Do not move the bitcoin, erase records, or assume an exchange restriction is a government seizure. Save every notice and account record, identify who imposed the restriction and under what legal instrument, and contact a lawyer who handles asset forfeiture and digital assets in the jurisdiction named in the papers. Deadlines and remedies depend on the country, the type of proceeding, where the bitcoin is held, and the exact notice you received.
First determine what “frozen” means
People use “frozen” for several different events. The response is different in each case, so start by identifying the actor and the legal basis.

Ask the provider in writing whether the restriction is an internal account action, a response to a warrant, a court order, or another request. Ask which authority issued the process and whether disclosure is legally restricted. Keep the request factual; do not speculate about the case or make substantive statements to investigators before counsel advises you.

- Preserve the complete notice. Save the original email or message, every attachment, the envelope or delivery record, the date and time received, case or reference numbers, and contact details. Export a PDF and keep an unchanged copy in a secure location.
- Record the account and wallet state. Capture statements, balances, deposit and withdrawal history, transaction IDs, wallet addresses, and screenshots showing the restriction. Note the date and time of each capture.
- Gather ownership evidence. Collect purchase records, exchange receipts, bank or card records, tax files, loan or gift documents, and agreements showing who acquired or beneficially owns the bitcoin. Preserve records for any joint, corporate, trust, or estate ownership.
- Preserve communications and devices. Keep correspondence with the exchange, counterparties, and investigators. Do not delete messages, reset phones or computers, wipe wallets, or alter logs that could relate to the case. Make forensic copies only with professional advice so you do not change evidence.
- Do not move or conceal assets. Do not transfer bitcoin, sweep a wallet, hide keys, or ask someone else to hold the coins to defeat an order. Such steps can create additional legal exposure and may destroy evidence.
- Call qualified counsel immediately. Find a lawyer experienced in asset forfeiture and digital assets in the jurisdiction identified in the documents. Give counsel the original papers, your timeline, and every stated deadline.
- Follow the notice exactly. If it gives a claim, petition, appeal, or contact procedure, have counsel verify the form, signature or oath requirements, filing location, service method, and deadline before submitting anything.
Why custody location changes the procedure
Bitcoin held by an exchange or other U.S. provider
The U.S. Department of Justice Asset Forfeiture Policy Manual (2025), Chapter 4, says an agency should obtain and serve a seizure warrant on a U.S.-based virtual asset service provider holding the cryptocurrency. That is a description of agency practice, not a complete statement of every federal or state remedy. Self-custodied bitcoin in the United States
The same DOJ chapter describes obtaining a seizure warrant and serving the owner or the owner’s counsel for self-custodied cryptocurrency. A notice may identify particular addresses, devices, or private keys. Do not surrender a device or disclose credentials informally; ask counsel how to comply with the warrant while protecting privileged information and unrelated assets. Foreign-located providers
The DOJ manual treats foreign-located virtual asset service providers separately and notes that international legal assistance may be necessary. A provider’s country, the location of its records, and the place where the bitcoin is controlled can all affect service and available remedies. U.S. federal civil forfeiture: claims and notices
In a U.S. federal civil forfeiture matter, filing a claim contests the seizure and requests court proceedings. The official Forfeiture.gov FAQ says a claim must describe the seized property, identify the claimant’s interest, and be sworn. A defective or late filing can jeopardize the challenge, so use the instructions in your actual notice and have counsel review the completed claim. Forfeiture.gov claim FAQ

Title 18, United States Code, section 983 contains federal civil-forfeiture notice and claim rules. The applicable route and timing depend on the process and the notice served; there is no safe universal number of days to import from another case. Read the current statutory text together with the agency’s notice and confirm the calculation with counsel. 18 U.S.C. § 983 (2024)

What a claim should establish
- Property: identify the bitcoin, wallet, account, transaction, or other description used in the notice.
- Interest: explain your ownership or other legal interest and attach records that support it.
- Verification: make the sworn statement and signature required by the instructions.
- Timeliness and service: file through the specified channel and retain proof that the agency received it.
A filed claim does not guarantee a hearing, release, or return. The government may continue a forfeiture case, and other claimants or criminal proceedings can affect the result. Your lawyer can determine whether additional petitions, an answer, or a separate defense is required.
United Kingdom example: crypto wallet freezing and forfeiture
The UK Home Office circular 005/2024 summarizes cryptoasset-specific civil-forfeiture provisions added to the Proceeds of Crime Act 2002 by the Economic Crime and Corporate Transparency Act 2023. In the regime described there, a judicial authority can make a crypto wallet freezing order. An affected person may apply to vary, set aside, or recall that order. The circular also describes possible exclusions for reasonable living expenses, continuing a business, or paying legal expenses, subject to statutory conditions and the court’s decision. For the forfeiture decisions covered by that circular, an appeal must be lodged within 30 days of the court order. That 30-day period is specific to the UK provisions summarized in the circular; it is not a deadline for U.S. cases or every UK cryptoasset dispute. Deadlines: why the notice controls
Do not rely on a blog post, a friend’s case, or a deadline printed on a different form. Timing can turn on whether the matter is an administrative restraint, a warrant, civil forfeiture, criminal confiscation, or an appeal; on the jurisdiction; and on when and how notice was served. Create a written timeline with:

