First identify which stage produced the problem: an H-1B cap registration that was not selected, a USCIS petition that is pending or denied, or a Department of State visa application that is delayed or refused. Each stage has a different decision-maker, notice, deadline, and remedy. Get the exact selection notice, USCIS notice, or consular refusal sheet before taking action, then coordinate with the petitioning employer and qualified immigration counsel when the consequences are significant.
Identify the stage before you act
People often say their “H-1B was denied” when three separate events may be involved. The employer’s electronic registration is a cap-selection process. USCIS then decides whether to approve the employer’s Form I-129 petition. The Department of State separately decides whether to issue a visa to an individual applying at a U.S. embassy or consulate. An approval at one stage does not automatically produce approval at the next.
| What happened | Decision-maker | Document to locate | Usual first action |
|---|---|---|---|
| Registration was not selected | U.S. Citizenship and Immigration Services (USCIS) cap-registration system | Employer’s registration result or selection notice | Ask the petitioner to confirm the official status and assess other lawful routes. |
| Petition is still pending | USCIS | Form I-797 receipt notice and receipt number | Check case status and the processing-time tool for the correct form, category, and office. |
| Petition was denied | USCIS | Complete written denial notice | Read the grounds, dates, and instructions with the petitioner and counsel. |
| Visa case is marked 221(g) | Department of State consular section | Refusal sheet and document request, if any | Submit every requested item through the specified channel or monitor administrative processing. |
| Visa refused under another ground, such as 214(b) | Consular officer | Refusal sheet identifying the INA section | Follow the rule for that ground; do not assume an appeal or that petition approval controls the result. |
The notice controls. Screenshots, informal emails, a visa appointment label, or a CEAC status alone may not explain what the government is asking you to do.
If your H-1B registration was not selected
Confirm that the result is official
Ask the employer or other petitioner that submitted the registration to retrieve the result from its USCIS account and give you the exact wording. USCIS describes a selected registration as permission to file a cap-subject Form I-129 petition; it is not approval of a petition or a visa. A nonselection notice therefore is not a USCIS petition denial. The USCIS description of the process is available in the H-1B Electronic Registration Process.

Do not treat nonselection as an appealable denial
The materials for the registration process do not establish a general appeal, guaranteed later selection, or a right to submit a second registration for the same beneficiary. USCIS warns that duplicate registrations by the same registrant for one beneficiary may be invalid. Do not ask an employer to create duplicate entries simply to improve the odds.
Ask what other lawful route may fit
Your employer’s immigration team or qualified counsel can examine whether the job and employer may qualify for a cap-exempt H-1B classification, whether another employment or student-related status is available, or whether a future registration is appropriate. Those possibilities depend on the employer, position, beneficiary’s education and experience, current status, and dates. A nonselection result by itself does not answer whether you may remain in the United States or continue working; those questions require review of your current status, I-94, employment authorization, and filing history.
If a USCIS H-1B petition is taking too long
Use the receipt number and the correct processing category
The petitioner or its attorney should provide the Form I-797 receipt number. Enter it in USCIS online case status and check the USCIS processing-time tool using the exact form, classification, and field office or service center shown for the case. USCIS explains that posted times reflect its processing experience for a form, category, and office; they are estimates, not promised completion dates. The agency’s processing-time explanations are at Processing Times FAQs.

- Open the USCIS processing-time page and select the form and case category that match the receipt notice.
- Enter the receipt date and office information requested by the tool.
- If the result says the case is outside normal processing time, use USCIS e-Request or the inquiry method displayed for that case.
- Save the inquiry confirmation number, submission date, and a copy of what you reported.
An inquiry does not guarantee approval or an immediate decision. USCIS may respond that the case remains within normal processing, request evidence, or provide a status update. Keep checking the case for a new notice rather than relying only on an inquiry response.

