A layoff announcement is not the same as an individual notice. In the first hours, establish whether your role is affected, preserve only information you are authorized to keep, and obtain written details about timing, severance, benefits, equity and access. Then meet the deadlines for health coverage and unemployment while using official transition services and protecting confidential company data.
First, separate confirmed facts from rumors
Read the official announcement or attend the named briefing, but do not assume it answers your personal situation. A company may announce affected functions or a head-count target before speaking with each employee. Save the announcement in an authorized personal record only if company policy permits; do not forward confidential lists, dashboards, customer information, source code or credentials.
Use the channel identified by HR or your manager for questions. Treat social-media posts, anonymous messages and hallway speculation as unconfirmed. Write down what is known, what is unknown and the date of the next promised update.
Questions to ask immediately
- Is my role or employment status affected?
- When will individual meetings occur, and who will conduct them?
- Where will the written FAQ and benefits documents be posted?
- What are the effective date and last working day, if my role is selected?
- Who is the HR contact for severance, equity, benefits and immigration or accommodation questions?
Do not try to infer selection criteria from a team chart or a manager’s wording. Individual selection, medical information, immigration details and performance claims belong in a private HR process.

Your first-hour and same-day checklist
In the first hour
- Read the complete announcement and note the stated scope, timing and next communication.
- Ask your manager or HR whether your position is affected and when you will receive individual written notice.
- From memory or approved records, list your title, projects, measurable outcomes, technologies, certifications and employment dates. Do not copy proprietary artifacts to a personal account.
- Confirm whether any meeting is mandatory and whether you may bring a representative where local policy or law allows.
- Keep communication factual and private. Do not speculate about colleagues or repeat unverified names.
Before the day ends
Request a written summary covering each item below. If a point is not yet decided, ask when it will be decided rather than relying on a verbal promise.
| Area | What to confirm |
|---|---|
| Employment | Selection status, notice period, last day, paid notice or garden leave, and whether work duties change immediately |
| Severance | Amount, payment date, continuation of salary or benefits, eligibility conditions, release, confidentiality, non-disparagement and any rescission period |
| Equity and bonus | Vesting through the last day, treatment of unvested awards, exercise window for options, bonus eligibility and governing plan documents |
| Paid time off and retirement | PTO payout rules, 401(k) or other plan treatment, rollover choices and outstanding expense reimbursement |
| Health and welfare | Plan end date, dependents’ coverage, COBRA or other continuation notice, life and disability conversion rights, prescriptions and claims contacts |
| Access and equipment | When VPN, repositories, cloud consoles, email, badges and devices change; approved personal-file retrieval; return shipping or handoff instructions |
| Support | Outplacement, employee-assistance services, references, neutral employment verification and the HR contact for follow-up |
Ask for copies of the severance agreement, equity plan, benefits summary and any release before signing. Keep them with your personal records only as permitted by policy and law.
Expect technology access to change quickly
Offboarding commonly involves termination of access to systems, networks and accounts. The Cybersecurity and Infrastructure Security Agency’s offboarding control example reflects this practice. Credentials, VPN, source repositories, cloud consoles, production tools, ticketing systems and devices may be disabled before or at the start of an individual meeting.
Assume you may lose access without time to retrieve personal material. Before access changes, ask IT for an approved method to collect personal files and contacts. Do not email work files to yourself, clone proprietary repositories, export customer data, photograph dashboards or retain passwords, keys or tokens. Those actions can violate policy, confidentiality obligations and security controls even if you created the material.
What you may safely preserve
- A personal list of accomplishments, dates, technologies and outcomes written from memory or from records you are expressly allowed to use.
- Public links to launches, conference talks, patents or documentation that contain no confidential information.
- Personal contact details you already possess lawfully, collected individually and without exporting a company directory.
- Your employment documents, pay records and benefits notices, subject to company policy and applicable law.
Ask how to return laptops, security keys, badges and other equipment. Obtain a receipt or shipping confirmation. If a device contains personal material, request the company’s documented process; do not reset, wipe or copy it yourself.
Health insurance, equity and income deadlines
Health coverage and COBRA
USAGov explains that COBRA generally applies to most private-sector employers with 20 or more employees when a qualifying event occurs, including termination or reduced hours. For those events, continuation coverage can last 18 months. The plan’s election notice generally gives you 60 days to elect coverage. The exact premium, administrative fee, coverage end date and dependent rules come from your plan documents.
Compare COBRA with a Marketplace plan, Medicaid, CHIP, Medicare or coverage through a spouse or domestic partner. Compare the monthly premium, deductible, out-of-pocket maximum, provider network, prescription continuity and the election deadline. A cheaper premium can expose your household to a higher deductible or disrupt treatment, so check doctors and medications before choosing.

Equity, bonuses and deferred compensation
Equity treatment depends on the award and plan documents. Confirm whether vesting stops on the termination date, whether any acceleration applies, how restricted stock or units are settled, and how long you have to exercise options after departure. Ask whether a bonus requires employment on the payment date and whether severance changes that rule. Do not rely on a manager’s estimate when the plan administrator can provide the governing terms.
Unemployment insurance
There is no single federal unemployment program. USAGov’s 2025 guidance states that each state administers its own system, with different eligibility tests and filing procedures. File with the appropriate state office as soon as you are eligible; waiting for a severance payment or a final pay statement can affect timing under state rules. Remote workers may need guidance on which state receives the claim, particularly when they lived in one state and worked for an employer based in another.
Have your legal name, address, employment dates, employer information, wage records and separation explanation ready. Report severance, vacation payout or temporary work as the state requires. Keep confirmation numbers and respond promptly to requests for identity or work-search information.

