If U.S. Customs or a launch partner says your electronics shipment is being held for an FCC issue, stop distribution and identify the exact entry request before moving any units. Import permission and permission to market are separate: 47 CFR § 2.1204 controls import conditions, while § 2.803 controls marketing, including sale, offers, advertising, and distribution for sale. A shipment hold does not waive either rule.
Start with the shipment, not assumptions
Ask the customs broker or other customs contact for the precise document request or hold notice. Obtain the entry number, current shipment status, importer and ultimate-consignee details, response deadline, and the specific FCC information requested. Do not treat a general statement such as “FCC problem” as a diagnosis.
At the same time, assemble a product fact sheet for the exact units in the shipment:

- Model number, hardware revision, radio modules, antennas, firmware and regional configuration.
- Intended U.S. use and destination, including whether units are for testing, a trade show, distribution, sale, repair or export.
- FCC ID, certification grant, certification application number or Supplier’s Declaration of Conformity status, if applicable.
- Quantity in the shipment and the identity of the legal owner while the units are in the United States.
- Packaging, labels, invoices, purchase orders and any prior authorization documents.
Compare those facts with the exact paragraph of § 2.1204 that you intend to use. The ultimate consignee must be able to document both compliance and the legal basis for the import condition. Preserve that evidence with the entry file.

Until the authorization and import condition are clear, pause activity that could be marketing, operation, display, consumer delivery or sale. Under § 2.803, “marketing” is broader than completing a retail sale; it includes offers, advertising, importation, shipment and distribution for sale, subject only to the rule’s limited exceptions.
Import authorization and marketing authorization are different questions
A device may qualify for a narrow import exception yet still be barred from display, operation, delivery or sale. Conversely, a marketing arrangement does not remove the need to satisfy the import conditions at entry. Make two separate determinations:
- Can these units enter the United States under a specific § 2.1204 condition?
- What activities are allowed after entry under § 2.803 and the applicable authorization status?
Write the answers beside the shipment number. This prevents a common error: using a testing import exception to justify sales, or assuming that a pending certification application allows customers to receive and use the product.

Section 2.1204(a)(11) allows a certification device to be imported in a quantity of 12,000 units or fewer that share the same FCC ID for pre-sale activity. This is a tightly controlled launch-logistics route, not a general pre-certification sales waiver.

Conditions that must be met before import
- Compliance testing must be complete at an FCC-recognized accredited laboratory.
- An application for FCC certification must have been submitted to an FCC-recognized Telecommunications Certification Body (TCB).
- The units must be tied to the same FCC ID, and the total quantity must not exceed 12,000.
- Each device or its packaging must carry the required prominent, visible and temporary removable label.
- Legal ownership must remain with the manufacturer, developer, importer, ultimate consignee or designated customs broker.
- A retrieval process must exist, with immediate retrieval after a determination that certification cannot be completed.
- Recipient records must be retained for 60 months.
The required label states: “This device cannot be delivered to end users, displayed, or operated until the device receives certification from the FCC. Under penalty of law, this label must not be removed prior to receiving an FCC certification grant.” Use the wording specified by the rule rather than an informal substitute.
What the route permits—and what it does not
The rule permits packaging and transfer of physical possession to distribution centers and retailers for pre-sale activity. Before certification, however, the devices generally cannot be delivered to end users, displayed, operated or sold, except for the limited, expressly conditioned marketing arrangement in § 2.803. A warehouse transfer is not consumer delivery, and a retailer’s possession does not authorize a demonstration.
Recipient records must identify the device or product, quantity, date the authorization was sought, expected FCC ID and recipient contact information. Keep records for the full 60-month period and make sure each recipient understands the no-delivery, no-display and no-operation restrictions.

The related marketing exception requires prominent disclosure of the pending FCC authorization and the delivery contingency. The disclosure must address that FCC rules do not determine whether consumer-protection or contract law applies, and it must explain the initiating party’s responsibility if authorization fails, including applicable refund information. For certification devices, completed accredited testing and a TCB filing are prerequisites to physical pre-sale transfers; ownership, labeling, retrieval and recordkeeping controls still apply.

