or continued stay on receiving a guarantee of payment from a third party, such as a relative or friend.” Read CFPB Circular 2022-05. A representative who has lawful access to the resident’s resources may be asked to arrange payment from those resources without becoming personally liable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

This federal rule is limited to qualifying nursing facilities and does not automatically apply to assisted living, independent living, or every CCRC agreement. State laws and the precise wording of the contract matter. Do not sign a clause labeled “guarantor,” “responsible party,” or “jointly and severally liable” until a qualified local adviser explains its effect.

Identify likely payment sources and out-of-pocket exposure

Ask the provider which payment sources it accepts and which services each source may cover. The NIA and CFPB recommend discussing affordability and checking whether Medicare, Medicaid, or long-term-care insurance may pay for particular costs. Coverage depends on the service, eligibility, state, and setting; never assume that a benefit covers the entire monthly bill.

  • Ask the insurer or plan for a written coverage determination for the specific service and facility.
  • For Medicaid, ask how income, assets, a refundable CCRC entrance fee, and state eligibility rules affect qualification.
  • For Medicare, distinguish covered skilled services from room, board, custodial care, and noncovered extras.
  • Calculate the resident’s monthly shortfall after benefits, pension, Social Security, and other reliable income.
  • Ask what happens if funds run out and whether the provider has a written policy for continued care.

Compare communities with the same worksheet

Use the same questions and assumptions for every facility. The official sources support comparing costs, services, and agreement terms, but they do not establish a national rating or standardized fee schedule.

Comparison point Record for each community
Price structure Base monthly fee, one-time entrance or admission fee, deposits, and estimated first-year total
Included services Meals, utilities, housekeeping, transportation, activities, emergency response, and maintenance
Add-on exposure Care levels, medication help, supplies, therapy, private aides, and per-use charges
Rate changes Notice, frequency, trigger, maximum if stated, and termination rights
Refunds and deductions Entrance-fee formula, deposit accounting, timing, and conditions
Transfer and exit Move criteria, discharge notice, appeal process, termination fees, and refunds
Care fit Current and anticipated needs, staffing coverage, overnight response, and outside-provider rules
Signer obligations Representative-only language versus personal guarantee or joint liability
Payment risk Accepted programs, likely monthly shortfall, and policy if funds are exhausted

Visit each community, meet staff, and ask to see the actual unit and care area. CFPB guidance encourages visiting facilities, learning about services and costs, and discussing affordability and safety with professionals.

Red flags that require clarification before signing

  • A fee schedule says “subject to change” without a notice period or explanation of the trigger.
  • Care-level charges are described by marketing names but have no measurable tasks or assessment criteria.
  • A representative is told to sign a personal guarantee or give unrestricted access to personal assets.
  • An entrance-fee refund depends on resale, but the contract gives no timing, accounting, or provider obligation.
  • The agreement permits discharge for broad reasons without notice, a transition plan, or a way to contest the decision.
  • Staff will explain important terms verbally but will not provide the explanation in writing.
  • The provider presents an old contract, an unsigned addendum, or a fee sheet that does not match the signature packet.

Pause the transaction when a material term is unclear. Mark the paragraph, write the question, and request a dated written answer. Keep both the question and response with the contract.

A practical contract-review process

  1. Collect the packet. Obtain the contract, fee schedule, care-level chart, refund policy, resident handbook, and all addenda.
  2. Build two budgets. Calculate the expected monthly bill now and after a plausible increase in care needs, including one-time and occasional charges.
  3. Mark obligations. Highlight every payment date, deposit, rate-change clause, refund condition, transfer rule, discharge term, and signature obligation.
  4. Test scenarios. Ask the provider to price hospitalization, temporary absence, higher care, outside therapy, nonpayment, and voluntary move-out.
  5. Verify benefits. Confirm coverage and eligibility with the relevant insurer, Medicaid agency, Medicare source, or long-term-care insurer.
  6. Review authority. Confirm that the signer has the required power of attorney or other legal authority and is not accepting unintended personal liability.
  7. Get local advice. Use the Area Agency on Aging or Eldercare Locator, legal aid, a state nursing-home survey agency, or an elder-law attorney when state law or contract language is uncertain.
  8. Sign only the final version. Make sure all promised changes are written into the agreement or a signed addendum, then retain a complete copy.

Local aging-services and legal professionals can interpret state-specific admission, discharge, Medicaid, and landlord-tenant rules that national guidance cannot resolve. CFPB identifies legal services and state nursing-home survey agencies as potential sources of help for nursing-home admissions concerns.