Account for premium processing separately
If the petitioner requested premium processing, follow the contact details and instructions on the premium-processing receipt and USCIS notices. Premium processing changes the agency’s service commitment for an eligible filing; it does not guarantee approval, eliminate a request for evidence, or issue a visa. A petition can be approved while a later consular interview remains pending.
Escalate through the petitioner, not an individual beneficiary alone
The employer is the H-1B petitioner and normally receives the formal petition notices. Give the employer and counsel copies of every update, address change, request for evidence, and delivery problem. Do not send duplicate petitions or registrations merely because a case is slow; duplicate filings can create validity and fee problems and do not substitute for an official inquiry.
If USCIS denied the H-1B petition
Read the entire denial notice
Identify the factual and legal grounds, the decision date, the petitioner named in the notice, and every instruction about review, motions, refiling, or response. USCIS decisions do not all carry the same options or deadlines. The sources and procedures applicable to one denial cannot be generalized to every H-1B case.
Recommended Free Tools
Coordinate with the employer and counsel promptly
Because the employer filed the petition, the petitioner and its immigration counsel must decide whether the notice supports a motion, an administrative review option, a corrected filing, or no further filing. Ask for a written timeline that accounts for the decision date, any deadline stated in the notice, the beneficiary’s current status and I-94 expiration, and the practical effect on employment. The USCIS case-status and processing resources explain how to obtain case information, but they do not replace legal analysis of a denial.

Do not assume a petition denial tells you to leave immediately
Whether you may stay, work, change status, or need to depart depends on facts such as the status requested, the validity of your I-94, prior filings, employment authorization, and the dates of any authorized grace or status period. A denial notice alone is not enough information to give a reliable work or stay answer. Obtain individualized advice before working, changing employers, remaining past an authorized period, or making travel plans.
If the consular visa is delayed or marked 221(g)
Understand what 221(g) means
The Department of State describes a refusal under INA 221(g) as a situation in which the applicant has not established eligibility to the officer’s satisfaction at that stage. The consular section may request missing documents or information, or it may place the case in administrative processing. A 221(g) refusal is not the same thing as a definitive final ineligibility under every possible ground, and an approved H-1B petition does not override the consular officer’s separate visa decision.
Respond exactly as instructed
- Read the refusal sheet and identify every document or answer requested.
- Use only the submission method and file format specified by the embassy or consulate.
- Send a complete, consistent response as soon as practical and keep delivery proof.
- Monitor the official case-status channel and your email or appointment account for further instructions.
The Department of State’s Administrative Processing Information page says requested information should be provided within one year of the refusal. If the information is not provided within that one-year period, the applicant must reapply and pay another visa fee. The same page states that “The duration of the administrative processing will vary based on the individual circumstances of each case.” There is no universal administrative-processing deadline that can reliably predict when a particular H-1B visa will be issued.

A CEAC status of “refused” can appear in a 221(g) case. That label alone does not tell you whether the consular section is waiting for documents, conducting administrative processing, or has made a different final determination; follow the refusal sheet and official updates. Repeated emails or duplicate applications generally do not accelerate administrative processing. If a serious, documented hardship exists, ask the consular section whether it provides a hardship-contact procedure, without assuming that an expedite will be granted.

If the visa was refused under 214(b) or another ground
214(b) has a specific rule
The Department of State’s Visa Denials guidance states, in the section addressing INA 214(b), that “There is no appeal process.” A person may submit a new application with a new fee, preferably when there is additional relevant information or a significant change in circumstances that addresses the refusal. Reapplying with the same facts and documents does not create an appeal.
Do not apply the 214(b) rule to every refusal
Read the refusal sheet for the exact INA section. Other ineligibilities have different consequences; some may be temporary, permanent, or dependent on a waiver. A consular officer decides the visa application independently. Petition approval establishes that USCIS approved the employer’s petition, not that every visa-eligibility requirement has been met.
Prepare before reapplying
- Keep the prior refusal sheet and identify the precise concern it describes.
- Gather genuinely new evidence or explain the material change in circumstances.
- Ensure the DS-160, petition information, employment facts, travel history, and interview answers are consistent.
- Pay the new application fee when submitting a new application, as required.
If the interview appointment is delayed
Check both the global table and your post’s instructions
Use the Department of State’s Global Visa Wait Times page and the specific embassy or consulate website. The global page is updated monthly and includes a petition-based H/L/O/P/Q appointment category at participating posts. Its estimates concern interview appointments, not USCIS petition adjudication and not the duration of administrative processing. They vary by location and are not guarantees.

