Do not treat an acquisition, new owner, or revised terms as an automatic reason to abandon an AI service—or as proof that continued use is safe. First establish exactly what changed, map every affected use and data flow, verify the governing contract, reassess privacy and security, test material service changes, and document whether you will continue, require remediation, restrict use, or transition.
Start with a controlled response
Assign one accountable owner and open a dated change record as soon as the provider announces a policy or ownership change. Preserve the announcement, the effective date, affected products, named provider entities, and any versioned terms. Separate confirmed changes from predictions about what the new owner might do.
Put a temporary control around high-risk activity while facts are gathered. Depending on your exposure, that may mean pausing new integrations, prohibiting sensitive uploads, requiring human review, or routing critical work to an approved fallback. A temporary restriction is not the same as a final exit decision; it prevents an unresolved change from silently expanding your risk.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches1. Confirm what actually changed
Ownership changes can alter the contracting entity, subprocessors, data-access arrangements, support model, or product roadmap. A policy revision may change only one product, region, plan, or use of customer content. Record the scope rather than assuming that every service from the provider changed at once.

Build the change record
- Announcement date, effective date, and any transition period.
- Legal entities involved before and after the change, including a new parent, subsidiary, or service operator.
- Products, models, APIs, embedded features, and regions named in the notice.
- Exact clauses or policy sections that changed, with old and new copies.
- Provider statements about prompts, uploaded files, telemetry, training, retention, subprocessors, security, support, pricing, or service levels.
- Open questions, the person responsible for each answer, and the date by which an answer is needed.
Ask the provider for a written impact statement if the notice is broad. Request confirmation of whether your account, purchased features, data location, support process, and negotiated terms are affected. Keep marketing assurances separate from contractual commitments.
2. Map your organization’s exposure
You cannot decide what a provider change means until you know where the service is used. Inventory direct purchases and AI embedded in a larger software platform. Include pilots and departmental accounts that procurement may not have recorded.
Minimum inventory fields
| Field | What to record |
|---|---|
| Business owner | The person accountable for the outcome and risk of the use case. |
| Service and integration | Product, model or endpoint, plan, region, connected applications, and authentication method. |
| Users and workflow | Teams, approximate volume, human approvals, downstream recipients, and decisions influenced by outputs. |
| Data | Personal information, confidential business data, regulated records, intellectual property, customer content, and whether data is uploaded, generated, logged, or exported. |
| Business impact | Consequences of downtime, changed answers, delayed support, unavailable history, or loss of an integration. |
| Current controls | Access restrictions, retention settings, redaction, monitoring, testing, incident contacts, and approved alternatives. |
Classify uses by impact. A drafting assistant for low-sensitivity material needs a different response from a system that influences hiring, credit, health, safety, legal advice, or access to essential services. Identify the highest-impact and most data-intensive uses first, then work down the list.
Bring procurement, legal, privacy, security, product, records-management, and business owners into the review as appropriate. Government acquisition guidance emphasizes cross-functional review; private organizations can use the same practice without treating federal procedures as mandatory.

3. Identify the documents that govern your service
Do not rely on a general website policy alone. The controlling documents depend on the exact product and how it was purchased. A service may be governed by a master agreement, order form, product terms, data protection addendum, security exhibit, service-level agreement, acceptable-use policy, and incorporated online terms.
Collect and compare
- Retrieve the signed agreement, order form, renewal notice, and amendments for your account.
- Save the data protection addendum, security documentation, service-level terms, privacy notice, and product-specific terms in force before the announcement.
- Obtain the new versions and record their effective dates, notice method, and any acceptance mechanism.
- Compare the documents clause by clause. Highlight changes rather than reading only the provider’s summary.
- Ask counsel which document controls if negotiated language conflicts with an online policy, and whether the change is permitted without your consent.
Issues to check
- Permitted use of prompts, files, outputs, telemetry, and account information, including any training or service-improvement use.
- Retention periods, deletion triggers, backup treatment, legal holds, and return of data at termination.
- Controller and processor roles, subprocessors, data locations, international transfers, and notice or objection rights.
- Security controls, access management, encryption, vulnerability handling, incident notification, audit evidence, and independent assurance reports.
- Intellectual-property ownership, licenses to use inputs and outputs, confidentiality, and responsibility for infringement claims.
- Model or feature changes, support commitments, uptime, performance remedies, rate limits, and deprecation notice.
- Termination rights, suspension triggers, transition assistance, export formats, deletion evidence, and fees that could affect an exit.
These are review topics, not guarantees that every agreement provides each right. If a protection is important and absent or ambiguous, treat it as an unresolved risk and seek a written commitment or compensating control.
4. Reassess privacy and data protection
An ownership change may introduce a different entity that determines processing purposes, receives data, or supplies infrastructure. Recheck whether the original purpose, lawful basis, notices, and contractual roles still fit what happens in practice.
Questions for the privacy assessment
- Who can access the data after the change, and for what purpose?
- Has a new controller, processor, subprocessor, or joint decision-maker appeared?
- Will prompts, files, outputs, or usage metadata be used for training, profiling, advertising, abuse detection, or product development?
- Does the new arrangement create a transfer to another country or a new onward recipient?
- Do retention, deletion, and return commitments still match your records schedule and customer promises?
- Do you need to update privacy notices, contracts, data-protection impact assessments, consent language, or individual communications?
Document the reasoning and evidence, not just a yes-or-no conclusion. UK Information Commissioner guidance on mergers advises examining original purposes, lawful basis, changed purposes, governance, security, and documentation when data moves to a different or additional controller. That guidance is under review following the Data (Use and Access) Act, so confirm the current UK position for your facts.