Do WARN rules apply to your layoff?
The federal Worker Adjustment and Retraining Notification (WARN) Act generally covers employers with 100 or more employees and requires at least 60 calendar days of written notice for a plant closing or qualifying mass layoff affecting 50 or more employees at one site. The Department of Labor describes a qualifying mass layoff as 50–499 employees when statutory workforce-percentage and duration tests are met, or 500 or more employees at one site. Exceptions can apply, including certain unforeseeable business circumstances and other statutory conditions.
These thresholds are not a personal guarantee that every technology worker receives 60 days. Employer size, worksite counts, the number and percentage of affected employees, the duration of the employment loss, and the applicable exception all matter. State “mini-WARN” laws may cover smaller employers, require longer notice or impose different definitions and exceptions.
Contact your state Dislocated Worker Unit to ask whether the event was reported and which state protections apply. Preserve the announcement, individual notice, pay records and worksite information. A suspected violation can require legal advice; do not assume that a severance offer automatically satisfies every notice obligation.
Know your rights in the selection and severance process
The Equal Employment Opportunity Commission says an employer may not base a discharge decision on race, color, religion, sex, national origin, age 40 or older, disability or genetic information. The Age Discrimination in Employment Act specifically protects covered workers age 40 and older. Selection criteria that appear neutral can still be unlawful if they are a pretext for discrimination or have a prohibited disparate impact under applicable law.

If you receive a severance release, read what claims and entities it covers, the payment and benefit conditions, confidentiality and non-disparagement language, cooperation obligations, non-solicitation or non-compete terms, and the deadline to sign or revoke. EEOC guidance notes that some group waivers covered by the Older Workers Benefit Protection Act require written disclosures and at least 45 days to consider the waiver. That rule does not make every agreement a 45-day agreement, so check whether the waiver is offered to a group and obtain advice before signing.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.A practical first-week plan
- File benefits claims: Submit unemployment when eligible, track the claim, and calendar COBRA or Marketplace deadlines.
- Build a lawful accomplishment inventory: Describe the problem, your contribution, measurable result, dates and technologies without copying code, customer data or internal metrics that are not public.
- Update job materials: Revise your resume and professional profile, emphasizing outcomes and transferable skills. Remove confidential product names and proprietary architecture.
- Contact people individually: Reach out to trusted former colleagues, mentors and professional contacts rather than sending a mass export of the company directory.
- Use transition services: Ask about Rapid Response sessions, American Job Centers, employer outplacement, interview workshops, training funds and an employee-assistance program.
- Set a sustainable cadence: Schedule blocks for applications, networking, skills refresh, benefits administration and rest. A weekly plan is more reliable than reacting to every rumor or posting.
What Rapid Response and American Job Centers can provide
The Department of Labor describes layoff as one of life’s most traumatic events and says Rapid Response teams can explain unemployment insurance and health-insurance options, provide career counseling, resume preparation, interview workshops, job-search assistance, training, financial planning and stress-management workshops. Services vary by state and situation. Attend offered sessions and contact your state Dislocated Worker Unit even if your employer has not arranged a meeting.
American Job Centers can connect eligible workers with local job-search assistance and training. Ask whether programs cover technology certifications, transportation, childcare or remote-work equipment in your area. Employer outplacement may add one-to-one coaching, resume review, interview practice or an employer network; verify duration, geographic availability and whether participation affects severance (it usually should be documented clearly).
Guidance for managers and teammates who remain
Publish a fact pattern, not speculation
Managers should state what has been decided, what remains unknown, when individual conversations occur, where benefits information lives and when the next update will arrive. Use neutral language. Do not disclose names, medical information, immigration details or performance claims to the wider team. Route individual selection, accommodations and legal questions to HR or counsel.
Coordinate a safe offboarding
HR, IT, security and facilities should coordinate each event so access termination, equipment return and personal-file retrieval follow an approved sequence. Give affected employees a clear contact and a documented way to return devices. Do not improvise data copies or ask departing staff to transfer credentials through chat.
Protect continuity for the retained team
Reset priorities explicitly. Identify ownership gaps, on-call coverage, production risks, customer commitments and projects that must stop. Schedule a follow-up on workload, psychological safety and unanswered benefits or process questions. Offer references and introductions to departing colleagues where policy allows, and point them to Rapid Response, unemployment, benefits and outplacement resources without promising an outcome.
Decision framework for competing options
| Decision | Compare |
|---|---|
| Health coverage | Premium, deductible and out-of-pocket exposure, provider network, prescription continuity and election deadline |
| Severance choices | Cash versus continued benefits, payment timing, equity treatment, release scope, confidentiality and non-disparagement terms |
| Job-search support | One-to-one coaching, resume and interview help, training budget, employer network, duration and geographic availability |
| Team communication | Speed, factual accuracy, privacy protection, support for affected people and continuity for the remaining team |
When to obtain professional advice
Consider an employment lawyer, benefits adviser or tax professional when a release contains broad waivers, the selection process suggests discrimination or retaliation, equity has substantial value, immigration status is affected, WARN coverage is unclear, or a non-compete or repayment clause could restrict your next job. Bring the written notice, plan documents, pay records and a timeline of events. Do not delay a filing deadline while waiting for a consultation.
