First determine which process is stalled: USCIS adjudication of the H-1B petition, or visa processing after USCIS approval. The agencies, deadlines and remedies differ. Use the receipt notice to check USCIS Case Status Online, follow any Request for Evidence (RFE) or Notice of Intent to Deny (NOID) exactly, and involve the petitioning employer and qualified immigration counsel before responding to a denial.
Start by identifying the H-1B stage
An H-1B case can be delayed or refused at more than one point. USCIS decides the petition filed by the employer. If USCIS approves it, the worker may still have a separate visa application or entry process handled through the Department of State and a U.S. embassy or consulate. A consular delay is not a USCIS petition delay, even though both may be described casually as an “H-1B delay.”

Do not choose a remedy until you know which row describes your case. A petition denial cannot be fixed by repeatedly checking a consular case, and a consular administrative delay cannot be resolved through a USCIS service request about the petition.
How to check a pending USCIS petition
Use the receipt number and Case Status Online
- Find the USCIS receipt notice supplied to the petitioning employer or its representative.
- Enter the receipt number in USCIS Case Status Online. The status tool is designed for applications, petitions and requests and may show that a case was received, that a notice was sent, that additional evidence was requested or that a decision was issued.
- Save or print the status result and every notice. Keep the date you checked it and give copies to the employer and immigration counsel.
A status message is not a substitute for the actual notice. If the online record and a mailed notice appear inconsistent, use the notice’s instructions and ask counsel to reconcile the discrepancy.

Check processing time for the correct case
Use USCIS’s processing-time tool for the exact form or petition type, the office or service center shown on the receipt notice and the applicable filing category. Selecting a nearby but different category can produce a misleading estimate. USCIS describes these figures as historical measures, not promises that an individual petition will be completed by a particular date.
Workload, staffing, case complexity, the time needed to respond to evidence requests and policy or operational changes can all move an estimate. A case that has passed the displayed range is not automatically lost or unlawfully denied, but it may become eligible for a case inquiry under the current USCIS rules.
Use an inquiry only when the case qualifies
Processing-time pages generally identify a “case inquiry date” or similar threshold. Compare that date with the receipt date before submitting an e-Request or contacting USCIS. An inquiry made too early may be rejected without investigating the petition. Follow the channel USCIS lists for that case type, and retain the confirmation number and the response.

- Ask the employer or attorney who filed the petition to submit the inquiry when the filing account or attorney relationship is required.
- Describe the filing type, receipt number, notice dates and the fact that the posted inquiry date has passed.
- Do not send duplicate inquiries merely because the first response is slow; duplicates can make the record harder to follow.
- If the case has moved, rely on the newest notice rather than an older estimate.
What to do when USCIS sends an RFE or NOID
Read the notice before gathering documents
An RFE asks for additional evidence. A NOID tells the petitioner that USCIS is considering a denial and gives the petitioner an opportunity to address the stated concerns. The notice controls the response deadline, delivery method, page limits, evidence period and submission address or online route. There is no universal response package that safely fits every H-1B case.
- Scan the entire notice and identify every numbered issue, not just the headline concern.
- Write the response deadline in at least two calendars, accounting for the delivery and time-zone instructions in the notice.
- Ask the petitioning employer and immigration counsel to assign an owner for each requested item.
- Collect primary records that answer the officer’s questions and explain any unavailable document rather than silently omitting it.
- Prepare a cover letter that follows the notice’s order, then label exhibits so an officer can match each document to the request.
- Submit exactly as instructed and preserve the courier receipt, upload confirmation, delivery record and a complete copy of what was sent.
USCIS policy materials indicate that officers consider evidence timely when it is submitted according to the notice instructions. That makes proof of a timely, correctly routed submission important if the case later shows an unexpected denial.
Common response mistakes
- Answering only the most convenient question while leaving another numbered request unexplained.
- Sending documents after the deadline without first obtaining advice about whether USCIS permits an extension or late submission.
- Providing contradictory job duties, worksite information, dates or wage information in different exhibits.
- Mailing the response to a general USCIS address instead of the address printed on the notice.
- Allowing the beneficiary to respond alone when the employer is the petitioning party and must verify the employment facts.
A strong response is not necessarily a large response. It is organized, internally consistent and tied to each issue the notice identifies.

