Slow down immediately, post a dedicated lookout, and give the whale a wide, predictable berth. Do not chase, cross its path, drive through feeding bubbles, or put your boat between a mother and calf. If the animal is injured, dead, or entangled, keep the engine off at a safe distance and report it rather than attempting a rescue.

Your first 60 seconds

  1. Reduce speed. Move to idle or no-wake speed as soon as you see a spout, back, tail, breach, unusual surface ripple, or a concentration of feeding birds. If you are still transiting toward the area, proceed at 10 knots or less while marine animals may be nearby, unless a stricter local restriction applies.
  2. Post a lookout. Have one person watch continuously ahead, astern, and to both sides. A whale that dives has not necessarily left; some remain underwater for 20 minutes or more, and additional whales may be nearby.
  3. Identify the animal if you can without approaching. A North Atlantic right whale triggers a larger legally required buffer. If you cannot identify the species or judge distance reliably, use the more conservative separation.
  4. Hold a steady course away from the whale. Do not turn toward it for a closer look, surround it, leapfrog ahead of it, or cut across its direction of travel.
  5. Keep fishing gear out of the area. Do not cast, troll, or drive through a humpback’s bubble cloud or ring; it can mark a whale about to surface.
  6. Stop and report a problem animal. For an entangled, injured, or dead whale, put the engine in neutral or shut it off when safe, remain aboard, and call the appropriate authorities.

NOAA’s vessel-safety advice summarizes the response this way: Did you see a spout, a tail, or a breaching whale? Slow down and post a lookout. Read the full guidance at NOAA Fisheries’ vessel-operation guidance.

How far away must you stay?

Distance rules differ by species and by whether the figure is a legal minimum or a wildlife-viewing recommendation. The right-whale requirement is binding in all U.S. waters, including Massachusetts waters. Other figures are NOAA viewing guidance; a local management zone can impose a stricter limit.

Situation Distance or speed What it means on the water
North Atlantic right whale At least 500 yards (1,500 feet) Legal minimum throughout U.S. waters. Stay outside the radius even if the whale is moving toward you; alter course early and do not attempt to maintain a close viewing position.
Other large whales — national NOAA guidance At least 100 yards Recommended minimum for ordinary viewing unless another rule is stricter. Treat it as a floor, not a target for approaching.
Other whales — New England regional guidance 100–600 feet Regional guidance from NOAA. Because the range varies with circumstances and the national page uses 100 yards, use the larger separation when species, distance, or conditions are uncertain.
Animals possibly nearby but not yet seen 10 knots or less NOAA regional operating advice when signs such as spouts or feeding activity suggest whales may be close. A separate 10-knot legal requirement applies to vessels 65 feet or longer in designated areas.
Whale already visible No-wake speed Operate slowly enough to avoid creating a hazardous wake and be ready to put the engine in neutral.
Intentional viewing of an individual or group 30 minutes or less NOAA national guidance recommends limiting observation time before leaving the area. An unexpected encounter still requires the same distance and maneuvering precautions.

See NOAA Fisheries’ Marine Life Viewing Guidelines for the national distances and operating language. The New England context is explained in NOAA’s regional whale-viewing guidance.

Why a whale can seem to appear out of nowhere

Whales surface unpredictably, and glare, chop, fog, rain, and a low sun can hide a back or spout until the animal is close. A vessel of any size can strike a whale. A single sighting also does not prove that the area is clear: whales may be traveling below the surface or feeding in a loose group. Keep the lookout in place after the last visible dive and resume normal speed only when you have safely cleared the area and checked current restrictions.

Surface clues to scan for

  • A vertical spout or misty blow, sometimes visible before the body.
  • A dark back, dorsal fin, fluke, or rolling movement.
  • A breach, tail slap, or repeated ripple in an otherwise calm patch.
  • Seabirds circling or diving over a concentrated patch of water, which can indicate bait and a feeding whale below.
  • Humpback bubble clouds or rings, which can precede a lunge at the surface.

Safe maneuvering once you have sighted the whale

Stay behind the whale’s direction of travel

Determine the whale’s heading from successive surfacings and keep your vessel out of its projected path. If you must pass, do so behind the animal, never across its bow. Make gradual course changes that the whale and nearby boats can anticipate. Do not accelerate to get ahead of it or make repeated approaches for photographs.

