If an automated or AI-assisted mortgage decision looks wrong, do not argue with the software first. Identify whether you received a new-loan denial, found an error in a credit report, suspect discrimination, or are dealing with an existing loan-servicing problem. Then get the decision and its specific reasons in writing, check the underlying records, dispute inaccurate information, and use the correct escalation route.
U.S. rules require a creditor to give specific adverse-action reasons, or tell you how to obtain them, even when a complex algorithm made or supported the decision. The process below is consumer information, not individualized legal advice.
Start by identifying what went wrong
The right remedy depends on the event. A new mortgage application that was denied is handled differently from a payment, escrow, or account error on a mortgage you already have.
| What happened | First responsible party | Best next step |
|---|---|---|
| New-loan denial or other adverse action | The lender or creditor that made the decision | Request the adverse-action notice and the specific principal reasons; ask how to request reconsideration. |
| Incorrect item in a credit report | The credit-reporting company and the company that supplied the information | Obtain the report identified in the notice and dispute the inaccurate item with both parties. |
| Possible discrimination | The lender, the CFPB complaint process, and potentially state authorities | Preserve the facts and communications, then seek tailored advice and consider a complaint. |
| Error on an existing mortgage account | Your mortgage servicer | Use the servicer’s written notice-of-error procedure; do not treat it as an appeal of underwriting. |
A disappointing result alone does not prove an AI error or unlawful discrimination. Your goal is to determine which information was used, what reason the creditor relied on, and whether the information or process was wrong.

1. Get the adverse-action decision and reasons in writing
When a lender denies credit or takes another adverse action, ask for the written adverse-action notice immediately. The notice should provide the specific principal reasons for the decision or explain how to obtain those reasons. The Consumer Financial Protection Bureau (CFPB) says that a statement merely indicating that a credit report was obtained is not, by itself, the specific explanation required under the Equal Credit Opportunity Act (ECOA) and Regulation B.
What to request
- A complete copy of the adverse-action notice, including the date and the application or loan reference number.
- The specific principal reasons for the denial or unfavorable terms, stated in understandable terms.
- The identity of any credit-reporting company named in the notice and the instructions for obtaining the report.
- Whether the application was incomplete, treated as a counteroffer, or denied for another stated reason.
- The lender’s process for correcting information and requesting reconsideration or a manual review.
Send a written request through a channel that creates a record, such as the lender’s secure message system, email address listed for application questions, or a letter to the address provided in the notice. Keep the original notice and a copy of your request. The CFPB’s sample forms show that consumers may encounter different notices, including adverse-action, credit-score, counteroffer, and incomplete-application forms; a sample is an example, not a universal form that controls every case.
Why an AI explanation is still required
The CFPB’s Circular 2022-03 states: “The adverse action notice requirements of ECOA and Regulation B, however, apply equally to all credit decisions, regardless of the technology used to make them.” A lender cannot avoid giving specific, accurate reasons by saying that its model is proprietary, too complex, or impossible to interpret. The obligation belongs to the creditor, even if a vendor supplied the software or an automated system generated the recommendation.

The explanation should identify the actual principal factors that affected your application. It should not substitute a generic statement such as “the algorithm declined your application” or simply repeat that a report was accessed. Ask the lender to clarify any code, abbreviation, or broad category that you cannot understand.

2. Check every record the lender relied on
Once you know the stated reasons, compare them with your own records. A wrong date, account status, balance, income entry, employment detail, debt, or public-record item can produce a different automated result. Do not assume that a model-created score is the original source of the problem; the model may have processed an inaccurate record supplied by a reporting company or by the lender itself.
Review the credit report named in the notice
- Follow the adverse-action notice’s instructions to obtain the report from the credit-reporting company it identifies.
- Compare names, addresses, account numbers, balances, payment history, limits, dates, and collection or public-record information with your statements and other documents.
- Mark each item that is inaccurate, incomplete, duplicated, outdated, or not yours. Save a dated copy of the report before filing a dispute.
- Check whether the report reflects the information that the lender said was a principal reason for the decision.
The CFPB advises consumers to dispute inaccurate credit-report information with both the reporting company and the company that supplied the information. A dispute to only one party may leave the other party’s records unchanged. Use each party’s stated dispute method, attach concise supporting documents, and retain confirmation numbers, submitted forms, attachments, and responses.
Preserve an evidence file
- The application, disclosures, rate or fee quote, and any preapproval communication.
- The adverse-action notice and every explanation supplied by the lender.
- Copies of relevant credit reports and supporting statements.
- Your disputes, delivery or submission confirmations, responses, and correction notices.
- Dates, names, job titles, and summaries of calls or secure messages.
Keep the file factual. A clear timeline makes it easier for the lender, a counselor, an agency, or an attorney to identify whether the issue was a source-data error, a misunderstanding of the reason, or a separate legal concern.

3. Ask the lender to review corrected or missing information
After you identify an inaccurate or missing item, tell the lender what changed and provide the correction notice or other supporting record. Ask how the lender handles corrected records, reconsideration, or a new application. The CFPB guidance supports requesting reasons and disputing inaccurate credit information, but it does not promise that a lender must reverse a decision or follow one universal reconsideration procedure.