Apply at the appropriate location
Guidance updated July 15, 2026 says nonimmigrant visa applicants should generally seek an appointment in their country of nationality or residence, or at a designated processing post. Check the post’s current instructions before paying or booking. Applying outside those locations can mean longer waits or greater difficulty demonstrating eligibility, and fees may not transfer. Location rules and appointment availability can change, so verify them immediately before making travel or filing arrangements.

Can you keep working or remain in the United States while you wait?
There is no safe one-sentence answer. The result depends on your current nonimmigrant classification, I-94 expiration date, employment authorization, whether an extension or change-of-status petition was timely filed, whether you departed the United States, and what notice USCIS or the consulate issued. A pending petition, an approved petition, a visa stamp, and an authorized period of stay are different things. Before continuing employment, changing jobs, traveling, or remaining after an I-94 date, give the employer’s immigration counsel or another qualified immigration lawyer the complete filing history, notices, I-94, passport and visa records, and a timeline of work and travel.
Common mistakes that make a difficult case worse
- Calling a registration nonselection a petition denial and asking for an appeal that may not exist.
- Submitting duplicate registrations or petitions instead of verifying the official record.
- Using the wrong USCIS form category or service center when checking processing times.
- Treating a processing-time estimate as a deadline or assuming an inquiry guarantees a decision.
- Calling every 221(g) case a final visa denial, or assuming “refused” in CEAC proves permanent ineligibility.
- Ignoring the one-year period for providing information requested after a 221(g) refusal.
- Quoting the “no appeal” language for 214(b) as though it covered every visa refusal.
- Assuming an approved petition guarantees visa issuance or authorizes work by itself.
- Relying on an appointment wait estimate that excludes administrative processing.
- Taking work, travel, or departure action without checking the I-94 and the exact filing timeline.
A practical document checklist
Build one chronological file for the employer and counsel. Include:
- Registration confirmation, selection or nonselection notice, and the petitioner’s USCIS account record.
- Form I-797 receipt, approval, request-for-evidence, or denial notices.
- Receipt number, case-status screenshots, processing-time result, and any e-Request confirmation.
- Passport biographic page, current and prior visas, I-94 record, and prior approval notices.
- DS-160 confirmation, appointment record, refusal sheet, CEAC updates, and proof of every 221(g) submission.
- A dated timeline of employment, status periods, travel, filings, interviews, and government communications.
Send complete copies to the petitioner’s immigration team and ask which person is responsible for the next response. Keep originals and delivery confirmations.
When professional advice is especially important
Obtain case-specific immigration advice promptly when there is a denial, a short response deadline, a possible status violation, an expiring I-94, prior unauthorized employment, a complex travel history, a 221(g) request you cannot satisfy, a refusal ground other than 214(b), or uncertainty about whether you may work or stay. USCIS advises people who are uncertain about forms or applications to consider help from an authorized service provider. A qualified lawyer can evaluate the actual notice, applicable deadline, status history, and available procedure instead of applying a generic “H-1B delay” answer.
Quick Recap
Immediate action plan
- Save the exact notice or refusal sheet and record the date you received it.
- Classify the event as registration, USCIS petition, consular 221(g), 214(b), another refusal ground, or appointment delay.
- Notify the petitioning employer and its immigration counsel.
- Use only the matching USCIS or Department of State status and inquiry tools.
- Meet every stated document or response deadline, preserving proof of submission.
- Before working, traveling, reapplying, or remaining in the United States, obtain advice based on your I-94, status, filings, and dates.