Devices subject to Supplier’s Declaration of Conformity cannot be physically transferred before the authorization process is complete. Do not apply the certification-device pathway to an SDoC product.
Other import conditions and their limits
Section 2.1204 contains several fact-specific alternatives. The quantity and use limits below are not interchangeable:

Larger quantities under an applicable exception may require written approval from the FCC Office of Engineering and Technology. The facts supporting an exception—purpose, quantity, consignee, ownership and controls—should be documented before entry, not reconstructed after a hold begins.
Do not confuse the 4,000-unit and 12,000-unit routes
The 4,000-unit provision is for testing, evaluation, development or determining suitability for marketing, and it bars an offer for sale or marketing. The 12,000-unit provision is for controlled pre-sale logistics after accredited testing is complete and a certification application has been submitted to a TCB. It carries the temporary label, ownership, retrieval and 60-month record requirements.

If your launch plan involves retailer inventory, conditional pre-sales or distribution-center transfers, the 4,000-unit testing pathway is not a substitute for the certification pre-sale pathway. Select the paragraph that matches the actual purpose of the shipment.
Check whether the FCC authorization matches the actual product
A certification grant or FCC ID is useful only if it covers the units being imported. Compare the grant and application against the hardware revision, radio chipset, antenna, enclosure, power configuration and firmware that will be shipped. A change that affects the certified radio configuration may require a new filing or permissive change rather than reliance on an older grant.
For a pending application, verify the filing date, applicant, FCC ID sought, test reports and product description with the TCB. The fact that a filing exists does not by itself authorize end-user delivery or operation. For an SDoC device, confirm that the responsible party has completed the applicable conformity process before physical transfer.

Customs broker
The broker can explain the entry-specific request, customs status and documents needed for the particular shipment. Ask what data or evidence must be corrected or supplied, then provide the documented § 2.1204 basis and supporting records. A broker cannot turn an ineligible device into an eligible import.

Accredited compliance laboratory
An FCC-recognized accredited laboratory can address outstanding compliance testing, configuration questions and test-report completeness. Give the laboratory the exact production hardware and software, not a prototype that differs from the shipment.
Telecommunications Certification Body
An FCC-recognized TCB reviews and processes certification applications. Ask it to confirm whether the application is complete, whether the FCC ID and product description match the shipment, and what technical or administrative items remain. None of these professionals can guarantee a release date.
FCC Form 740 and current customs workflow
FCC OET KDB publication 997198 is the FCC’s importation-guidance entry for identifying goods that require equipment authorization. Its attachment should not be treated as a substitute for the live regulation or current FCC guidance.
FCC 17-93 documents the Commission’s elimination of the FCC-specific customs declaration associated with Form 740 after changes to customs electronic filing. Do not assume that filing Form 740 is a routine fix for a present shipment hold. Ask the broker exactly what entry data or supporting evidence U.S. Customs and Border Protection is requesting, then separately establish which FCC import condition applies.
A practical response sequence
- Record the hold: Capture the entry number, shipment status, document request, deadline, importer and ultimate consignee.
- Freeze risky activity: Stop sale offers, advertising, consumer delivery, display and operation until the authorization and exception analysis is complete.
- Identify the product: Match model, revision, radio configuration, firmware, antennas and quantity to the shipment.
- Check authorization: Determine whether a valid grant covers the exact configuration, whether certification is pending, or whether SDoC applies.
- Select the import condition: Compare the facts with § 2.1204, including quantity, purpose, ownership and no-marketing limits.
- Complete professional review: Send testing gaps to an accredited laboratory and certification gaps to a TCB; send entry questions to the broker.
- Install controls: Apply the required temporary label, preserve legal ownership, establish retrieval procedures and create recipient records where the selected pathway requires them.
- Respond to the broker: Provide the entry-specific evidence and ask what action remains for that entry. Keep a written record of the response.
Currentness and timing cautions
The eCFR pages display Title 47 as current through October 8, 2026 and state that it was last amended October 6, 2026. Those pages also flag amendments published September 11, 2026 that had not yet been applied to the displayed text. Before acting on a newly published change, verify the Federal Register amendment and its effective date, then confirm how it applies to the device and entry.
No rule or source establishes a guaranteed customs-release, TCB-review or certification timeline. Treat every date supplied by a carrier, broker, laboratory or launch plan as an operational estimate rather than a regulatory promise.
