Pause before ordering or paying. Confirm the restaurant location, ordering channel, exact item, current availability, and complete price with staff; then save the listing and receipt. If the restaurant will not correct a charge, contact the delivery platform (if involved) and the consumer-protection agency for the restaurant’s location. Whether a business must honor an online price depends on the state, the transaction, and what the listing actually disclosed.
An online menu can be wrong because it is stale, belongs to another branch, describes dine-in while you are ordering delivery, omits a promotion condition, or comes from an unauthorized third-party listing. Treat the mismatch as something to document and resolve, not as an automatic legal victory.
Start with a five-minute verification
Before you argue about the bill, establish that you are comparing the same offer. Write down or photograph the restaurant name, street address, item name, listed price, ordering method, and the date and time. Then check the following differences.
| What may differ | What to compare | Why it matters |
|---|---|---|
| Location | Exact branch address on the listing and your receipt | A chain or local group may use separate menus and prices by location. |
| Ordering channel | Restaurant-controlled website, dine-in menu, pickup page, or delivery platform | Platform prices, availability, fees, and promotions can differ from in-house terms. |
| Menu version | Publication date, “seasonal,” “limited time,” or sold-out label | A search result or cached page can remain visible after the offer ends. |
| Price type | Base item price versus tax, mandatory fee, optional add-on, tip, or delivery charge | A higher total is not necessarily a higher menu price; each component should be identified. |
| Quantity and modifiers | Size, side, substitutions, toppings, and number of items | Changes selected during ordering can alter the amount. |
The Federal Trade Commission (FTC) and Illinois Attorney General alleged in a December 2024 action that outdated menus and unauthorized listings on a delivery service harmed diners and restaurants. The complaint attributed listings for up to 325,000 unaffiliated restaurants to the service; that figure is an allegation in that enforcement matter, not a current count of restaurants or proof that every listing was inaccurate.

Before ordering: confirm the current offer
- Open the original page. If a search engine, social post, or screenshot led you to the menu, follow it to the restaurant’s own page when possible. Note whether the page identifies the branch, ordering channel, date, or promotion terms.
- Check availability. Look for “sold out,” “seasonal,” “limited time,” or an item that disappears after selecting a location. Ask whether the dish is available now and whether the listed portion or size is the one being served.
- Ask for the complete price. Request the base price, any mandatory charge, and any optional add-on separately. If you are ordering through an app, compare the restaurant’s own menu with the platform’s checkout total before submitting payment.
- Get confirmation from staff. Say, “I see this item at $X on the [site/app] for this location. Is that the current price for [dine-in/pickup/delivery]?” Record the employee’s answer, and ask for a manager if the answer is uncertain.
- Choose deliberately. If the price or availability changes, decide whether to accept the new terms, select another item, cancel before payment, or leave. Do not assume an old page or screenshot automatically controls the transaction.
If the quoted price is higher than the listing
Show the exact listing calmly and identify the mismatch without accusing the staff member. Ask whether the restaurant can honor the displayed price, correct the menu, or remove the item from the order. The business may agree as a goodwill adjustment, explain a location or channel difference, or decline because the listing is obsolete. If you have not accepted the new price, you can refuse the item or order and avoid a dispute over an amount you never authorized.
Ask one clarifying question at a time:
- Is this the same branch and menu channel?
- Was the displayed price a promotion with a date, membership, size, or time restriction?
- Is the difference a mandatory fee, an optional addition, tax, tip, or delivery charge rather than the item price?
- Can the restaurant correct the online listing while you are there?
If a platform supplied the listing, take a screenshot showing the restaurant, item, price, and location before the page changes. Tell both the restaurant and the platform what you were shown and what you were quoted. The FTC’s April 2026 notice seeking public comment on online food and grocery delivery practices asked about price differences between platforms and restaurants, discounts, total prices, fees, and unauthorized billing. That notice requests comment; it is not a final rule requiring every platform to display identical prices.
If the food or availability is different
The item is unavailable
Ask whether the kitchen has a substitute, a different portion, or a new preparation time. If you ordered online and the restaurant cannot supply the item, request cancellation or a refund through the same channel used for payment. Save the original confirmation and any message saying the item was unavailable.

The restaurant is a different branch
Show the address displayed when you ordered and the address on the receipt. Ask the platform or restaurant to correct the location mapping. A branch can have a different menu, hours, inventory, or price without either page being universally applicable.
If the bill is already wrong
- Request an itemized receipt. Check each item, size, modifier, fee, tax, discount, and tip line.
- Point to one discrepancy. State what the listing showed, what the receipt charged, and the dollar difference. Ask the server or cashier for a correction.
- Escalate to the manager. If the first employee cannot adjust the bill, repeat the facts to a manager and ask what resolution is available.
- Record the response. Note the location, date and time, order channel, employee or manager response, and whether a refund, credit, or correction was promised.
- Keep payment records. Retain the receipt, order confirmation, screenshots, emails, chat messages, and any refund notice until the matter is closed.
Do not alter a receipt or make a chargeback your first step when the restaurant is actively correcting the error. If a card dispute becomes necessary, describe the transaction accurately and provide the issuer with the same records you gave the merchant. Card-network deadlines and procedures vary.
Build an evidence packet before pages change
Online menus can be edited without preserving the old price. Save a dated screenshot that includes the URL or app screen, restaurant name, branch, item, price, and promotion terms. Keep the original confirmation email or text, the in-person menu if the restaurant permits a copy or photograph, and the itemized receipt.

