First confirm whether the claim is still pending or has been denied, then obtain the reason in writing, preserve every record, and use the appeal route and deadline stated in your plan notice. Urgent medical risk can justify expedited handling or an external review request while an internal appeal is underway.
Start by identifying what happened
A claim that is pending has not received a final decision. A claim that is denied has been processed and rejected, in whole or in part, or the insurer has issued an adverse benefit determination. The next step depends on which situation you have.
When the claim is pending
- Read the explanation of benefits (EOB) and check that the service date, provider, billed amount, allowed amount, insurer payment, patient responsibility, claim number and status are correct.
- Call the insurer using the number on your insurance card or notice. Ask what information is outstanding, who must provide it, whether the claim is suspended for medical records or coding review, and when the insurer expects to decide it.
- Record the representative’s name, the date and time, the reference number if one is offered, exactly what was requested and the promised next step.
- Ask for the status and any request for information in writing. A delayed claim does not have one universal deadline across all U.S. plans; the governing plan rules, claim type, state and funding arrangement control.
When the claim is denied
Do not treat a phone explanation or an EOB line alone as the complete appeal record. Request the formal denial notice if you do not have it. The notice should identify the decision, the reason, the plan provision used, any denial code and its meaning, the appeal deadline, where to send the appeal, and whether an external review is available.

An EOB explains how the plan processed a claim; it is not necessarily a demand for payment. Compare it with the provider’s bill before paying anything. Look for these fields:

| EOB item | What to check |
|---|---|
| Service date and claim number | Confirm that the claim belongs to you and that the date matches your medical record. |
| Billed amount | What the provider submitted to the plan. |
| Allowed amount | The amount the plan recognizes under its contract or benefit rules. |
| Plan payment | What the insurer says it paid or will pay. |
| Patient responsibility | The amount assigned to deductible, copayment, coinsurance or a noncovered service; verify it against the provider bill. |
| Adjustment or denial reason | The code and plain-language explanation that determine what evidence an appeal must address. |
If the EOB says information is missing, ask whether the provider, you or another party must supply it. If the insurer says the service is excluded, experimental, not medically necessary or out of network, obtain the precise policy language rather than relying on a shorthand description.
Get the decision and appeal rules in writing
For an ERISA-governed employer plan, the U.S. Department of Labor’s Employee Benefits Security Administration says a denial notice must provide enough detail to understand the claim, the specific reason for the denial and the procedures for appealing. Other plans have their own notice and review rules, so the actual letter and plan document remain controlling.
Before writing an appeal, make a one-page summary containing:
- Member name, identification number and contact information.
- Claim number, provider, service date and disputed amount.
- The exact denial reason and any code.
- The plan section or exclusion cited by the insurer.
- The outcome you want, such as payment, authorization or correction of a coding error.
- The filing deadline, submission address or portal, and permitted appeal levels.
If the notice is vague, call and ask for the clinical criteria, policy language, records reviewed and the name of the department handling the appeal. Follow up with a written request so there is a dated record.

Build an appeal file before submitting anything
Keep originals and send copies whenever possible. A complete file makes it easier for a reviewer to connect your evidence to the denial reason.
- The EOB and every denial or adverse-benefit notice.
- A complete copy of your appeal and any plan form you used.
- Medical records, test results, treatment history and referral documentation relevant to the disputed service.
- A clinician’s letter explaining diagnosis, medical necessity, urgency and why the requested treatment meets the plan’s coverage criteria, when those points are relevant.
- Provider billing records, corrected claim forms or coding explanations when the issue is administrative.
- Proof of delivery, portal confirmation, fax confirmation or certified-mail receipt.
- A call log with dates, names, reference numbers and promises made by the insurer.
A paper folder, scanned files or an optional accordion organizer can all work. No purchase is required to appeal; the important part is that the record is complete and backed up.
File the internal appeal on time
An internal appeal asks the health plan to reconsider its own decision. HealthCare.gov gives consumers a general deadline of 180 days after receiving the denial notice to request one, but your notice and plan documents may specify the governing procedure. Missing the stated deadline can forfeit review rights, so use the earliest deadline shown in your documents and keep proof of submission.

Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →- Use the plan’s form or write a request. Identify yourself, the claim and the decision being challenged. State that you are requesting an internal appeal.
- Answer the stated reason. Tie each document to the denial. For a medical-necessity denial, explain the diagnosis, prior treatment, clinical rationale and expected benefit. For a coding or eligibility error, show the corrected information.
- Ask for the precise remedy. Request payment, authorization, reprocessing or removal of an incorrect patient balance, as applicable.
- Attach evidence and retain a copy. Number attachments and refer to them in the letter. Keep the submission receipt.
- Track the decision date. If the plan does not acknowledge the appeal, contact it promptly and ask whether anything is missing.
You can adapt this compact format:

The following are general federal consumer and ERISA timeframes, not a universal promise for every plan. The claim category and the plan’s notice control.

