First identify where the case is stuck. A U.S. employer’s petition can be pending or denied at U.S. Citizenship and Immigration Services (USCIS), while a worker’s visa application can be pending or refused at a U.S. consulate. Those are separate stages handled by different agencies, with different status tools, deadlines and remedies. Find the receipt number, notice or interview record involved before taking action.
Start by locating the stage of your case
IT professionals commonly encounter two connected but distinct processes. The employer (or another petitioner) may file an employment petition with USCIS. After approval, a worker who is outside the United States generally applies for a visa at a U.S. embassy or consulate. A petition approval does not itself issue a visa, and a consular refusal does not necessarily mean USCIS denied the petition.

Do not send a consular document response to USCIS or use a USCIS inquiry form for a consular case. Keep copies of every receipt, notice, uploaded document, courier confirmation and status change.
What to do when a USCIS work-visa petition is delayed
1. Check Case Status Online
Use the USCIS receipt number exactly as printed on the receipt notice in USCIS Case Status Online. Confirm that USCIS has the correct mailing address and contact details. A status page can show that a filing was received, that an RFE or other notice was issued, that a response was received, or that a decision was made. The status tool tracks an application, petition or request; it does not predict approval.

2. Check the correct processing-time entry
USCIS processing times depend on the form, classification and office handling the case. Select the exact form and category shown on the receipt, then use the listed service center or field office. USCIS says the displayed processing time reflects how long it took to complete 80% of adjudicated cases during the previous six months. That is a population measure, not a promise that your case will finish by that date.
The separate “case inquiry date” calculation uses a 93% completion measure. Reaching that date means you may ask USCIS about the delay; it does not create an approval deadline or guarantee a response by a particular day.
3. Submit an inquiry only when the tool permits it
If the processing-time page says your receipt is outside normal processing, use the USCIS case-inquiry channel identified there and provide the requested receipt and contact information. When a form type is not listed, USCIS says the default inquiry threshold is more than six months pending. That six-month rule is an eligibility threshold for asking about a case, not an expected adjudication time.

4. Track RFEs and responses carefully
An RFE pauses the practical path to a decision until the response is received and reviewed. Record the response deadline printed on the notice, send every requested item in the specified format, and retain proof of delivery or online submission. USCIS notes that a recent notice, an RFE response or an online status update may indicate active processing. Workload, staffing, policy, operational changes and the time taken to answer a request can all affect duration.
5. Coordinate with the employer
For many employment petitions, the employer is the petitioner and receives the formal notices. Ask the company’s immigration contact for the receipt notice, RFE, response and decision, rather than relying on a worker’s informal summary. This matters for software engineers, analysts and other IT workers whose start date, assignment or location may change while the petition is pending. Do not change jobs, duties or work location based solely on an online status phrase; obtain advice tied to the specific filing and authorization.

- the form and classification decided;
- the person or company that filed the petition;
- the factual and legal reasons USCIS gave;
- any motion or review procedure named in the notice; and
- the deadline and filing location stated there.
There is no single appeal deadline or universal review route for every employment form. Procedural rights vary by form and decision. Because the employer generally controls a petition, the worker may need the petitioner to decide whether to pursue the option in the notice. A qualified immigration lawyer can explain the notice, but no representative can guarantee approval or force USCIS to finish sooner.

At a consular interview, a refusal under section 221(g) means the officer has not found the applicant eligible at that stage. The notice may say that the application is incomplete and list documents to provide, or it may say that administrative processing is required. Read the refusal sheet rather than treating the word “refused” as a final, permanent outcome.
When documents are requested
Follow the exact submission method and document list in the refusal letter and the consular post’s instructions. Send a complete response promptly, keep scans of everything and retain the courier or online confirmation. The Department of State says an applicant has one year from the refusal to provide requested additional information. If that period expires, the applicant must start a new visa application and pay another application fee.

When administrative processing is required
Administrative processing can involve additional review after the interview or after supplemental documents are submitted. The Department of State states: “The duration of the administrative processing will vary based on the individual circumstances of each case.” There is no reliable universal duration, and the officer may later determine that the applicant qualifies or remains ineligible.
Consular electronic status systems can display “refused” while administrative processing is underway. The Department of State has explained that this display can change later if eligibility is established or outstanding issues are resolved. Check the case using the instructions for the specific post and keep the case number and passport details available.
When and how to ask about administrative processing
For routine cases, Department of State guidance says applicants should wait at least 180 days after the interview or the submission of supplemental documents, whichever is later, before asking for an administrative-processing update. The guidance identifies an exception for emergency travel involving serious illness, injury or death in the immediate family. The 180-day point is inquiry guidance, not an estimate of when a decision will arrive.

After the waiting period, use the consular post’s designated contact channel and include the applicant’s full name, date of birth, passport details, case number and interview date. Avoid sending repeated messages through unrelated channels; they do not substitute for the post’s requested documents or accelerate review. If an urgent family emergency exists, explain it clearly and provide whatever evidence the post requests.

Consular visa refusal
A consular visa refusal has no appeal process. The Department of State’s guidance states, “There is no appeal process.” A 221(g) document request is handled by supplying the requested information within the one-year period; it is not an appeal. If the refusal is based on an unresolved ineligibility, the practical option may be a new application that addresses the stated problem, when the facts and category allow it.
USCIS petition denial
USCIS decisions are different. The decision notice may identify a motion, appeal or other review route, but availability depends on the form and the type of decision. The petitioner named on the notice generally must take that step. Follow only the instructions and deadline in the actual notice; do not assume a consular “no appeal” rule applies to a USCIS petition.

Reapplication may be possible, but it is not a universal fix. First determine whether the refusal was a missing-document 221(g), administrative processing, or another ineligibility. A new application is normally required after the one-year 221(g) document window closes, and a new visa application generally carries another fee. A new filing should address the specific reason for refusal with complete, consistent evidence; submitting the same unchanged application can lead to the same result.
For an IT professional, prepare a factual record that matches the petition and interview: the employer and role, worksite or assignment information, education and experience evidence, passport details and every document requested by the post. Do not conceal a prior refusal. The consular officer will evaluate the new application under the facts and evidence then presented.

Common mistakes that make a delay harder
- Mixing agencies: USCIS case status cannot explain a consular administrative-processing delay.
- Treating a processing-time chart as a promise: The 80% display and 93% inquiry calculation describe groups of completed cases, not your outcome.
- Ignoring the notice: A refusal sheet or decision letter controls what evidence, channel and deadline apply.
- Missing the 221(g) year: Waiting beyond one year to provide requested information can require a new application and another fee.
- Assuming the worker can appeal an employer petition: The petitioner named in the USCIS filing usually controls the available review step.
- Using generic expedite claims: Eligibility for expedited or premium handling depends on the exact form and current agency rules; verify it before relying on it.
- Sending inconsistent evidence: Names, dates, job duties and employer information should match across the petition, DS-160 or other application records, passport and supporting documents.
When individualized legal review is worthwhile
Consider case-specific immigration counsel when a USCIS denial contains complex factual findings, an RFE raises specialized qualification issues, a consular refusal cites an ineligibility ground, a deadline is close, or the employer and worker disagree about who must act. Bring the complete notice, receipt, petition copy, evidence submitted, interview record and status history. Counsel can explain available procedures and risks, but cannot promise approval, erase a refusal or guarantee faster agency processing.
