If a gold-, oil-, or other commodity-linked token will not redeem, first determine exactly what you bought, which legal entity owes performance, and which redemption route you used. A ticker, wallet balance, reserve statement, or secondary-market price does not by itself prove a right to physical delivery. Compare your request with the issuer’s current and historical terms, preserve every record, demand a written explanation through a verified channel, then use the complaint, regulator, dispute, or court routes identified in the token’s disclosures. If the facts suggest fraud or theft, report them to official authorities and ignore anyone promising recovery for an upfront fee.

Start by identifying the obligation

A token’s brand name, ticker, blockchain, reserve custodian, redemption agent, and issuing legal entity may all be different. The entity that marketed the token may not be the entity contractually required to accept it. An exchange may have held your account balance without giving you a direct redemption relationship with the issuer.

Collect the documents that define your rights

  • The exact token name, ticker, network and contract address.
  • The issuer’s full legal name, registered address and any redemption agent or custodian.
  • The current white paper or equivalent disclosure, plus the version in force when you submitted the request.
  • Redemption rules, fees, terms of service, complaint procedure and insolvency language.
  • The governing law and named court or dispute-resolution body.

For an asset-referenced token covered by the EU Markets in Crypto-Assets Regulation (MiCA), the white-paper disclosure list includes redemption mechanics, complaint contacts, dispute and redress procedures, insolvency treatment, applicable law and the competent court. That disclosure requirement does not establish that an unidentified token or issuer is within MiCA’s scope.

Check whether your request met the redemption conditions

Read the policy that applied on the date of your request, not only a later webpage. Make a side-by-side record of each requirement and what you submitted.

Eligibility and onboarding

  • Was redemption limited to customers verified directly by the issuer?
  • Had identity, sanctions and source-of-funds checks been completed?
  • Did you submit through the issuer’s required portal or email rather than an exchange’s support channel?

Quantity and delivery form

  • What minimum balance applies to physical delivery?
  • Does the policy offer delivery, cash value, or sale proceeds as separate routes?
  • Are specific bar sizes, product forms, countries or collection arrangements required?

Money, valuation and timing

  • Which fees apply, including fabrication, shipping, insurance, storage or wire charges?
  • What valuation point or pricing source determines cash proceeds?
  • What processing, settlement and delivery windows were published?
  • Was there a documented pause, exceptional event or orderly-redemption process?

MiCA Article 39 says a covered asset-referenced token’s redemption policy should set out thresholds, periods and timeframes, mechanisms, valuation principles and settlement conditions. Use those categories as a practical checklist only after confirming that the instrument and issuer are covered.

Why one token may not buy one physical unit

Physical delivery can require a whole commodity unit rather than the token’s notional fraction. A 2023 Federal Reserve research paper described a Tether Gold (XAUt) example in which physical redemption required a full gold bar of 385–415 fine troy ounces; one token did not entitle the holder to one troy ounce delivered. This is a historical illustration, not a current statement of that issuer’s terms and not a rule for other tokens.

Compare the available routes before choosing one

If the issuer offers more than one path, record the practical differences rather than assuming delivery is the only remedy.

Issue Physical delivery Cash redemption or sale proceeds
Minimum May require a whole bar, lot or other large threshold May allow a smaller balance, subject to the policy
Verification Usually requires completed identity and delivery checks May require the same onboarding or additional banking checks
Fees Potential fabrication, shipping, insurance, storage and handling charges Redemption, spread, wire or other published charges
Timing Processing plus transport and delivery scheduling Processing and settlement to the stated payment method
Valuation Commodity form and availability control what is delivered Uses the policy’s stated valuation point and pricing method
Geography May exclude your country or require an approved collection point May be restricted by banking, sanctions or residence rules

The issuer’s current contract controls. A market discount, reserve attestation or account balance cannot substitute for the threshold and settlement terms.

Build an evidence file before contacting support

Preserve originals and work from copies. Write a chronological log while events are fresh.

  • Wallet addresses, account identifiers and the token contract address.
  • Transaction hashes, blockchain network, token amount, date and time.
  • The date, channel and content of each redemption submission.
  • Completed forms, confirmation pages, support-ticket numbers and email headers.
  • Screenshots or downloaded PDFs of the applicable terms, fee schedule and status messages.
  • Bank, shipping or identity-verification records relevant to settlement.

The FBI Internet Crime Complaint Center (IC3) asks for transaction details such as addresses, type and amount, date and time, and transaction ID or hash. Keeping the same fields now makes a later complaint more coherent.

Send a precise written complaint

Use contact information taken from the issuer’s verified website or disclosure. Do not rely on an address supplied in an unsolicited direct message. State the facts without alleging insolvency or fraud unless you have evidence.

  1. Identify the token, quantity, wallet or customer account and the legal entity you believe owes performance.
  2. Give the submission date, requested form (physical delivery or cash), destination and any case number.
  3. Attach copies of the confirmation and relevant policy page; retain originals.
  4. Ask for the exact policy provision applied, every missing requirement, the valuation used and the expected completion date.
  5. Request a written response and a new case number if the existing ticket is closed.

