If police stop you at a peaceful protest in India, stay calm, do not physically resist, and ask clearly whether you are free to leave, being detained, or formally arrested. Ask where you are being taken, which authority is responsible, and the grounds being given. A short police stop and a formal arrest do not necessarily trigger identical procedures; the word “detention” is not defined as a single general status in the Bharatiya Nagarik Suraksha Sanhita (BNSS). The Indian Express explains the distinction in the protest context.
If you are arrested, request a lawyer, ask police to notify a trusted person, obtain the arrest details and memo, report medical needs, and insist on prompt production before a magistrate. The BNSS and Article 22 of the Constitution provide important safeguards, but a peaceful protest does not create blanket immunity from arrest. Lawfulness depends on the facts, the alleged offence, the state in which events occur and any special legislation. This is general information, not individual legal advice.
What to do in the first minutes
- Keep your body language non-confrontational. Do not push, run, threaten officers or try to pull away. Physical resistance can create additional allegations and may make it harder for a lawyer to establish what happened.
- Ask your status in plain language. Say, “Am I free to leave, or am I being detained or arrested?” Then ask which police station, unit or other authority is taking you and why. Do not assume that being placed in a police vehicle, held at a cordon or taken to a station automatically means the same thing as a formal arrest.
- If officers say you are arrested, ask for the grounds. Request the arrest memo and ask that the time and place of arrest be recorded accurately. The BNSS requires arrest documentation and identification by the arresting officers. Read the official BNSS text.
- Name a person to be informed. Give the name and contact details of a relative, friend or another trusted person and ask police to notify them about the arrest and place of custody. If a family member is not available to attest the arrest memo, the BNSS provides for the arrested person to nominate someone for notification.
- Request a lawyer immediately. State that you want to consult an advocate and ask how the lawyer can meet you. Under BNSS section 38, an arrested person may meet an advocate of choice during interrogation, although the statutory wording does not require the advocate to remain throughout every question.
- Protect your health. Tell officers at once about injuries, illness, disability, medication, pregnancy or other urgent needs. Ask for medical attention and for visible injuries or symptoms to be recorded.
Speak truthfully, but do not guess, volunteer a long narrative or sign a document you do not understand. Never sign a blank, incomplete or inaccurate statement. Ask for time to read documents and for legal advice before accepting disputed wording.
Work out whether this is a stop, detention or arrest
Terminology matters because formal arrest safeguards attach to an arrest, while a temporary police action may be handled differently. The available protest-specific explanation notes that Indian law does not provide one universal statutory definition of “detention” covering every situation. Write down the sequence as soon as it is safe: where you were standing, what officers said, when restraints or a vehicle were used, who witnessed it and where you were taken. If your phone is inaccessible, give the information to counsel or your trusted contact from memory. Do not delete messages, edit photographs or coordinate a false account.
Arrest safeguards under the BNSS
The BNSS is India’s current general criminal-procedure statute for arrests. Its protections do not mean police can never arrest a protester; they set procedures and limits that officers and courts must follow.
When arrest is not automatic
Section 35 covers police arrest powers and notice-of-appearance provisions. In situations covered by the section where arrest is not required, police may issue a notice to appear instead. Whether that option applies depends on the alleged offence and facts. Ask a lawyer to assess the notice, its deadline and the consequences of non-compliance rather than ignoring it.

Identification and the arrest memo
Section 36 requires officers making an arrest to carry clear identification and prepare an arrest memo. The memo is to be attested by a witness and countersigned by the arrested person. Check that the date, time, place and identifying details are correct. If you dispute an entry, tell the officer and lawyer; do not sign a blank page. Ask for a copy or for counsel to record what was supplied.
Information and notification
Sections 47 and 48 concern information about the grounds of arrest and notice to a person nominated by the arrested person. The Supreme Court’s directions in D.K. Basu v. State of West Bengal also require safeguards around informing a friend or relative and maintaining custody records. The Ministry of Home Affairs reproduces those directions, including this requirement: “The person arrested must be made aware of this right to have someone informed of his arrest or detention as soon as he is put under arrest or is detained.” See the MHA-hosted directions.
Access to an advocate during interrogation
BNSS section 38 states: “When any person is arrested and interrogated by the police, he shall be entitled to meet an advocate of his choice during interrogation, though not throughout interrogation.” This gives you a basis to request access to counsel, but it is not a promise that the lawyer will sit beside you for every moment of questioning. Tell counsel if access was refused, delayed or limited.

