If the fish is not legal to keep, stop retaining it and return it promptly to the water where it was caught if it is alive. Rules differ by location, species, waterbody, season, and fishery, so check the current local regulation. If the fish has died or is already in your possession, do not assume you may keep or transport it; contact the responsible fisheries or wildlife agency for instructions.
What to do right now
- Stop keeping or moving the fish while you check the rule. Do not delay a required release to take photos or seek informal advice. If you are still at the water, avoid moving the fish elsewhere while deciding what to do.
- If it is alive and must be released, return it promptly to the water where it was caught. Handle it as little as possible and release it in a way that causes the least harm. Do not keep it aside while you look for an answer if the applicable rule requires immediate release.
- If it has died or is already in a cooler, do not assume possession is allowed. Check the local rule and contact the relevant agency for direction before keeping, eating, selling, or transporting it.
- If you may have violated a rule or the species may be protected, contact the responsible agency promptly. Explain what happened and follow its instructions. If you are unsure whether a report is required, ask the agency rather than assuming there is one universal reporting process.
Canada’s Ontario Fishery Regulations, 2007, section 12, says a prohibited fish “shall immediately return the fish to the waters from which it was caught” and, if alive, release it “in a manner that causes the least harm to that fish.” The regulation is current on the Justice Laws site through September 21, 2026, and was last amended March 1, 2025. This is an Ontario regulation, not a rule for every jurisdiction: Ontario Fishery Regulations, 2007.
The key distinction is between a fish that is alive and subject to a required release, and one that is dead or has already been retained or moved. For the first situation, prompt, low-harm release is the practical priority. For the second, do not decide that you may keep it just because it is no longer alive or because it is already in your possession. Ask the regulator responsible for that place and fishery what the local rule requires.
Why the exact local rule matters
“Undersized” and “protected” do not have one universal meaning. A fish may be illegal to retain because it falls below a minimum size, is protected, was caught during a closed season, or would put you over a retention limit. These are different rule triggers, and the applicable rule may depend on the province or state, management zone, species, season, fishery, and individual waterbody. Exceptions and special provisions may also apply.

Check the current official rules for the place where you caught the fish and identify the species as accurately as you can. Ontario’s provincial guidance treats protected, undersized, closed-season, and over-limit fish as fish that must be released immediately: Ontario fishing rules. This is a useful example of the kinds of cases that can require release, but Ontario guidance does not establish the rule for another location.
If identification is uncertain, consult an official species guide or ask the agency before making a retention decision; do not use a guess as permission to keep it. A general summary, an old regulation, or a rule for a nearby waterbody may not cover the exact fishery. Look for the current version of the official regulation and any local zone or waterbody provisions. If the wording is unclear, contact the agency that administers that water rather than relying on an informal answer.
Make sure you are checking the rule for the place the fish was caught, not merely where you live or where you plan to take it. A length threshold, protected status, closed season, or retention limit can differ across areas. The relevant question is not simply “Is this species legal to keep?” but “May I retain this species, at this size, from this waterbody, at this time, under this fishery’s rules?”

- Keep the fish wet and minimize the time it is out of the water.
- When feasible, unhook it in the water and handle it as little as possible.
- If it has swallowed the hook, do not tear the hook out. The U.S. Fish & Wildlife Service advises cutting the line as close to the mouth as possible.
- Follow species-specific official instructions when available; no single handling method is right for every species.
The U.S. Fish & Wildlife Service advises anglers to release undersized fish quickly in A Guide to Fishing for the First Time: “If you catch a fish that is under the legal or minimum size or that you do not want to keep, release it quickly.” The same guide says: “If the fish has swallowed the hook, do not tear the hook out. Simply cut the line as close to the mouth as possible.” These instructions support quick, careful handling; they should not be read as a substitute for any species-specific agency direction.

A rubberized net, wet hands or gloves, and suitable dehooking pliers may help with ordinary release handling. NOAA also discusses circle and barbless hooks as catch-and-release gear: NOAA Fisheries. Such equipment is optional practical gear, not a solution to a legal problem. Buying or using a particular tool does not make unlawful retention legal, and no gear can guarantee a fish will survive release. Avoid assuming that one tool or handling approach suits every protected species.
Do not prolong the fish’s time out of water to take a photograph, measure it again, or wait for informal advice when the current rule calls for release. If you need to establish what happened after an accidental retention, make a factual note once doing so will not delay a required release, and ask the agency whether it needs further information.
If the fish is dead or you have already taken it away
Do not assume that death changes the retention rule. Hawaiʻi’s Division of Aquatic Resources says, “No, it is unlawful to take or possess undersized or out-of-season fish,” and recommends releasing the fish even if it dies before release. That is Hawaiʻi-specific guidance, not a nationwide statement: Hawaiʻi Division of Aquatic Resources FAQs.
Elsewhere, the applicable local law controls. If the fish is dead, in a cooler, or has been transported from the capture site, contact the regulator responsible for that fishery and ask what to do. Do not keep, eat, sell, or transport it unless the agency confirms that the applicable rule permits it. The process for a recreational catch already retained is not the same everywhere, so an official answer is safer than assuming a general procedure.