Let the whale pass your boat

If a whale is approaching, take the engine out of gear and allow it to move past. Maintain a lookout for a second animal and for the whale surfacing on the opposite side. Do not turn the propeller while the animal is close enough that a sudden movement could cause a strike.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Never create a close-quarters encounter

Do not chase, surround, box in, or “leapfrog” a whale by repeatedly running ahead and waiting for it to surface. Never position a boat between a mother and calf. These actions can separate animals, alter feeding or resting behavior, and leave no safe escape route.

Do not enter a feeding bubble cloud

A humpback may be preparing to lunge upward inside or beside a bubble net. Keep clear of the bubbles and the surrounding birds, and do not cast or troll there. The whale can surface with little warning, so treat the entire feature as a moving hazard rather than a stationary landmark.

Use the engine only as needed

NOAA’s general instruction is to slow to no-wake speed and put the engine in neutral when whales approach to pass. Steering response decreases in neutral, so choose a safe course and speed before the animal reaches the close-quarters area.

If the whale is injured, dead, or entangled

Do not enter the water, approach the animal, attach a line, cut fishing gear, or attempt to tow it. NOAA explicitly says, Never enter the water or attempt to rescue on your own. An entangled whale can move suddenly, and loose line or gear can endanger both the animal and a person.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Keep the boat well clear and maintain a continuous watch so you can describe the whale’s location and movement.
  2. Reduce propulsion; turn off the engine when doing so will not put your boat in danger or cause it to drift into the animal.
  3. Call the NOAA New England/Mid-Atlantic reporting hotline at 866-755-6622, or hail the U.S. Coast Guard on VHF Channel 16.
  4. For an entangled animal, Massachusetts also lists the Marine Animal Entanglement Hotline, 800-900-3622. The state’s clean-boating information is at Mass.gov’s Simple Steps to Clean Boating in Massachusetts.
  5. Give responders your GPS position or the nearest landmark, time of observation, whale description, heading, and any visible gear. Stay available for follow-up questions, but do not remain so close that your presence changes the whale’s behavior.

Reporting a North Atlantic right-whale sighting

A sighting report can warn other mariners even when the whale appears healthy. Use 866-755-6622 or Coast Guard VHF Channel 16, and consider submitting the location through Whale Alert, which NOAA and Massachusetts identify as a sighting and alert resource. Report only after you have reached a safe position; operating the boat or using a phone must not distract the lookout.

Check Massachusetts and NOAA notices before departure

Whale-management zones, temporary slow zones, and routing restrictions can change by location and date. NOAA’s Massachusetts advisory dated April 30, 2021 described seasonal measures that were correct at that time, but its old date ranges should not be treated as current rules. Before leaving the dock:

  • Review current NOAA whale advisories and the Massachusetts boating information for your planned route.
  • Check navigation notices for designated speed zones; a rule applying to vessels 65 feet or longer may not apply to a smaller recreational boat, while a separate state or local restriction may.
  • Load the NOAA and Coast Guard phone and radio contacts into your boat’s communications plan.
  • Open Whale Alert or another current notice source before departure, then brief every person aboard on the lookout, engine-neutral, and no-rescue procedures.
  • Confirm that your chartplotter, GPS, and depth or weather displays will not distract the person assigned to watch for surfacing animals.

For a handheld marine VHF user, Channel 16 is the Coast Guard calling and distress channel; a radio is useful when cellular coverage is weak, but you can also report by phone or through Whale Alert. No purchase is required to follow the safety steps.

What to remember in changing conditions

Fog, darkness, heavy rain, glare, and rough water reduce detection distance. In those conditions, slow earlier, increase the number of people scanning, and avoid assuming that a quiet surface is an empty one. If visibility becomes too poor to maintain a safe lookout, leave the area at a prudent speed rather than continuing to search for whales.

The governing principle is simple: give the animal time and space to surface and change course. A cautious, predictable boat protects the whale, everyone aboard, and the other mariners who may be responding to the same sighting.
