Save evidence first, then report the ad through the platform’s privacy, impersonation, intellectual-property, or intimate-image process that fits the facts. The correct next step depends on whether the image is intimate, who owns the original photograph, whether the ad falsely suggests your endorsement, which platform published it, and the law of the relevant state.
This is a U.S.-focused guide. It explains practical reporting and escalation options, but it cannot determine whether a particular ad violates a law or what damages may be available. Those questions require the actual ad, source image, platform, jurisdiction, and facts.
Start by preserving proof
An ad can be edited or deleted before a platform reviews your complaint. Create a record before submitting reports.

- Capture screenshots and, when useful, a screen recording. Include the image, surrounding text, advertiser or account name, product, price or offer, endorsement language, comments, and visible platform identifiers.
- Record the date and time. Note your time zone and where you saw the ad.
- Preserve communications. Keep messages from the advertiser, platform, agency, or anyone who sent you the ad. Save report numbers and confirmation emails.
- Keep the original photograph and its history. Identify who took it, when it was taken, and whether you have the original file or editing records. That information matters to a copyright claim.
For a report under the TAKE IT DOWN Act, Federal Trade Commission (FTC) guidance says to identify the platform and where the image appears, then download a copy of the FTC report after submitting it. Keep that downloaded report with your other evidence.

Choose the route that matches the ad
There is no single “AI image” takedown rule. Use the following distinctions before choosing a complaint.

When the TAKE IT DOWN Act may help
The TAKE IT DOWN Act addresses covered nonconsensual intimate imagery, including qualifying digital forgeries. It is not a general removal guarantee for every AI-generated advertisement, face swap, or unauthorized use of a person’s likeness.
What the covered process requires
For a qualifying image on a covered platform, submit the platform’s designated request identifying where the image appears and asking for removal. The FTC says a covered platform must remove the covered image and known identical copies within 48 hours after receiving a valid request. This is a statutory response period for the Act’s covered process, not a deadline that applies to ordinary non-intimate ads or every likeness complaint.

If a covered platform has no request process, its process is broken, or it does not remove the covered image and known identical copies within 48 hours of a valid request, report the platform to the FTC at TakeItDown.ftc.gov. Keep the platform submission, confirmation, timestamps, and your downloaded FTC report.

The FTC’s May 19, 2026 compliance announcement quotes Chairman Andrew Ferguson: “If someone shared an intimate photo or video of your child, or of you without your consent, it can be stressful and overwhelming.” The statute’s process is designed for that covered category; do not describe it as a universal AI-ad takedown service.
What the platform penalty means
The FTC’s May 2026 business guidance says platforms violating the Act may face civil penalties of $53,088 per violation. That figure concerns platform compliance. It is not an amount automatically payable to the person depicted and does not establish your damages.
Report a non-intimate ad to the platform
For a conventional product ad, synthetic portrait, avatar, or face replacement that is not covered intimate imagery, select the platform route that best describes the harm.
Impersonation or identity misuse
Use an impersonation or identity-misuse form when the account or ad presents itself as you, uses your name, or creates a realistic false association. State exactly what is fabricated and attach the URL and screenshots.

Privacy or unauthorized-image reporting
Use a privacy or unauthorized-image route when the issue is publication of your image rather than ownership of the underlying photograph. Explain whether the image is synthetic, altered, or copied and whether you consented to this commercial use.
Intellectual-property reporting
Use an intellectual-property form when you own the photograph or another protected work that the ad copied. Be precise about which work you own; a claim based only on appearing in another person’s photograph can be rejected.
Report every location
If the same creative appears in multiple ads, accounts, or landing pages, report each URL and cross-reference the related reports. Preserve each confirmation rather than assuming one report reaches every copy.
Understand when a DMCA notice fits
Copyright protects the photograph as a creative work. It does not automatically give the person pictured ownership of the image.