Be clear about what has already happened when you contact the agency: whether the fish is alive or dead, whether it remains at the capture site, and whether it has been moved or retained. These details help the regulator understand that this is no longer a simple release question. Do not move it again, dispose of it, or treat it as ordinary legal catch based on assumptions while waiting for direction.
If the fish is still alive but you have already transported it, the usual advice to return a fish promptly to its capture waters may not fully answer what to do in that situation. Contact the local agency for instructions rather than choosing a different location or treating transport as permission to keep it. The cited rules do not establish one universal process for every recreational angler in every jurisdiction.
When and how to report what happened
Reporting obligations depend on the jurisdiction and fishery. Hawaiʻi’s agency recommends reporting violations to its Division of Conservation and Resources Enforcement (DOCARE). NOAA’s cited mandatory reporting requirements concern accidental protected-species bycatch in specified commercial fisheries; they should not be treated as a reporting duty for every recreational angler.

Report promptly when the local authority recommends or requires it, but do not assume that a commercial-fishery reporting rule applies to recreational fishing. NOAA’s cited requirements concern particular protected-species bycatch in specified commercial fisheries, which is a different situation from an ordinary recreational catch. The agency responsible for your location can tell you whether a reporting channel or other action applies to your case.
How to check before your next catch
- Open the current official fishing regulations for your state, province, country, or territory.
- Find the rules for the specific waterbody or management zone, then check the species’ size, season, protected status, and retention limits.
- Read any exceptions or special provisions that apply to that species or location.
- If the fish is hard to identify or a rule is unclear, contact the agency responsible for that water before deciding to keep a catch.
Rules can change, and a broad regional summary may not cover a particular lake, river, or marine area. The controlling answer is the current rule for the exact place and fish—not a rule from another jurisdiction. Save or bookmark the official source you used so you can confirm that it is current when you fish again.
Before retaining a fish, check each part of the decision: identification, minimum or maximum size if applicable, open or closed season, protected status, and how the catch affects any retention limit. Do not assume that satisfying one requirement means all the others are satisfied. If an exception seems relevant, read its exact conditions in the official rule or ask the regulator; do not infer an exception from a summary that leaves out details.
Frequently Asked Questions
What should I do if I accidentally kept an undersized fish?
Check the current rule for the exact location and species. If the fish is alive and the rule requires release, return it promptly to its capture waters and handle it as little as possible. If it is dead or already retained, do not assume you may keep or transport it; contact the local fisheries or wildlife agency for direction.

Can I keep a protected fish if I caught it by accident?
Do not assume that accidental capture makes it legal to retain. The applicable rules depend on location, species, waterbody, season, and fishery. Check the official local regulation and contact the responsible agency if the fish is already retained or if you are unsure what to do.
Is an undersized fish legal to keep if it dies before I release it?
Not necessarily. Hawaiʻi’s Division of Aquatic Resources specifically says possession of undersized or out-of-season fish is unlawful there even if the fish dies before release. That example is Hawaiʻi-specific; elsewhere, ask the local regulator rather than assuming death changes the rule.
Should I report an accidental catch of a protected fish?
Reporting requirements are not universal. Hawaiʻi recommends reporting violations to DOCARE, while NOAA’s cited mandatory reporting rules concern specified protected-species bycatch in commercial fisheries. Check the official reporting channel for the authority responsible for your location and fishery.

What if I swallowed the hook while trying to release the fish?
If the fish swallowed the hook, the U.S. Fish & Wildlife Service advises not to tear the hook out; cut the line as close to the mouth as possible. Keep the fish wet, minimize time out of water, and follow applicable species-specific agency guidance.
The Bottom Line
If a fish may be illegal to retain, act promptly: release it in its capture waters if it is alive and the rule requires release, with as little handling and air exposure as possible. Check the current rule for the exact species and waterbody. If it is dead, already retained, or transported—or if reporting is unclear—contact the responsible local agency and follow its instructions rather than assuming possession is allowed.