A useful written request
Keep the request narrow and attach evidence. You can adapt this wording:
Subject: Request for review of mortgage application decision [reference number]
I received an adverse-action notice dated [date]. It lists these principal reasons: [quote the reasons]. The following information appears inaccurate or incomplete: [identify the item and source]. I have attached [documents or correction response]. Please explain how to submit corrected information and how your reconsideration or manual-review process works. Please confirm in writing whether the corrected information was reviewed.
Do not describe this letter as a guaranteed appeal. Its purpose is to create a precise record and learn the lender’s process.
4. Ask focused questions about the automated decision
You may not receive the model’s code, internal weights, or every data point. You can still ask questions that test whether the stated reasons are accurate and complete.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- Which specific facts were principal reasons for the adverse action?
- Did the decision rely on a credit report, a score, information entered in the application, or another record?
- Was any information missing, conflicting, or treated as unverifiable?
- Did the lender identify the application as incomplete or make a counteroffer instead of issuing a final denial?
- What documentation will the lender accept to correct the disputed fact?
- After a correction, is a reconsideration or new application required?
These questions target verifiable facts rather than demanding that the lender disclose confidential technology. If the answer is still a generic reference to an opaque algorithm, repeat that you are requesting the specific principal reasons for the adverse action. Technology does not remove that explanation requirement.

5. If discrimination may be involved, document before escalating
Mortgage discrimination can involve being refused credit despite qualifying, receiving less favorable terms, or being treated differently in the application process. A denial by itself is not proof. Look for facts that connect the outcome to a protected characteristic or to different treatment of similarly situated applicants.
Build a factual record
- Write down dates, names, statements, and the exact terms offered or refused.
- Keep copies of advertisements, application screens, emails, notices, and fee or rate quotes.
- Record any inconsistent explanation or change in reasons.
- Note relevant comparisons only when you have reliable information about the other applicant’s circumstances.
- Preserve evidence of corrected records and the lender’s response to them.
The CFPB says consumers who believe a mortgage lender discriminated can submit a CFPB complaint. You can also obtain advice about applicable state protections. Do not label conduct discriminatory solely because an automated result was surprising; explain the observable facts and let the reviewing agency or adviser assess them.
Check the current rule before relying on older summaries
Federal Regulation B is subject to change. The CFPB’s current Regulation B material reports amendments in 2026 affecting provisions concerning disparate impact, discouragement, and special-purpose credit programs. Older articles may describe those provisions differently. Before making a detailed legal claim, check the current official regulation and the law in your state. This article does not determine whether a particular decision violated ECOA, Regulation B, the Fair Housing Act, or state law.
6. Do not confuse a servicing error with an underwriting denial
If you already have a mortgage and the problem concerns a payment, escrow amount, payoff figure, account balance, payment application, or another servicing action, you are not appealing the original underwriting decision. Contact the servicer and use its written notice-of-error process described by the CFPB.

Use the servicer’s designated written process
- Read your mortgage statement or servicing correspondence for the address and instructions used for written notices of error.
- Identify the loan and describe the specific servicing action you believe is wrong, including relevant dates and amounts.
- Attach copies of statements, payment confirmations, or other records that support the description.
- Keep a complete copy and proof of delivery or electronic submission.
- Review the servicer’s response and escalate unresolved issues through the CFPB complaint channel if the response is inadequate.
Follow the servicer’s published process rather than sending a generic “AI appeal.” The servicing notice-of-error route and the response requirements are distinct from the adverse-action notice you receive after a new mortgage application is denied.
7. Get neutral help when the facts are difficult
A HUD-approved housing counselor can help you assess affordability, review readiness, organize documents, and consider options after a denial. A counselor does not control the lender’s decision and cannot guarantee approval. The CFPB specifically identifies HUD-approved counseling as a resource for consumers evaluating their ability to pay.
Consider individualized legal advice if the lender will not provide specific reasons, the records remain contradictory after disputes, you believe you were treated differently because of a protected characteristic, or the financial consequences are substantial. Bring your evidence file rather than relying on memory.

Common mistakes that weaken a challenge
- Arguing about “AI” without identifying the wrong fact. Point to the inaccurate account, income entry, status, or stated reason.
- Accepting a generic credit-report reference as a full explanation. Ask for the specific principal ECOA reasons.
- Disputing only with the reporting company. The CFPB advises disputing with the reporting company and the information provider.
- Assuming a correction guarantees approval. A lender may review the information and still reach a different lawful decision.
- Using the wrong escalation route. New-loan denials, discrimination concerns, credit-report disputes, and servicing errors have different responsible parties.
- Relying on an old legal article. Verify current federal rules and state protections, especially after the 2026 Regulation B changes.
- Failing to preserve records. Notices, reports, disputes, and responses are often the evidence needed to explain what happened.
A practical decision path
- Denied for a new mortgage? Obtain the adverse-action notice and specific reasons.
- Reason points to a report? Get the identified report and compare it with your records.
- Found an error? Dispute it with the reporting company and the information provider, then notify the lender.
- Correction made but the outcome is unclear? Ask about reconsideration or a new application; do not assume reversal is required.
- Facts suggest different treatment or protected-class concerns? Preserve the evidence and consider a CFPB complaint, state protections, and tailored legal advice.
- Problem is with an existing loan account? Use the servicer’s written notice-of-error process instead.
- Need help assessing affordability? Contact a HUD-approved housing counselor.
What the evidence can—and cannot—show
The available federal guidance establishes procedures for obtaining reasons, checking and disputing credit information, addressing possible discrimination, and reporting servicing problems. It does not establish a national rate of erroneous AI mortgage decisions, a guaranteed appeal success rate, or a single reconsideration process used by every lender. Treat each number or reason in your own notice as specific to your application and the records used for it.
The most effective response is therefore document-driven: obtain the actual reason, test the underlying fact, correct the record with every relevant party, and escalate through the channel that matches the problem. If the lender’s explanation remains vague or the facts point to unequal treatment, use the CFPB complaint process and qualified advice rather than trying to reverse-engineer the software yourself.