If USCIS denies the H-1B petition
Read the complete decision immediately
The denial notice is the controlling document. It should identify the grounds for denial and explain any procedural route that USCIS makes available. Give the complete notice to the petitioner and counsel promptly; a beneficiary often cannot pursue a petition-level challenge independently because the employer filed the petition.

- Every factual and legal reason USCIS gave for the denial.
- The party listed as eligible to file a motion or appeal.
- Whether the decision appears reviewable through an appeal, a motion to reopen, a motion to reconsider, or none of those routes.
- The filing deadline stated in the notice and how USCIS calculates it.
- The required form edition, fee, filing location or online destination.
- Whether the existing record supports the requested remedy or whether a new petition or another immigration option should be evaluated.
Appeal versus motion
These are not interchangeable labels. An appeal asks a higher administrative authority to review the decision. A motion asks the deciding office to reopen the matter with new evidence or reconsider it based on an alleged error in applying the law or facts. USCIS does not make every denial appealable, and filing a motion does not guarantee that the case will be reopened.
Some USCIS materials refer to Form I-290B for certain appeals and motions, but eligibility, the current form edition, fee, filing destination and deadline depend on the particular decision. Because procedural instructions change, verify the current USCIS form and policy guidance and follow the denial notice rather than relying on an old checklist or an unverified summary.

Coordinate the filing
The employer should decide, with qualified immigration counsel, whether to challenge the decision, submit a new petition, change the filing strategy or end the case. Counsel should review standing, the administrative record, the standard of review, evidence that was actually before USCIS and any consequences for the worker’s status or employment. A beneficiary should not send a petition-level appeal in the belief that personal correspondence can replace the petitioner’s filing.
Deadlines can be short. Treat the date printed in the notice as a hard operational deadline, allow time for preparing exhibits and delivery, and obtain written confirmation of filing. If a deadline has already passed, ask counsel whether any narrowly permitted late-filing rule could apply; do not assume that a late appeal or motion will be accepted.
When the petition is approved but the visa is delayed
USCIS approval establishes approval of the petition; it does not itself issue a visa. A worker applying for a visa abroad may face a separate interview, document review or administrative processing at the relevant embassy or consulate. That process is handled under Department of State and consular instructions, not the USCIS petition-status system.

- Confirm that the petition approval notice and its validity dates are available to the applicant and the consular post.
- Check the embassy or consulate’s current instructions for the specific visa application and follow any document or interview request.
- Respond through the channel named by the consular post, keeping copies and delivery confirmations.
- Ask the petitioning employer and counsel to assess how the delay affects the planned start date, status, travel and work authorization.
Do not infer a consular timeline from a USCIS processing-time estimate. Administrative-processing procedures and timelines can vary by post and case, so use current State Department or consular guidance for the location handling the application.

Records to assemble before contacting counsel
- USCIS receipt and approval or denial notices, including every page and enclosure.
- Case Status Online screenshots showing dates and status messages.
- The filed petition and supporting exhibits, if the employer or attorney can release them.
- All RFE, NOID, courier, upload and delivery confirmations.
- Employment details relevant to the filing, such as job title, duties, worksite, start date and the employer contact handling the case.
- For a visa delay, the DS-style application confirmation, interview or document-submission instructions and correspondence from the consular post, as applicable.
Keep personal copies in a secure location and do not alter a notice or submit inconsistent versions of the same fact. Immigration counsel can determine which records belong in a response and which should remain internal.
Questions to ask the employer or immigration lawyer
- Which agency currently has the case, and what is the exact case type?
- Is the case still within USCIS’s posted processing range, or has the inquiry date passed?
- Does the notice request a response, and what is the controlling deadline and delivery method?
- If there is a denial, who has standing to file and what remedy does the decision permit?
- Would a challenge address the stated reason, or would a new petition be more appropriate?
- How could the delay or denial affect the worker’s current status, employment, travel or planned start date?