What the law does—and does not—guarantee
There is no single nationwide restaurant rule that resolves every online-menu mismatch. The FTC’s small-business advertising guidance says truthful-price standards apply and notes that many jurisdictions require sellers to charge no more than an advertised or shelf price. It also advises businesses and consumers to check the relevant state Attorney General because local pricing practices and remedies differ.
The FTC’s Unfair or Deceptive Fees guidance distinguishes mandatory charges from optional charges. Covered businesses must disclose required total-price information in situations governed by the rule, while an optional charge must be disclosed and included in the final amount before payment. The guidance also recognizes that businesses may use demand- or inventory-based pricing when the presentation is not misleading and that prices can vary by region. Those principles do not automatically decide whether a particular restaurant must honor an old online menu price.
California demonstrates why location matters. The state Attorney General describes Senate Bill 478 as a transparency law, not a price-control law. It generally requires the full amount a customer is required to pay to be shown in a listed or advertised price, subject to statutory exceptions. The guidance gives special treatment to certain mandatory restaurant and food-vendor fees when they are clearly and conspicuously displayed wherever prices are shown. California’s rules are an example, not a nationwide standard; verify the current law where the restaurant is located.
As FTC Bureau of Consumer Protection Director Christopher Mufarrige said in April 2026, “Clear and truthful pricing is essential to competitive markets.” The statement appeared in the notice seeking comment on online food and grocery delivery practices, not in a final rule establishing a universal menu-price guarantee.

Escalate in the right order
1. Restaurant management
Give the business one clear opportunity to fix the listing, price, food, or refund. Written communication is useful because it creates a record and lets you attach the same evidence later.
2. The ordering platform
For a platform order, open the order’s help or support path and report the inaccurate listing or unauthorized charge. Include the restaurant location, item, displayed price, charged amount, and screenshots. Ask whether the platform can correct the page and refund the difference.
3. State or local consumer protection
Identify the consumer-protection office serving the restaurant’s location, often the state Attorney General or a local agency. Complaint forms and jurisdiction differ, so follow that office’s instructions rather than sending a complaint to an unrelated state.
The Iowa Attorney General’s consumer guidance, for example, recommends trying to resolve the issue directly, preserving screenshots, receipts, emails, and other supporting documents, and considering a consumer complaint when direct resolution fails. That is an Iowa-specific route and should not be treated as a nationwide filing instruction.

4. Payment dispute or court
Use a payment dispute only for a legitimate unresolved billing problem and meet the card issuer’s time limits. For a substantial loss, local legal aid or a licensed attorney can explain state-specific remedies. A consumer agency may investigate patterns or violations but cannot promise an individual refund.
Common situations and the sensible response
Restaurant website shows $14; the dining-room menu shows $17
Verify that both pages identify the same branch and meal period. Ask which menu is current and whether the website is an old promotion. If the restaurant will not honor $14, choose whether to proceed at $17; save the page and report the stale listing for correction.
Delivery app shows a lower entrée price, but checkout adds fees
Separate the entrée price from delivery, service, small-order, tax, tip, and optional charges. Review the final amount before payment. If a required charge was not disclosed as required by applicable law, document the screen and ask the platform and restaurant to explain or refund it.

A search result lists a dish that the restaurant never offered
Ask the restaurant whether the page is theirs. An unauthorized or outdated listing may be outside the restaurant’s control. Report the inaccurate page to the platform or search service while preserving the result and the restaurant’s response.
The menu price changed after you placed the order
Use the order confirmation to show the amount accepted at checkout. Ask the restaurant or platform to honor that confirmed amount or cancel without penalty. Keep proof of the confirmation and any later adjustment.
How to prevent the problem on your next order
- Use the restaurant’s location selector and confirm the street address before adding items.
- Prefer a current, restaurant-controlled menu when it is available, but still check its date and promotion terms.
- Review the final checkout screen, including mandatory and optional charges, before submitting payment.
- Save the confirmation for large, catered, or time-sensitive orders.
- Ask about seasonal items, substitutions, and branch-specific prices before traveling to the restaurant.
The practical rule is simple: verify first, ask before accepting a changed price, preserve evidence, and escalate with the same facts if the business does not resolve the discrepancy. That approach protects your money without assuming that every online price is legally binding in every state.
