Before uploading brain-signal data to an AI service, find out exactly what it will receive, why it needs it, how long it will keep it, whether it can reuse or share it, and what protections and deletion options apply. Raw recordings, processed features, and AI-generated inferences are different kinds of information, but each may be sensitive. The risk depends on the signal and processing, the purpose, the service’s terms and controls, and the laws that apply to you.

What counts as brain-signal data?

Brain-signal data is information recorded from or about brain activity. It may come from a brain-computer interface (BCI) or another measurement method. EEG is one example, but the term is broader: non-invasive BCI technologies also include MEG, fNIRS, and fMRI. An AI service does not automatically receive this kind of information just because it uses AI; it must be given the recording or information derived from it.

It helps to distinguish three layers of information before you decide what to share:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Raw recordings: the measured signal itself, potentially accompanied by timestamps, device identifiers, or other metadata.
  • Processed features: data extracted or transformed from a recording for a particular analysis. A service may ask for these instead of the full recording, but you should verify what they contain and whether they can be linked to you.
  • AI-generated outputs or inferences: conclusions produced from the recording or features. OECD identifies concern that AI may decode neural signals into sensitive inferences about emotions, intentions, and cognitive patterns.

These layers are not interchangeable. A feature set is not necessarily anonymous just because it is not a waveform, and an output is not automatically harmless because it is generated rather than directly recorded. Treat derived information as potentially sensitive, while recognizing that its legal classification may be uncertain and depends on the relevant jurisdiction and context.

Can an AI infer more than I meant to share?

Possibly, depending on the signal, the processing performed, and the task. An upload intended for one analysis could also be used to generate or examine other outputs if the service’s capabilities and terms permit it. OECD’s discussion highlights the prospect of inferences about emotions, intentions, or cognitive patterns; it does not establish that every recording reveals those things, or that a particular service can reliably infer them.

Do not treat a provider’s description of its immediate feature or task as the whole answer. Ask whether the service creates additional outputs, whether those outputs are stored or associated with your account, and whether they can be used for other purposes. Also consider context: an inference that seems low-stakes in a personal experiment could be more consequential if used in employment, education, insurance, health, or another decision-making setting. OECD reports regulatory concern about discriminatory or opaque uses in some such contexts. That concern is not proof that a given service has used one person’s data in that way.

Will the AI service keep or train on my neural data?

You cannot infer retention or training practices from the fact that a service accepts an upload. Check the provider’s terms and privacy information for the exact data covered, the purposes allowed, whether model training or product improvement is included, and whether those uses are optional or required. Look for separate rules for inputs, derived features, outputs, and account or device metadata; one category’s policy may not answer for the others.

Also look for a retention period or deletion process, and determine whether deletion applies to the original upload, derived material, and copies held by other parties. Ask what categories of recipients may receive data, including subprocessors or researchers, and whether the provider identifies them. If the terms do not answer a question clearly, do not assume the most privacy-protective interpretation. The OECD identifies meaningful consent, purpose limitation, secondary use, minimisation, and the treatment of inferred data as recurring governance concerns.

Use this checklist before uploading

Apply these questions to the specific service and task. They are checks to make, not assumptions about any provider.

  1. Identify the payload. What exact information is uploaded: a raw EEG or other signal, timestamps, device identifiers, notes, or derived features? Does the service need every item?
  2. Confirm the purpose. What does the provider say it will do with the data? Can it also use it for model training, product improvement, advertising, profiling, or another secondary purpose? Is consent for those uses separate?
  3. Check retention and control. How long is the upload kept? Can you delete it or request access to it? Does the stated process cover derived information and any copies held by other parties?
  4. Check disclosure. Is information shared with subprocessors, researchers, or other third parties? Which categories of recipients are disclosed, and for what purposes?
  5. Ask about protection and access. What safeguards protect the information in transit and in storage? Who is allowed to access it? The service’s description should answer these questions in terms you can evaluate.
  6. Reduce what you send. Can the task be completed with a smaller excerpt, fewer channels, less identifying metadata, or processed features rather than a full recording? Confirm that the smaller dataset still suits the intended analysis.
  7. Consider your role. If you are a patient, research participant, employee, student, or minor, check whether additional consent, institutional rules, or a power imbalance affects your choice. An apparent choice to upload may not feel equally voluntary in every setting.
  8. Decide whether the answer is good enough. If purpose, retention, reuse, recipients, or access controls remain unclear, pause before sharing. You can ask the provider or the organization that directed you to use the service for specific answers.

This checklist applies OECD’s discussion of consent, purpose limitation, data minimisation, derived data, and privacy-enhancing approaches. It cannot determine whether a particular provider’s terms are adequate or what law applies to your circumstances.

Privacy and security are related, but not the same

Privacy concerns what information is collected, why it is collected, how long it is retained, what can be inferred, whether it is reused, and with whom it is disclosed. Security concerns protection against unauthorized access and the safeguards used during transfer and storage. A service can address one set of questions without resolving the other: for example, a security measure does not tell you whether the provider may use an upload for model training.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For connected BCI systems, security issues can extend beyond the confidentiality of stored information. The U.S. Government Accountability Office (GAO) has discussed possible interference with device function as a BCI risk. That concern is relevant to systems with a device-control connection; it should not be generalized to an ordinary upload that has no connection to device control. When assessing a connected system, ask what functions are connected and what protections apply to them, separately from questions about the provider’s data practices.