Ask the issuer to explain whether the problem is eligibility, quantity, geography, verification, fees, valuation, settlement or a temporary operational pause. A refusal that names no contractual basis is easier to escalate than an answer that identifies a genuine unmet condition.

Escalate through the route named in the disclosures

MiCA-covered asset-referenced tokens

MiCA Article 39 states: “Holders of asset-referenced tokens shall have a right of redemption at all times against the issuers of the asset-referenced tokens, and in respect of the reserve assets when issuers are not able to meet their obligations as referred to in Chapter 6 of this Title.” The rule applies to covered asset-referenced tokens, not automatically to every commodity-linked token, wrapped claim or security.

If a covered issuer cannot meet its obligations, MiCA Article 47 provides for an orderly redemption plan after a competent-authority determination that the issuer is unable or likely unable to meet those obligations. The relevant authority, complaint route and court depend on the issuer’s authorization and your circumstances. Confirm applicability with the token’s disclosures and the competent authority rather than assuming an EU rule applies because you reside in Europe.

Other jurisdictions and contractual forums

Follow the complaint, ombuds, arbitration, consumer-protection and court process named in the governing documents. A regulator may supervise conduct without adjudicating your individual contract claim. An exchange’s internal complaint route may also be necessary when the exchange, rather than the issuer, rejected the request.

Report suspected fraud through official channels

A delayed redemption can be an operational or contractual dispute; it can also occur alongside impersonation, theft or a fake token. Consider an official report when you see fabricated reserves, altered websites, unauthorized transfers, a vanished issuer, demands to pay a “release” charge, or instructions to send assets to a new wallet.

United States-connected cases

For suspected cryptocurrency crime with a US connection, IC3 accepts complaints and requests transaction and subject information. Its submission process says reports may be analyzed and referred for possible investigation; filing does not promise contact, investigation or reimbursement. The Consumer Financial Protection Bureau’s general fraud guidance identifies the FBI, Federal Trade Commission, state attorney general and local police as possible reporting channels. Use independently located agency websites and telephone numbers.

Historical CFPB complaint data recorded more than 8,300 crypto-asset complaints submitted from October 2018 through September 2022, with 40% categorized as fraud or scams. Those figures are not a tokenized-commodity redemption count and are not a current prevalence estimate.

Do not turn a failed redemption into a second loss

Recovery fraud targets people who have already lost money. The FBI warns: “Private sector recovery companies cannot issue seizure orders to recover cryptocurrency.” It also says, “Be wary of anyone claiming they can recover your funds as this may be another scam.”

  • Do not pay an unsolicited helper an upfront fee, crypto deposit, tax, bond or “release” charge.
  • Do not share seed phrases, private keys, one-time codes or remote-access credentials.
  • Do not assume a person using an agency logo or a case number is an official.
  • Verify alleged affiliations through contact details you locate independently.
  • Preserve the scammer’s messages and wallet addresses for your official report.

Private tracing or legal services cannot compel an issuer, issue a seizure order or guarantee recovery. Treat any promised result as unverified until an independently checked authority confirms it.

When independent legal advice is worthwhile

Consider a lawyer qualified in the relevant jurisdiction when the amount is material, the issuer appears insolvent or is winding down, several entities are involved, the governing law is unclear, or the token’s legal classification affects your remedy. Look for demonstrated experience in commodities, insolvency or digital-asset disputes and verify independence, jurisdictional fit, fees and scope. A lawyer can preserve limitation periods and assess whether a contractual, insolvency, regulatory or property claim is plausible; no adviser can promise that the asset will be recovered.

A practical escalation checklist

  1. Identify the exact token, issuer, custodian, redemption agent and channel used.
  2. Save the applicable policy version and list every threshold, fee, verification, geography and deadline.
  3. Reconcile your wallet or account records with the requested amount and transaction hash.
  4. Submit a written complaint asking for the precise contractual reason and completion date.
  5. Escalate through the disclosed ombuds, regulator, dispute body or court.
  6. Report credible fraud or theft to the appropriate official channel.
  7. Ignore recovery offers that require money, credentials or a transfer to an unknown wallet.
  8. Obtain qualified legal advice if the value, insolvency risk or cross-border complexity justifies it.

Frequently Asked Questions

Does a token balance prove that I can demand physical delivery?

No. Delivery may require a minimum lot, direct onboarding, an eligible destination, additional fees and a specific settlement procedure. The token’s governing terms determine whether and how delivery is available.

Is a falling market price evidence that the issuer is insolvent?

No. A secondary-market discount can reflect liquidity, fees, market conditions or uncertainty. It does not by itself prove insolvency, fraud or a right to physical delivery.

Will filing an IC3 complaint guarantee repayment?

No. IC3 says submissions may be analyzed and referred for possible investigation; reporting does not guarantee contact, investigation or reimbursement.
