If the U.S. Department of Justice (DOJ) says it will not investigate your civil rights complaint, read the notice closely, follow any referral or request for information, and promptly ask a lawyer whether you have a personal claim and a deadline. A DOJ complaint is a request for government review—not a lawsuit filed on your behalf—and the DOJ says submitting one does not pause applicable limitation periods.
What does it mean when the DOJ declines to investigate?
A notice that the DOJ Civil Rights Division will not investigate means the Division is not opening or pursuing an investigation based on that complaint, or is taking another action described in the notice. It does not, by itself, establish that no civil-rights violation occurred, decide every legal issue about your situation, or rule out a personal legal remedy. The notice controls what the Division has actually decided; do not read a broader conclusion into it.
The Civil Rights Division handles reports through specialized teams. Depending on the report, it may ask for more information, begin mediation or an investigation, direct the person to another organization, or say it cannot help. The Division also cautions that it may not be able to provide updates while reports are under review or an investigation or case is active. Its online reporting site and contact page describe the reporting process and possible outcomes.
Government enforcement and an individual’s possible claim are separate questions. The Division may decide not to take federal enforcement action even though a person may have options under a particular statute; conversely, not every statute the DOJ enforces gives individuals a right to sue. The law applicable to your claim, respondent, location, and circumstances determines what remedies may be available.

What should I do if the DOJ won’t investigate my civil rights complaint?
Start with the actual notice and the materials you submitted. A short, organized record helps you understand the scope of the decision and lets an agency or lawyer assess the facts without relying on memory.
- Preserve the complete record. Save the notice, any envelope or delivery details, your original complaint, attachments, and prior correspondence. Keep the dates and a copy of anything you sent or received.
- Identify the exact decision. Note whether the notice closes a particular DOJ review, declines only federal enforcement, refers the matter, asks you to correct or add information, or gives other instructions. Record the reason and any limits the notice states.
- Follow explicit instructions. If the notice names another office, asks for documents, or describes a way to respond, use the contact details and process it provides. If the instruction is unclear, ask the named office to clarify what it needs.
- Write a concise chronology. List the key events, dates, people or organizations involved, relevant communications, and any agency complaints or proceedings. Keep the underlying records together and distinguish what you directly observed from what someone told you.
- Get claim-specific legal advice promptly if you may seek personal relief. Share the notice, chronology, and documents with a lawyer familiar with the relevant civil-rights area and jurisdiction. Ask about the possible claim, forum, prerequisites, and deadline rather than assuming the DOJ decision answers those questions.
This is a practical way to act on the notice, not a determination of your rights. A general article cannot identify the controlling statute or deadline without the facts and the notice itself.
Will the DOJ send my complaint to another agency?
It may. The Civil Rights Division says it sometimes redirects complaints to another part of the DOJ or to a different federal agency that may be able to help. If no federal agency can address the issue, it suggests contacting state or local government officials or a private attorney. Check whether your notice identifies a destination, says a referral was made, or simply suggests that you contact another office. Those are not necessarily the same thing: a suggestion to contact an agency does not establish that the agency has received your file or accepted jurisdiction. If the notice names a recipient, use the stated contact information to confirm whether it received the referral and whether it needs a separate complaint. If no recipient is named, describe the issue and respondent to a qualified lawyer or the relevant government office and ask which body, if any, handles that type of matter.
Do not treat a referral as proof that the receiving agency has authority over every part of your complaint, or as a guarantee that it will investigate. The appropriate office and any required administrative process depend on the law and facts. If an office directs you elsewhere, record the date, the person or unit you contacted, and the next step it gave you.
Can I still sue if the DOJ declines my complaint?
Possibly, but the DOJ’s decision alone does not answer whether you can sue. The answer depends on the statute, the defendant, the kind of harm and remedy, the court or other forum, the jurisdiction, and any procedural requirements. Some laws allow a private action; others may limit who can sue or require steps before filing. A decision not to investigate is neither a general bar to a lawsuit nor a promise that a lawsuit is available.

The DOJ’s own materials illustrate why a single rule cannot safely be applied to every civil-rights complaint. Its Title VI Legal Manual, Section IX discusses private Title VI litigation and states that, in the circumstances it addresses, a plaintiff need not exhaust administrative remedies. In contrast, the DOJ page reproducing 34 U.S.C. § 10228 describes an administrative exhaustion provision for actions under that statute. The DOJ also explains that some police-misconduct statutes it enforces have no private right of action in its guidance on laws addressing police misconduct.
These are examples of different legal frameworks, not a way to classify your claim from a short description. Ask counsel which law could apply, whether it permits an individual action, who may be sued, what remedies could be sought, and whether an agency process is required or optional. Do not assume that a rule described for Title VI, a police-misconduct statute, or another law applies to a different claim.
Does filing with the DOJ stop the statute of limitations?
No—not according to the Civil Rights Division’s complaint form. The form warns that submitting a complaint has no effect on limitation periods that might apply to a personal claim and does not commence a lawsuit or other legal proceeding on the complainant’s behalf. It advises people who believe their rights were violated and intend to sue to contact a private attorney. Read the warning on the DOJ Civil Rights Division complaint form.

Do not infer that the clock is paused because the DOJ has your report, asks for more information, refers it to another office, or is considering a request to revisit its decision. Whether a specific event affects a particular deadline is a question of law tied to the claim and jurisdiction. Ask a lawyer to identify the deadline and whether any applicable rule changes it; do not wait for the DOJ to finish reviewing a complaint before getting that advice.
No universal filing period can be stated from the information here. Different statutes and claims can have different rules, and a notice alone may not contain enough facts to calculate the deadline. Give counsel the dates of the underlying events, your filing dates, and all agency correspondence so they can evaluate the timeline.

The official public materials described here do not establish a general reconsideration or appeal process that applies to every Civil Rights Division complaint. That does not prove that no response is possible in a particular matter; it means you should not assume there is a standard appeal, a guaranteed second review, or a deadline that applies to every notice.

First, check the notice for a response route, a request for additional information, or a named contact. If it provides one, follow its directions and keep a copy of your submission. If it does not explain a review process, contact the office identified in the notice or use the Division’s official contact page to ask whether any procedure applies to your matter. A request for clarification or reconsideration should not be treated as a substitute for advice about a possible court claim or its deadline.
What if a U.S. Attorney’s Office declined a criminal civil-rights case?
A criminal prosecution decision is different from a Civil Rights Division decision not to investigate a civil complaint. For federal criminal civil-rights matters, the DOJ Justice Manual says a U.S. Attorney’s Office declination does not bind the Civil Rights Division and places ultimate declination authority with the Assistant Attorney General for the Civil Rights Division. The manual section, “8-3.000 Enforcement of Civil Rights Criminal Statutes”, was updated in March 2018.
That rule concerns coordination of criminal enforcement. It is not a general appeal right for someone whose civil complaint was closed, and it does not guarantee that the Division will take further action. If your notice concerns a criminal referral or prosecution rather than a civil complaint, ask the issuing office what the decision covers and consult a lawyer about any personal civil remedies separately.

Contacting another agency and consulting a lawyer serve different purposes. A referral may help identify a public office with authority over the subject; a lawyer can assess an individual’s possible claim and procedural obligations. Neither route replaces the other in every case, and some matters may involve parallel agency and court processes.