Care for health and safety
Section 56 requires reasonable care for the health and safety of an arrested person. Tell the custody authority about medication schedules, allergies, injuries or mental-health risks before they become emergencies. Ask that treatment, examinations and injuries be entered in the record. The D.K. Basu directions contain related medical-examination and documentation safeguards.
Your constitutional protections
Article 22 protects an arrested person’s right to be informed of the grounds of arrest, to consult and be defended by a legal practitioner, and to be produced before a magistrate within 24 hours, subject to constitutional exceptions. A peaceful assembly can still be investigated for alleged offences, and special laws or preventive-detention provisions may change the procedure. Do not describe Article 22 as immunity from arrest; use it to demand the information, legal access and court production it provides.
A lawyer should check the exact accusation, the sections invoked, whether an FIR exists, whether a notice rather than arrest was legally appropriate, and whether any special statute is being used. Ask counsel to preserve the precise arrest time because it determines when the production deadline runs.

The 24-hour rule and what happens next
BNSS sections 57 and 58 require an arrested person to be taken before the appropriate magistrate or officer without unnecessary delay and restrict detention beyond 24 hours without further lawful authority. The 24 hours are measured from the arrest, excluding the travel time necessary to reach the magistrate. This is a procedural limit, not an unconditional promise that you will walk free at the end of the period: a magistrate may authorize further detention under the law. Sections 58 and 187 of the BNSS are in the official statute.
- Record the exact arrest time and location, not merely the time you reached a station.
- Ask when and where you will be produced before a magistrate.
- Tell your lawyer about any gap, delay, change of location or claim that the arrest occurred earlier than officers state.
- At production, explain injuries, denial of medication, inability to contact a trusted person, lack of grounds, or any document you were pressured to sign.
- Read the remand application and order with counsel. Further custody requires judicial authorization; it is not created simply by police saying that more time is needed.
Getting a lawyer quickly
Choose help based on what can happen immediately, not on a distant reputation. The most useful lawyer is one who can reach the station or court, understands criminal procedure in the relevant state, communicates with your family, and can verify the custody and remand records.

Official police guidance states that free legal aid is available in police custody and at first production or remand for eligible people. A family member or trusted person should contact the relevant State or District Legal Services Authority and ask for the local criminal legal-aid route. The Meghalaya Police constitutional-rights page summarizes these protections and legal-aid access; procedures and contact points differ by state.

What to document and preserve
- Identity and timeline: your name as recorded, arrest or pickup time, station, vehicle details, officer names or badge numbers and every transfer.
- Case information: FIR number, alleged sections, notices, arrest memo, seizure list, medical papers and remand documents. Ask counsel how to obtain copies if police do not provide them immediately.
- Witnesses and media: names and contact details of people who saw the stop, arrest, injuries or property seizure. Preserve original photographs or video; do not crop, overwrite or manufacture context.
- Property and phone access: list the phone, identification, medication, cash and other items taken. If the device is locked or unavailable, tell counsel what messages, recordings or location data may be on it and when access was lost.
- Health records: request examination and note symptoms, treatment, prescriptions and whether injuries were photographed or entered in a register.
Do not hide evidence, delete communications or ask witnesses to synchronize stories. A truthful, contemporaneous record is safer than an improvised collective account.
If you are released without charge or on a notice
Release does not end the matter. Keep every notice, receipt and property-return record. Ask counsel whether you must appear on a stated date, whether a case or FIR has been registered and whether conditions apply. Comply with a valid notice while challenging it through the appropriate legal route; ignoring it can create avoidable complications.
Situations requiring special legal review
General BNSS guidance may not cover preventive detention, special security legislation, children, women, people with disabilities or other protected groups. Those categories can involve additional safeguards, different authorities or different timelines. The available materials do not establish a complete, current state-by-state legal-aid directory or one nationwide protest-arrest helpline. Treat the absence of a listed procedure as an information gap, not proof that no protection exists.

A compact checklist for a trusted person outside
- Write down the detainee’s full name, age, phone number, protest location and the last confirmed time and place.
- Call or visit the likely police station and ask whether the person is there, under what status, and under which case or sections.
- Contact a criminal lawyer or the State/District Legal Services Authority; provide the exact timeline and any medical risks.
- Preserve messages, photographs, live-location records and witness contacts without editing them.
- Ask counsel to verify the arrest memo, grounds, notification, medical examination, 24-hour production deadline and any remand order.
- Do not obstruct officers, threaten officials, publish an unverified accusation or coordinate a false narrative while trying to help.
The safest approach is calm cooperation with lawful instructions, clear requests for status and counsel, accurate records, prompt medical care and immediate local legal assistance. A lawyer who can inspect the actual arrest and remand papers is better placed than any general checklist to advise what should happen next.
