Do not assume every withdrawal ends your green-card case. The result depends on which filing was withdrawn, whether the I-140 was approved, how long an associated I-485 has been pending, and whether you have a qualifying new employer. PERM, I-140, and I-485 are separate stages with different rules and deadlines. First preserve every notice, identify the exact withdrawal, calculate the applicable 180-day periods, and obtain case-specific immigration advice before withdrawing an I-485 or changing its underlying basis.
Identify the stage before deciding what the withdrawal means
PERM is the Department of Labor (DOL) labor-certification stage. After DOL certifies the application, the employer submits that certification to U.S. Citizenship and Immigration Services (USCIS) with Form I-140, Immigrant Petition for Alien Workers. An I-485 adjustment application is a later, separate filing. The same employer action can therefore have very different consequences depending on where your case is.

The DOL receipt date is used as the priority date for the labor-certification case. That date does not by itself create an approved I-140 or guarantee that a later employer can use the filing.

- Get the actual notice. Ask the employer or its representative for the withdrawal confirmation and determine whether it names a PERM application, an I-140, an I-485-related filing, or something else. A payroll or termination email is not the same as a USCIS or DOL withdrawal record.
- Build a dated case file. Keep the PERM application and certification, I-140 receipt and approval notices, I-485 receipt notice, every Supplement J filing, USCIS or DOL correspondence, and any revocation notice. Scan the front and back of notices and retain the envelopes when they show mailing dates.
- Write down every relevant date. Record the DOL filing and certification dates, I-140 receipt and approval dates, I-485 receipt date, withdrawal date, and any USCIS revocation date. The 180 days after I-140 approval and the 180 days of I-485 pendency are different clocks.
- Check the case status directly. Use the receipt numbers on USCIS notices and the DOL case information available to the employer or its authorized filer. Do not treat an internal human-resources statement as proof that USCIS has revoked a petition.
- Ask a prospective employer about a genuine permanent offer. A replacement case requires a bona fide job offer and a position that meets the applicable employment-based category. A new employer does not simply take ownership of the old employer’s PERM or I-140.
- Do not withdraw an I-485 on impulse. Before withdrawing it or requesting a transfer to another basis, have counsel review continuity of eligibility, visa availability, the pending application’s history, and the proposed replacement filing.
- Review nonimmigrant status separately. A green-card withdrawal does not answer what happens to H-1B, L-1, EAD, or another status or work authorization. Check the approval notices, expiration dates, and any independent filing requirements for those benefits.
If the employer withdraws a pending PERM
A pending PERM is an employer-side DOL case. DOL’s FLAG system describes withdrawal by the filer from the Case Details page for eligible submitted cases, including cases shown as “In Process.” That system description does not give the sponsored worker control over the employer’s filing; the beneficiary generally cannot stop the employer from requesting withdrawal.
Once the PERM is withdrawn, there is no approved labor certification to submit with an I-140. A different employer normally must assess its own position, recruitment and labor-market test, and filing strategy. Do not assume that changing employers preserves the old PERM filing date or lets the new employer reuse the old case.

Certified PERM that has not yet supported an I-140
DOL states that, after certification, the application is submitted to USCIS with Form I-140 and that the certification expires if it is not submitted within 180 days. The 180-day period is tied to the certification and is not the same as the I-140 or I-485 clocks. If the employer withdraws before filing the I-140, determine whether the certification is still valid, whether the employer will complete the filing, and whether another lawful filing route exists. If the certification has expired or cannot be used, a new employer-sponsored process may be necessary.
If the I-140 is still pending
The principal USCIS material available for this issue addresses withdrawal of an approved employment-based I-140. It does not establish that a pending, unapproved I-140 has the same retention protection. A pending petition may also have unresolved evidentiary, classification, or visa-availability issues.

Confirm whether USCIS has issued a receipt, request for evidence, notice of intent to deny, approval, denial, or revocation. Preserve the complete filing and ask counsel what a withdrawal would mean for any priority date, a new petition, and an associated I-485. Do not describe a pending I-140 as “protected after 180 days” without a rule that actually applies to your facts.