- the date and method of every notice or order;
- the stated response deadline and time zone;
- any hearing date, claim number, or court address;
- dates when an exchange or agency denied access; and
- your lawyer’s confirmation of the filing and service method.
If the notice is incomplete, illegible, or arrives after an apparent deadline, send it to counsel anyway. A lawyer can investigate service, extensions, and available relief; do not assume that silence or a missed date means the bitcoin is permanently lost.
Evidence that helps establish ownership
Ownership evidence should connect the person named in the notice to the specific bitcoin. Build a chronological file rather than sending isolated screenshots:
- exchange account-opening and identity records;
- deposit, purchase, withdrawal, and conversion statements;
- blockchain transaction IDs and the addresses involved;
- bank statements or invoices showing the source of funds;
- tax returns, accounting ledgers, and business records;
- inheritance, gift, loan, partnership, trust, or custody agreements; and
- communications explaining transfers between your exchange account and self-custody wallet.
Keep the originals and a read-only backup. Do not edit timestamps, rename files in a way that obscures their origin, or combine records so that metadata is lost. Tell counsel if another person, company, creditor, spouse, or estate may assert an interest.

Provider restriction versus government action
If the exchange says it is an internal restriction
Ask for the contractual or policy basis, the precise functions disabled, the review process, and the documents needed for reinstatement. Keep the exchange conversation separate from any law-enforcement communication. An internal review may be resolved through the provider’s complaint or legal channel, but do not assume that completing a routine form will answer a pending warrant or forfeiture case.

If the exchange cites a warrant or court order
Request a copy or the identifying details the provider may lawfully provide, then send them to counsel. Do not pressure staff to bypass the restriction or create a new account to avoid it. The order may cover only specified assets or accounts, and counsel must interpret its scope.
If agents contact you directly
Be polite, preserve the contact details, and ask to speak through your lawyer before making substantive statements or consenting to a search. Do not lie, destroy records, or obstruct an order. Your lawyer can explain what the warrant requires and whether you should provide access, a written statement, or nothing beyond identifying information.

A temporary freeze or seizure is not the same as a final forfeiture order. Civil forfeiture generally proceeds against the property and uses a claim process; criminal confiscation is connected to a criminal case and can involve different parties, standards, and remedies. The labels on your documents matter more than a provider’s shorthand. Ask counsel to identify whether you are facing:

Do not promise yourself a particular result. Return, release, settlement, or continued forfeiture depends on the evidence, the legal basis, competing claims, and the court or agency decision.

Common mistakes that make a case harder
- Assuming every freeze is a seizure: first identify the actor and instrument.
- Waiting for the provider to “sort it out”: notices can contain short, case-specific deadlines.
- Moving coins or hiding keys: this can violate an order and compromise evidence.
- Deleting old wallets or messages: missing records weaken the ownership timeline.
- Submitting an unsworn or incomplete claim: federal claim instructions may require a property description, interest, and sworn verification.
- Using another jurisdiction’s deadline: the UK 30-day appeal period does not govern U.S. proceedings, and U.S. rules do not govern UK orders.
- Treating a general article as legal advice: only a lawyer reviewing the actual documents can assess your options.
Can seized bitcoin be recovered?
Possibly, but no general article can predict recovery. The answer depends on whether the restriction was mistaken or temporary, whether you can prove a lawful ownership interest, what the warrant or order covers, whether another claimant is involved, and whether you meet the procedural requirements. A valid claim or application preserves an opportunity to contest the action; it does not guarantee that the bitcoin will be released.
Give counsel the complete record immediately and follow the court or agency process in the notice. Hardware wallets, seed backups, forensic software, and similar tools cannot release bitcoin that is subject to lawful process, and changing custody can create additional problems.
What to hand your lawyer
- The original notice, order, warrant, or provider message with delivery evidence.
- A one-page timeline of access changes, contacts, and deadlines.
- All account statements, wallet addresses, transaction IDs, and ownership documents.
- Names and contact details for exchanges, custodians, counterparties, and agencies.
- Any prior legal, tax, business, inheritance, or lending documents tied to the bitcoin.
- A list of devices and accounts that may contain relevant records, without altering them.
Ask counsel to confirm the jurisdiction, the type of proceeding, the exact response required, and the filing and service proof you should retain. Those answers must come from your documents and applicable law, not from a generic deadline.