What privacy law applies?

There is no single rule that determines how every brain recording or neural inference is classified. OECD reports that data-protection laws do not have a clear, broadly accepted definition of brain or neurodata. Authorities debate whether different signals and inferences should be treated as health, biometric, sensitive, or other personal data. Classification can turn on jurisdiction, signal type, identifiability, context, and use; do not assume that all neural data automatically receives the same legal protections.

For a U.S. example, the Colorado Attorney General’s overview says the Colorado Privacy Act gives covered Colorado consumers rights that include access, deletion, and correction, and requires affirmative consent before covered controllers process sensitive data. The overview includes certain personal data revealing health conditions and biometric data used for identification. It does not name neural data as a distinct category, so it is not a basis for saying that every brain recording is automatically covered as sensitive data. Whether the Act applies depends on its coverage rules and the facts.

GAO’s technology assessment, published December 17, 2024, says there is no unified privacy framework for all BCIs and describes uncertainty around ownership and control. It identifies policy options rather than claiming that those options are universal legal requirements. If the decision has legal, employment, research, or health consequences, check the rules and agreements that apply in your jurisdiction and setting rather than relying on a general description of neurodata law.

What technical measures can reduce risk?

Where available, prefer a design that sends less information to fewer places. OECD identifies several approaches that can mitigate some risks while retaining data utility. None is a guarantee that a particular service is safe, and a provider should be able to explain which measures it actually uses and for what purpose.

  • On-device processing: the analysis may be performed locally rather than sending the recording to a remote service. Ask what information, if any, still leaves the device.
  • Federated learning: a possible approach for training models without collecting all training data in one central location. Its use does not by itself answer whether other information is transferred or retained.
  • Differential privacy: a technique intended to limit what can be learned about individuals from certain outputs or analyses. Ask how it is applied to the task at hand; the label alone is not evidence of a specific level of protection.
  • Controlled-access research environments: access may be limited to approved users or a defined research setting. Check who qualifies for access, what uses are allowed, and what happens to data afterward.

Data minimisation is a practical companion to these measures: share only what the task needs, including less identifying metadata where possible. A headset or electrode set may collect a signal, but it does not determine what an AI provider does with an upload after it is sent.

How to compare services without relying on a privacy label

If you have more than one option, compare the actual terms and controls for the intended use rather than relying on a general claim such as “secure” or “private.” Record the answer to each question for each service, using “not stated” when the available terms do not provide an answer.

What to compare Question to resolve
Data collected Does the service receive raw signals, processed features, timestamps, device identifiers, notes, or some combination?
Purpose and secondary use Is use limited to the task you requested, or do the terms allow training, product improvement, advertising, profiling, or other uses?
Retention and deletion How long are uploads and derived information kept, and what can you delete or request access to?
Third-party disclosure Do the terms identify categories of recipients, such as subprocessors or researchers, and explain their roles?
Security and access What protections are described for transfer and storage, and who can access the information?
Available rights What access, correction, deletion, or other privacy rights are described for your situation?
Processing location Can the task run locally or in a controlled environment, and what information would still be sent elsewhere?

This comparison is about documented practices, not a vendor ranking. No particular AI service is established here as safer or more private than another; the relevant answer depends on the service’s current terms, controls, and your use case.

What BCI standards do—and do not—tell you

Two ISO/IEC documents have different statuses and purposes. A draft focused on BCI privacy is not a published standard, while a published specification for data formats does not certify a service’s privacy or security. Their scopes should not be conflated.

Document Status and scope What it does not establish
ISO/IEC WD 27505.2, Privacy in brain computer interface (BCI) applications Under development as a working draft. The ISO catalog describes BCI-specific privacy requirements and guidelines based on ISO/IEC 29100 and ISO/IEC 27701 principles. It is not a published standard or proof that a provider meets privacy requirements.
ISO/IEC TS 27571:2026, Data format for noninvasive brain information collection Published in April 2026. Its scope includes basic data elements, technology-specific information, metadata, extensible structure, annotations, and naming conventions for non-invasive technologies including EEG, MEG, fNIRS, and fMRI. It specifies data formats; it is not a privacy or security certification.

ISO/IEC’s abstract for TS 27571:2026 says the document specifies a basic BCI data format, including basic data elements, technology-specific information and metadata, an extensible modular structure, annotations, and a standardized naming convention. That is a data-organization role, not a finding about how any provider collects, retains, or protects uploads.

When should you hold off?

Pause if you cannot determine what data will be sent, what the provider may do with it beyond the immediate task, how long it will remain, who may receive it, or whether you can delete it. The same is true if you are being asked to share data in a setting where consent may be affected by your role and the organization has not explained the relevant protections. Ask for clearer terms or a less data-intensive way to complete the task before uploading.