If an approved I-140 is withdrawn
Withdrawal before the applicable 180-day protection
The USCIS decision dated August 30, 2022, quotes 8 C.F.R. § 205.1(a)(3)(iii)(C): an employment-based petition withdrawn less than 180 days after approval generally is automatically revoked, unless an associated adjustment application has already been pending for 180 days or more. Therefore, count both events separately:
- 180 days from the I-140 approval date; and
- 180 days from the I-485 filing date, if an associated I-485 exists.
Meeting one clock can matter even when the other has not been met. If neither threshold applies, do not promise that the approval survives a withdrawal. Any priority-date-retention argument must be checked against the actual revocation ground and the governing regulation; there is no universal answer for every case.

Withdrawal after an applicable 180-day threshold
The same USCIS decision states: “A petition that is withdrawn 180 days or more after its approval, or 180 days or more after the associated adjustment of status applications has been filed, remains approved unless its approval is revoked on other grounds.” This means a voluntary withdrawal alone does not automatically erase the approved petition once the relevant threshold has been reached.

That protection is narrower than it sounds. USCIS also states that the original job offer is rescinded. The approval can remain valid while the employment offer that supported it no longer exists. A new employment-based petition is generally needed to pursue adjustment of status or an immigrant visa, unless an exception such as INA § 204(i) and 8 C.F.R. § 245.25 applies.

When AC21 portability may help
AC21 portability is a separate mechanism from transferring ownership of an I-140. USCIS describes it for certain approved employment-based applicants in the first three preference categories whose I-485 has been pending for at least 180 days. The new permanent job must be in the same or a similar occupational classification as the job in the original petition.
How the portability analysis works
- Approved underlying petition: Portability is generally considered in the context of an approved employment-based petition and a properly filed adjustment application.
- 180 days of I-485 pendency: This clock starts with the I-485 filing, not with I-140 approval.
- Same or similar occupation: Compare duties, occupational classification, skills, educational requirements, and other evidence; a different job title alone does not decide the comparison.
- Permanent, bona fide offer: The new employer must genuinely intend to employ you on a permanent basis under the applicable terms.
- Supplement J: USCIS identifies Form I-485 Supplement J as the request mechanism. Use the current USCIS form and instructions because procedures can change.
Reaching 180 days does not guarantee approval. USCIS can still examine the original petition, the adjustment application, admissibility, visa availability, the new job’s classification, and whether the portability request was properly supported.

Replacement I-140s and transfers to another adjustment basis
A replacement I-140, an adjustment-basis transfer, priority-date retention, and AC21 portability are related but distinct concepts. USCIS Policy Manual guidance explains that a replacement basis must satisfy continuity requirements and that, where the rule applies, the new basis must be properly filed and designated before the original supporting petition is withdrawn, denied, or revoked. Transfer requests also have their own eligibility and visa-availability requirements and can be discretionary.
This is why withdrawing an I-485 merely because an employer withdrew an I-140 can be harmful. Withdrawal may affect the ability to transfer the application, preserve continuity, or use a replacement basis. Have counsel evaluate the sequence of filings and notices before anyone asks USCIS to change the underlying basis.
Common mistakes and safer alternatives

A practical decision checklist
- Which filing was withdrawn: PERM, pending I-140, approved I-140, or something connected to the I-485?
- What are the exact approval and filing dates?
- Has the I-485 been pending for at least 180 days?
- Is there an approved I-140, and has USCIS issued any revocation or other adverse notice?
- Does a prospective new job appear to be in the same or similar occupational classification?
- Will the new employer sign a bona fide permanent offer and support the required petition or Supplement J?
- Is a replacement basis or adjustment transfer available under current USCIS rules and visa availability?
- What independent nonimmigrant status or work authorization remains valid?
The safest course is to preserve the record, calculate each clock from its correct starting event, and obtain qualified U.S. immigration advice before taking an irreversible step.