If you took the photo
The U.S. Copyright Office states: “If you took the photo—for example, if it is a selfie—then you are likely the copyright owner and can submit a takedown notice under section 512.” A selfie or other photograph you created can therefore support a DMCA notice when the ad copied that photograph.
If someone else took the photo
If a friend, photographer, employer, or agency made the photograph, you usually cannot send a copyright notice in your own name merely because your face appears in it. Ask the copyright owner to submit the notice, or use a different legal or platform-policy route based on your own rights.
What a notice must contain
A DMCA notice goes to the service provider’s designated agent. It must identify the copyrighted work, identify the allegedly infringing material and its location, provide the required contact information, include the required good-faith and accuracy statements, and include the copyright owner’s or authorized agent’s signature. Use the provider’s published designated-agent instructions and retain a complete copy of what you sent.
Do not describe a likeness complaint as a copyright claim unless you can truthfully identify the photograph or other work you own. A false ownership statement can undermine the request and create additional risk.

Address a false endorsement or testimonial
An AI ad can cause a separate problem when it implies that you personally used, approved, or recommended a product. Save the exact wording, voice-over, captions, logo placement, and any first-person statement. “I use this product” communicates something different from a neutral fictional avatar that merely resembles a generic person.
FTC guidance does not categorically prohibit AI avatars. However, an unauthorized celebrity avatar used to create a favorable testimonial may violate the FTC’s endorsements rule if reasonable consumers would think that celebrity actually gave the testimonial. The same factual question—what would a reasonable viewer believe?—can matter when the person is not a celebrity.
Report a misleading endorsement through the platform’s ad or deceptive-content channel and preserve the claim. Depending on the facts, an attorney may also evaluate state publicity or privacy rights and other federal theories.
Consider state publicity and privacy law
Unauthorized commercial use of a person’s identity can implicate state publicity or privacy law. The available rights, definitions, exceptions, remedies, and deadlines vary by state and may depend on where the person lives, where the advertiser operates, where the audience is located, and how the image was used.
The U.S. Copyright Office’s report on copyright and artificial intelligence identifies possible state privacy and publicity frameworks, along with federal copyright, FTC Act, Lanham Act, and Communications Act provisions. Those are issue-spotting frameworks, not a conclusion that every claim succeeds. A licensed attorney can analyze the applicable state, preservation requirements, demand strategy, litigation options, and limitation periods.
Use this decision sequence
- Classify the image. Mark it as intimate, a qualifying digital forgery of intimate imagery, or non-intimate.
- Identify the publisher. Determine whether the ad is on a covered platform and which reporting forms it offers.
- Separate the rights. Ask who took and owns the original photograph, and separately ask whose likeness or identity the ad uses.
- Check the message. Identify any statement, voice, caption, or design that suggests you endorsed the product.
- Submit the narrowest accurate report. Use the platform’s intimate-image, privacy, impersonation, intellectual-property, or deceptive-ad route that matches your evidence.
- Track the response. Save timestamps, ticket numbers, replies, removals, reuploads, and any remaining URLs.
- Escalate only within the applicable rule. Use the FTC’s Take It Down process for a covered intimate-image failure; seek jurisdiction-specific legal advice for other disputes.
Common mistakes that delay removal
- Sending a DMCA notice because your face appears in the image. Copyright ownership usually follows the person who created the photograph, not every person depicted.
- Invoking the 48-hour rule for a normal ad. The deadline belongs to the TAKE IT DOWN Act’s covered intimate-image process.
- Reporting without preserving the URL. A screenshot alone may not identify the account, campaign, or copy that must be reviewed.
- Leaving out the endorsement claim. If the ad says or implies you used the product, quote that language and identify where it appears.
- Assuming an AI label makes the use lawful. Disclosure that an image is synthetic does not, by itself, answer copyright, publicity, privacy, or deception questions.
- Treating a platform penalty as personal compensation. The FTC’s $53,088 figure is a possible civil penalty against a violating platform, not an automatic payment to you.
When to contact a lawyer
Get advice from a licensed attorney in the relevant jurisdiction when the ad is still running after reports, the image is intimate, the advertiser is selling widely, the ad uses your name or voice, you face reputational or employment harm, the original photograph’s ownership is disputed, or you are considering a demand or lawsuit. Bring the preserved files, URLs, report confirmations, source-image information, and a timeline. The facts needed to assess liability, damages, choice of law, and deadlines are case-specific.