For organizations subject to Canada’s PIPEDA, the Privacy Commissioner describes third-party assessment as a due-diligence measure supporting accountability. The cited consultation page accepts comments until December 4, 2026; verify the final guidance and the law that applies to your organization before relying on it.
5. Recheck security and operational resilience
Ask whether the new owner changes privileged access, hosting, subprocessors, identity systems, support locations, incident escalation, or vulnerability-management practices. Obtain current security evidence rather than assuming that an earlier assessment remains valid.
Evidence to request or refresh
- Current security certifications or independent assessment reports relevant to the service.
- Architecture and data-flow descriptions showing storage, processing, backups, and administrative access.
- Subprocessor list, change-notification process, and geographic locations.
- Incident-response contacts, notification timelines, and recent changes to the escalation path.
- Retention and deletion procedures, including how backups and derived data are handled.
- Business-continuity, disaster-recovery, uptime, and capacity commitments.
Map a practical fallback for critical workflows. Record how long the organization can operate without the service, what manual process would be used, and who can authorize a switch. A fallback that has never been tested is an assumption, not resilience.

Design a proportionate test
- Define acceptance criteria before testing: accuracy, consistency, safety, privacy, security, accessibility, latency, cost, and any use-case-specific threshold.
- Use a representative test set that is redacted, synthetic, or otherwise approved for the environment. Do not upload production secrets merely to reproduce a result.
- Compare the previous and current service on the same prompts, documents, tools, and human-review steps where possible.
- Check edge cases, refusals, hallucinations, formatting, citations, language coverage, bias-sensitive outcomes, and downstream automation.
- Have the business owner and relevant risk specialists review results. Record failures, severity, remediation, and retest dates.
- Set monitoring and a rollback or fallback plan before returning the workflow to normal operation.
US Government Accountability Office work on AI acquisition identifies data-rights clauses and testing requirements as lessons worth carrying into future procurements. That is not a universal private-sector test protocol; your depth and thresholds should reflect the use case and risk.

United Kingdom
Use the ICO’s merger and outsourced-service guidance to assess controller changes, purposes, lawful basis, security, documentation, and return or deletion clauses. The ICO also recommends regular review of outsourced services and considering modification or switching when continued use is no longer compliant in your circumstances.
Canada
Organizations within PIPEDA should treat third-party assessment and accountability as part of vendor due diligence. Consultation material is not automatically final law, so confirm the applicable provincial or federal requirements.

Determine whether your role and activity bring obligations under the EU AI Act into scope. European Commission material cited for this issue concerns general-purpose AI model providers, including technical documentation, downstream information, copyright policy, and training-content summaries. Those provider duties do not automatically become duties of every customer or downstream deployer.

United States federal acquisition
GAO findings and federal acquisition guidance describe agency procurement and coordination practices. Private organizations may adapt the risk-management ideas, but should not assume that federal requirements apply to them.
8. Make a documented decision
Use the same criteria for every affected use, while allowing high-impact workflows to require a higher threshold. Record facts, uncertainties, owners, mitigations, approval authority, and the decision date.
| Outcome | Use when | Required controls |
|---|---|---|
| Continue | Terms, privacy, security, behavior, and continuity remain acceptable. | Archive evidence, update the risk record, monitor the provider, and set a next review date. |
| Continue with remediation | The service is valuable but a specific gap can be corrected. | Negotiate written commitments, assign deadlines, restrict affected data or features, and verify completion. |
| Restrict or pause | Uncertainty or failure is unacceptable for sensitive or high-impact use. | Stop new use, remove sensitive inputs, increase human review, and activate a fallback while issues remain open. |
| Transition | The provider cannot meet legal, contractual, security, quality, transparency, or continuity requirements. | Approve a migration plan, test the replacement, control dual-running, and complete return or deletion obligations. |
Cost alone should not decide the outcome. Weigh contractual and regulatory fit, data protection, security readiness, service quality, change transparency, continuity and portability, transition burden, and the availability of an acceptable alternative. The weighting depends on your use case and risk tolerance.
9. If you leave, make the exit operational
- Confirm termination rights, notice periods, minimum commitments, export charges, and permitted access during the transition.
- List everything to export: prompts, uploaded files, outputs, conversation history, evaluations, fine-tuning materials, configurations, logs needed for accountability, user and role mappings, and integration settings.
- Test the export format and completeness before terminating the old service. Preserve chain-of-custody records for sensitive information.
- Evaluate replacements against the same acceptance criteria, data restrictions, security evidence, support needs, and regulatory analysis.
- Run a staged cutover with a defined rollback point. Communicate changed procedures to users, customers, and affected partners.
- Obtain deletion certificates or equivalent evidence for data that must be removed, including copies held by subprocessors and backups where the contract requires it.
- Close credentials, webhooks, API keys, integrations, and administrator accounts only after dependencies and records obligations are addressed.
Processor contracts should state that personal information is returned or deleted at the end of the service unless law requires storage. Keep the old service only for the period and purposes the contract and law permit.
10. Turn the incident into a standing control
After the decision, update the AI inventory, supplier register, data-flow diagrams, privacy assessments, security review, model-risk documentation, and business-continuity plan. Add provider-change events to contract monitoring and require business owners to report unapproved AI features or account creation.
Set recurring reviews for high-impact services and trigger reviews when ownership, terms, subprocessors, model families, data locations, or retention practices change. Preserve the decision record so a later auditor, regulator, customer, or executive can see what changed, what was tested, which uncertainties remained, and why the organization continued, restricted, or exited.