| Stage or claim type | General timeframe described by agency guidance | Important qualification |
|---|---|---|
| Insurer decision on prior authorization (ACA consumer rules) | 15 days | Applies to the general category of services not yet received; verify the plan rule. |
| Insurer decision on care already received (ACA consumer rules) | 30 days | General rule; the actual plan and claim facts may differ. |
| Urgent-care decision (ACA consumer rules) | 72 hours | Used when waiting could seriously jeopardize life, health or ability to regain maximum function. |
| Internal appeal for services not yet received | 30 days | DOL describes this for ERISA plans, with limited exceptions. |
| Internal appeal for services already received | 60 days | DOL describes this for ERISA plans, with limited exceptions. |
| Internal appeal for urgent care | Up to 72 hours | Use the notice’s instructions and explain the medical urgency. |
| Consumer deadline to request an internal appeal | Generally 180 days after receipt of the denial notice | Use the deadline in your notice and plan documents. |
| Federal external-review request | Often four months after the final denial | State and plan rules can differ; the final notice controls. |
There is no single nationwide processing deadline for every delayed claim. A plan’s funding arrangement, grandfathered status, state and claim type can change both the insurer’s decision period and your remedy.
Request expedited review when delay threatens your health
Tell the insurer plainly why standard handling could seriously jeopardize life or health or your ability to regain maximum function. Ask for an expedited internal appeal and identify the date by which a decision is medically needed. Include a clinician’s statement when available.
In urgent circumstances, HealthCare.gov says you may be able to request external review at the same time as the internal appeal. Expedited external review has separate procedures and time limits; use the instructions in the denial notice and those of the applicable state or federal administrator. Do not wait for a routine appeal clock if the treatment cannot safely be delayed.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteUse independent external review when the case qualifies
External review sends an eligible dispute to an independent reviewer rather than asking the insurer to reconsider again. HealthCare.gov describes the resulting decision as binding on the insurer. Eligibility commonly includes denials based on medical judgment, determinations that care is experimental or investigational, and coverage rescissions. Not every dispute qualifies, and some plans require completion of the internal appeal first.

- Read the final internal-appeal notice for the external-review administrator, deadline and submission method.
- Send the request before the stated deadline. Federal guidance often describes a four-month window, but state and plan rules can be different.
- Attach the final denial, EOB, internal appeal, relevant records, clinician explanation and proof of dates.
- Explain the specific medical or coverage judgment under review; do not submit an unrelated history that obscures the disputed issue.
CMS reported a temporary extension for certain HHS-administered federal external-review requests affected by a 2026 process interruption: qualifying windows that fell between July 1 and August 3, 2026 could run until October 2, 2026. That date has passed, and the extension was limited by location, plan type and filing history; it is not an open general deadline.

State Consumer Assistance Program
A state Consumer Assistance Program may help you understand the denial, prepare an appeal or submit it. Availability and authority vary by state.
State insurance department
For a state-regulated, fully insured plan, the state insurance department may explain complaint and external-review procedures. The insurer’s notice or your policy documents should identify the correct office.
Employer plan administrator and EBSA
Ask your employer’s benefits office or plan administrator whether the plan is insured or self-funded and request the governing plan document. Self-funded employer plans are generally administered under federal rules rather than state insurance regulation. For ERISA process concerns, the Department of Labor’s Employee Benefits Security Administration provides information and assistance.
Insurer grievance or member-services department
Use the member-services number for status questions, corrected claims and submission instructions. Ask for a supervisor when a representative cannot explain the denial code, but keep the request factual and continue documenting every contact.
Common mistakes that weaken a claim appeal
- Appealing the wrong issue: A medical-necessity denial needs clinical evidence; a duplicate-claim or coding error needs billing proof.
- Relying on a phone promise: Ask for written confirmation and retain the call log.
- Sending an unorganized record: Number attachments and identify the page that supports each point.
- Missing the deadline while gathering records: File a timely appeal with the evidence available and ask whether supplemental records may follow.
- Paying a disputed provider balance immediately: Compare the bill with the EOB and ask the provider about a hold while the appeal is pending.
- Assuming every denial can go to external review: Check eligibility, plan type and the final notice.
- Using a routine appeal for an emergency: State the health risk and request expedited handling explicitly.
A practical day-by-day checklist
- Today: Save the EOB and denial, mark the service and receipt dates, and call for the current status.
- Within the next few days: Request missing policy language, clinical criteria or records; contact the provider for corrections and your clinician for a supporting statement.
- Before the notice deadline: Submit the internal appeal with attachments and delivery proof.
- While waiting: Monitor treatment needs, respond quickly to requests and keep a dated log.
- After the final decision: If the denial remains and the case qualifies, submit external review using the final notice’s instructions; otherwise contact the appropriate state or federal assistance channel.
What outcome to expect
An appeal can result in payment, authorization, corrected processing or confirmation that the exclusion applies. A well-documented file cannot guarantee coverage, but it gives the reviewer the facts, plan language and medical explanation needed to evaluate the actual dispute. Keep the final decision with your records and ask the plan to explain any remaining patient balance in writing.
